SOUTH BURLINGTON PLANNING COMMISSION
The South Burlington Planning Commission will bold a public
hearing at the South Burlington City Hall, Conference Room, 575
Dorset Street, South Burlington, Vermont on Tuesday, May 13,
1986, at 7:30 P.M. to consider the following:
1) Public hearing: Final Plat application of Gregory and Carole
Lothrop for the subdivision of a 3.1 acre parcei into — ree--

1. Review Minutes of 6 May 1986
Mrs. Maher moved that the Minutes of 6 May be approved as
printed. Mr. Belter seconded, and the motion passed
unanimously.
2. PUBLIC HEARING: Final Plat application of Gregory & Carole
Lothrop for the subdivision of a 3.1 acre parcel into 3 lots
of .28 acres each and enlargement of existing properties at
99 and 171 Kirby Road and dedication of remaining 2 acres to
the City located at 157 Kirby Rd.

A small corner of property will be deeded to Ms. Swan to even
off her property. Access to the city property is off Duval
St. Mr. Lothrop agreed to save the larger trees.
Mrs. Maher moved that the S. Burlington Planning Commission
approve the Final Plat application of Gregory & Carole
Lothrop for the subdivision of a 3.1 acre parcel into 3 lots
of .28 acres each and the enlargement of the existing
porperties at 99 and 171 Kirby Rd. and the dedication of the
remaining 2 acres to the City located at 157 Kirby Rd. as
depicted on a plan entitled "Plat of Survey showing proposed
subdivision: Gregory and Carol Lothrop property" prepared
Warren A. Robenstein, dated April 1, 1986 with the following
stipulations:
1. The large trees at the northwest corner of lot #3 shall
not be removed unless approved by the City Engineer and Tree
Warden.
2. The deed for the dedication to the City of the southerly

within 45 days.
3. Grading around each house shall be done so that runoff is

toward the ravine, not toward Kirby Road.
4. A sewer allocation of 450 gallons per day per lot is made
in accordance with the South Burlington sewer policy.
5. It is the applicant's responsibility to record the final
Plat with the City Clerk within 90 days or this approval
shall be invalid. It must be approved 12y the Planner and
singed by the Chairman or Clerk of the Planning Commission
prior to recording.
6. The southeast corner of the 2.1 acres may be deeded to the
adjacent property owner, Joan Swan. The Plat must be amended
prior to recording. T
Mr. Belter seconded, and the motion passed unanimously.
Mr. Bevins of 36 Duval asked if it would be possible to clear
and seed some of the city land that adjoins his, to even out
his property. Mr. Jacob said he was sure it would be OK and
suggested Mr. Bevins talk with Mr. Szymanski.
3. PUBLIC HEARING: Final Plat application of John Belter for
continuation of the industrial subdivision with lots #9-21 at
Ethan Allen Farm Industrial Park (repeated due to applicant's
failure to meet filing deadlines) Mr. Belter stepped down
during this discussion.
Mrs. Lafleur said the application is identical to the one
.passed except one of the stipulations on the last approval
was the dedication of the 5.25 foot wide strip on either side
of Ethan Allen Drive. It is not shown on the plan but the
deed is already in the City's possession. She added that
work on Ethan Allen Dr. will start in 1987-88. Sonny Audette
is applying for special funds for fixing dangerous inter-
sections. Ms. Peacock asked for some background on the
project as she had not been on the Commission when it was
passed. Mr. Jacobs provided a brief summary.
Mrs. Maher moved that the S. Burlington Planning Commission
approve the Final Plat application of John Belter for the 13
lot industrial subdivision as depicted on a plan entitled
"Ethan Allen Farm, Industrial Subdivision lots 9-21" as
prepared 12y Warren A. Robenstien, dated August, 1985 with the
following stipulations:
1. On -site sewage disposal systems for each lot shall be in-
stalled in the front yards so that connection to a future
sewer main in Ethan Allen Drive is possible.
2. The 5.25 foot wide dedication for future street widening

stand(s) that the information required by Section 3-08 of the Rules must be submitted for evaluation. If such
information does not meet the Environmental Protection Rules, permission to build on the lot will be denied.
(3) The conditions of this permit shall run with the land and will be binding upon and enforceable against
the permittee and all assigns and successors in interest. The permittee shall be responsible for recording this permit
and the "Notice of Permit Recording" in the City of South Burlington Land Records within 30 days

