GENERAL This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from the Department of Labor and Industry -phone (802) 828-21.06 or (802) 658-2199 and local officials prior to proceeding with this project. 2. The project shall be completed as shown on the plans prepared by Tricia LaFleche which have been stamped "approved" by the Wastewater Management Division. The project shall not deviate from the approved plans without prior written approval from the Wastewater Management Division. Each prospective purchaser of the lot shall be shown a copy of the approved plot plan and this Subdivision Permit prior to conveyance of the lot. 4. The conditions of this permit shall run with the land and will be binding upon and enforceable against the permittee and all assigns and successors in interest. The permittee shall be responsible for the recording of this permit and the "Notice of Permit Recording" in the town of South Burlington Land Records within 30 days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 5. This project has been reviewed and is approved for the construction of one four bedroom single family residence on the approved lot. By acceptance of this permit, the permittee agrees to allow representatives of the State of Vermont access to the property subject to this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental/health statutes and regulations. WATER SUPPLY 8. The lot is approved for water supply by connection to the municipal water system as depicted on the stamped plans. No other means of obtaining potable water shall be allowed without prior review and approval by the Wastewater Management Division. SEWAGE DISPOSAL 9. The lot is approved for wastewater disposal by connection to the municipal sewer system as depicted on the stamped plans for a maximum of 600 gallons of sewage per day. No other method of wastewater disposal shall be allowed without prior review and approval by the Wastewater Management Division, and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. Other Business: Mr. Weith gave members a copy of a letter to the City Council regarding Certificates of Occupancy. Mr. Weith advised that during peak traffic periods, Staples Plaza will be barricading the right turn out access because waiting cars block a lane. Members felt this was OK as long as it is only temporary. Mr. Weith noted receipt of a letter from Patrick Sullivan re- garding the pizza restaurant on Williston Road. Mr. Sullivan be- lieves it is a quality restaurant and thus will have only 25 peak hour trip ends. He asked the Commission to reconsider The Commission said they will listen if Mr. Sullivan will come in with data to convince them. Mr. Burgess said he got a message from Herb Durfee of Regional Planning that they will be discussing plans to begin regional planning with the Council on 5 December. 2. Public Hearing: Final Plat application of Eugene LeClair for subdivision of 1.78 acres of land into two lots of 1.02 acres and 0.76 acres, 110 Kirby Road: Mr. LeClair said one lot is already developed and he is not planning to develop the other lot at this time. Mr. Burgess noted that a portion of one lot is located in the CO zone. Members expressed no other concerns. The house goes with the lot with the larger frontage. There are no plans to build yet. Mr. Weith said the final plat should show the boundary of the CO Zone. The larger lot (lot #1) is developed with a single family dwelling. Sketch plan was reviewed on 10/25/94 (minutes not available). This property located at 110 Kirby Road lies within the R4 District. It is bounded on the west and east by a duplex, on the north by land owned by the City and on the south by Kirby Road. Access: The developed lot has a curb cut on Kir oad which is shown on the plat. The proposed curb cut for lc-#�i i also shown on the plat. Lot size/frontage: The minimum lot size of 9,500 square feet (0.22 acres) is being met. The minimum frontage requirement of 80 feet is being met. Setbacks: Setback requirements are being met. C.O. Zone: A small portion of lot #1 is in a C.O. Zone. This area is shown on the plat and will not be impacted by this subdivision. Sewer: The sewer allocation needed for a four (4) bedroom home would be 600 gpd. Continued Site Plan Application of David Simendinger to raze a drive-in bank building and construct a 1750 sq. ft. convenience store with gas sales, deli, ATM machine and a 1920 sq. ft. canopy, 801 Williston Rd: David Sirnendin.gee explained that they would reduce the building size by 20% and the pump aisles by 30%. Mr. Boyle then reviewed the proposed layout. There would be no left turn in from Williston Rd. Dimensions of the parking lot have been corrected and the dumpster would be screened as required. The building has been reduced both in length and depth. Members said they wanted to see a plan with the whole property on one sheet. Mr. Alexander then reviewed traffic. He felt the actual use would be less than ITE estimates. He based this estimation on three factors: other stations, no west -bound cars entering, and fewer pumps. They estimate 80 trip ends. Mr. Burgess asked if the comparables had included a deli or ATM. Mr.. Alexander said they had not. But he felt the 80 trip ends would include the ATM. Mr. Burgess noted the Overlay zone allows 29.7 vehicle trip ends, which would still put the plan well over the allowable. He added that the Commission could approve more trip ends if the applicant could demonstrate a net improvement in traffic near the site. Mr. Alexander felt the number. of 'movements allowed represented an improvement. There is now 2-way access from East Terrace and from Williston Rd. Both would be reduced to one-way access. 