This project consisting of a four lot subdivision, lots 1, 2 + 3
being 76' x 170' with municipal water and sewer services, and a
fourth lot being subject to Deferral of Permit No. D-4-0949,
located on Kirby Road in the City of South Burlington, Vermont
is hereby approved under the requirements of the regulations
named above, subject to the following conditions:
GENERAL
(1) The subdivision must be completed as shown on the plans
prepared by Ron Muir and which have been stamped APPROVED by
the Division of Protection. No changes shall be made to the
approved plan without prior written approval from the Agency
of Environmental Conservation.
(2) Each prospective purchaser of any lot of the subdivision
shall be shown a copy of the approved plot plan, the
engineer's site report and the Land Use Permit
prior to conveyance.
(3) This project has been reviewed and is approved for the
construction of one single family residence on each of the
approved lots. Construction of other type dwellings,
including public buildings, duplexes and condominium units,
is not allowed without prior review and approval by the
Agency, and such approval will not be granted unless the
proposal conforms to the applicable laws and regulations.
(4) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee
and all assigns and successors in interest. The permittee
shall be responsible for recording this permit and the

2) LOTHROP SUBDIVISION, 157 KIRBY ROAD
Mr. & Mrs. Lothrop propose to subdivide the 3.1 acre parcel
between 99 and 171 Kirby Road into 3 lots of .28 acres each,
enlarge the existing properties at 99 and 171 Kirby Road and
dedicate the remaining two acres to the City. The property is
zoned R4. Although the lots will be of adequate size for a duplex
on each (12,000 square feet minimum), the Zoning Board has
already granted a variance for the single-family frontage
requirement of 80 feet; each lot has 76.1 feet of frontage.
During Sketch plan review, Bill Szymanski noted that the large
tree near. 99 Kirby Road should be saved. There are two enormous
trees and they are very much alive.
3) BELTER, ETHAN ALLEN DRIVE, LOTS #9 - #21
John Belter neglected to record the mylar for these 13 lots
within the required 90 days. Therefore, this subdivision is
invalid. It was approved on June 25, 1985. The Commission has
approved site plans for a number of lots in the first phase of
the subdivision. All Act 250 permits have been obtained and all
legal documentation is in order.
Access: Lots #9 through #18 will access directly onto Ethan
Allen Road. These driveway intersections have adequate site
distance. A private road will be constructed to access lots #19,
#20 and #21. Each lot will need separate site plan approval
prior to construction. All lots will have on site sewage dispo-
sal; systems must be installed so that a future connection to a
sewer main in Ethan Allen Drive is possible.
Traffic Impact: A 5.25 foot wide strip of land on either side of
Ethan Allen Drive will be dedicated to the City for future street
widening. Mr. Belter also dedicated land at the intersection of
Shamrock Road and Airport Parkway so the intersection could be
straightened. Also, he will pay $5,000 in $1,000 installments
for future road improvements.
Other traffic information that was presented to the Environmental
Commission and their findings are enclosed.
The Environmental Commission noted, as did the Planning Commis-
sion, the unsafe intersection at Ethan Allen Drive. The Environ-

3) LAKEWOOD DEVELOPMENT, SHELBURNE ROAD
1. Drainage pipe shall be concrete, plastic or asbestos cement
not metal or aluminum.
2. A sidewalk should be included along Shelburne Road. There
shall be at least a 5 foot grassed strip between curb and
sidewalk.
3. The culvert pipe across the access drive is too shallow. It
should be replaced with a drop inlet and piped to the inlet on
the line to Holmes Road.
4) HARBOR INN, SHELBURNE ROAD

5. Sketch Plan application of Gregory Lothrop for subdivision
of a 3.1 acre parcel into 3 single family lots and
enlargement of existing single family parcel located a 157
and 171 Kirby Rd.
Mr. Lothrop said the land is being surveyed now. He bought
it to develop as single family homes in conjunction with the
character of the neighborhood. He would donate to the city a
piece of land to join up with other city -owned land. Mr.
Muir said the oak trees the City Engineer said should be
saved seem dead to him. Mrs. Lafleur will check on this.
Mr. Lothrop said he hadn't planned to remove them unless nec-
essary.
6. Site plan application of M_ & M Partnership for Easy Self
Storage (Donald Marek & Arnold Marek) for construction of a
1500 sq. ft. storage building at 46 Swift St.
The Zoning Board approved this plan for 5 buildings years
ago; however, the Planning Commission approved only 4. They
are now asking for the 5th building. Lot coverage would be
at 68%. The only concern is with seeding and stabilizing the
bank. Mrs. Hurd asked if the Southern Connector will affect
the property. Mrs. Lafleur said some property will be taken.
She felt there wouldn't be new pavement but only an extension
of the right-of-way. Mr. Donald Marek said they get only
about 10 to 15 cars a day, virtually no traffic.
Mr. Dooley moved that the South Burlington Planning Com-
mission approve the site plan application of M_ & M Partner-
ship for construction of a 1500 sq. ft. mini -storage building
at 46 Swift St. as depicted on a plan entitled Easy Self
Storage, 46 Swift St, South Burlington, Vermont" prepared
Don Marek, dated 3/3/86 with the following stipulations:
1. A $750 landscaping bond shall be posted prior to permit.
A new plan valued at $750 shall be approved 12y the City
Planner prior to permit. It shall include plantings east of
the new building toward the Correctional Center to stabilize
the bank.
2. The field area along the interestate shall be graded and
topsoil placed and seeded prior to permit.
3. The building permit shall be obtained within 6 months.
Mr. Belter seconded, and the motion passed unanimously.

prior to permit.
4) HARBOR INN, SHELBURNE ROAD
John Larkin never recorded the final plat for the approved sub-
division within the required 90 days. I am beginning this
approval at sketch plan but suggest we can proceed directly to
final plat.
The swimming pool will be enclosed in one building. There are no
other changes to the plan.
5) LOTHROP, 157 AND 171 KIRBY ROAD
The applicant requests to subdivide a 3.1 acre parcel into 3
single-family lots of 13,000 square feet each. The remainder of
the parcel will be attached to the property at 57 Kirby Road.
The area is zoned R-4.
Each lot will have 76.2 feet of frontage. A variance from the 80
foot frontage requirement was granted by the Zoning Board.
The remaining acreage (approximately 22 acres) is a large gully
that connects to City owned land. It will become part and parcel
of the property at *157 Kirby Road. (See Bill Szymanski`s
comments.)
6) M & M PARTNERSHIP, 46 SWIFT STREET
This application is for approval of a fifth mini -warehouse at
Easy Self Storage on Swift Street. Although the Zoning Board
approved 5 structures, the Planning Commission minutes of May 24,
1983 show approval of only 4. (Enclosed) These buildings have
been built on fill and the site drops steeply towards the Correc-
tional Center.
Lot coverage will be 69 %. Access, circulation and parking will
not change as a result of this additional building. However, the
proposed structure will be built at the edge of the steep
dropoff. The proposed unit can not be accessed on the northern
side due to the steep drop off. There will only be 5 feet to the
edge of the bank. New landscaping valued at $750 should be
planted on the steep bank to stabilize it. (See Bill Szymanski`s
comments.)