16% of accidents are turning and entering related. By precluding left turns in, this would be reduced. Mr. Crow felt this might reduce mid -block accidents, but it could increase accidents at the next intersection with people trying to make turns to get back to the gas station. Mr. Burgess said the problem with Mr. Alexander's concept is that even though the exit to East Terrace is angled, there is nothing to prevent right turns out to get to Spear St. He was also not sure that what is proposed would preclude left turns in from Williston Rd. On the 12th day of September, 1995, the South Burlington Planning Commission approved the request of Thomas Chastenay for final plat approval under Section 202 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of the resubdivision/boundary line adjustment of a subdivision approved on 11/22/77. The purpose of the resubdivision is to subdivide a 0.97 acre lot from a 2.83 acre lot to merge the 0.97 acre lot with an adjoining 0.63 acre parcel located on Airport Parkway. This will result in two (2) reconfigured lots of 1.83 acres (114-116 Kirby Road) and 1.6 acres (615 Airport Parkway). This application is to correct a violation discovered by staff. Access: No additional access proposed since the 1 acre lot will be merged with an existing lot. The remaining lot is developed with a two-family dwelling with a curb cut on Kirby Road. 4. Lot size/frontage: The minimum lot size requirement of 12,000 square feet for a two-family dwelling will be met since the two- family dwelling lot is approximately two (2) acres. The minimum frontage requirement of 85 feet is met. 5. Sewer: No additional allocation needed since no new developable lot will be created. 6. C.O. Zone: There is a watercourse crossing this property with a corresponding C.O. Zone. This stream and C.O. Zone are shown on the final plat. The C.O. Zone in the vicinity of the pond is not accurately depicted. The C.O. Zone is 50 feet from the edge of the wetland associated with the pond. Recreation path: The Recreation Path Committee submitted comments to the Planning Commission dated 9/12/95 and requested a 20 foot easement across the property. The applicant has: 1) reduced the size of the convenience store from 1750 square feet to 1400 square feet, 2) eliminated one (1) gas pump and 3) made modifications to the Williston Road curb cut to further discourage left turn movements by exiting and entering traffic. This project consists of razing a drive-in bank building and constructing a 1400 square foot convenience store with gas sales, deli, ATM machine and a 1920 square foot canopy. The ZBA granted a conditional use permit for this facility on 4/27/95. This property located at 801 Williston Road lies within the C1 District. It is bounded on the west by Spear Street, on the south by a residence and the Burlington Tennis Club, on the east by a service station and Staples Plaza, and on the north by Williston Road. This application is to correct a violation discovered by staff. The 1 acre lot was illegally sold to Richard and Gary Caron on 5/19/87. SOUTH BURLINGTON RECREATION PATH COMMITTEE MINUTES MARCH 6, 1995 The South Burlington Recreation Path Committee held it's monthly meeting on Monday, March 6, 1995 at 7:00pm in the Municipal Office Building. MEMBERS PRESENT: Lenore Budd, Lou Bresee, Maja Smith and Walt Kuentzel ALSO PRESENT: Bruce O'Neill, Recreation Director The minutes of the January 9, 1995 meeting were approved. The committee reviewed the minutes of the Planning Commission 2/21/95 meeting where the separation of 4 lots on Kimball Ave from the "Digital Property" were discussed. The applicant, GBIC, has agreed to construct a recreation path along Kimball Ave. prior to occupancy of the first building. A review was conducted of the proposed subdivision of the Chastenay property on Kirby Drive. This area has a sewer easement across much of it and is a key connection in the proposed path from Jaycee Park to the Lime Kiln Bridge. Lou Bresee will attempt to contact Mr. Chastenay prior to the Planning Commission hearing which is expected March 28,1995 or later. The paving of the section of the path from Farrell Park to Lindenwood Drive was discussed. Doug Weber, design engineer of the path provided much useful information to the committee through Lenore Budd and Bruce O'Neill. The Committee will recommend to the City Council that this section of the Path be paved and that additional paving be provided from Farrell Park to Swift St. This new section will connect with the Phase III Section of the Path and this connection may help to reduce the traffic on Lindenwood Drive. The rational for this recommendation is documented in the attached trade study on the subject. While the subject was discussed extensively, there was little difference of opinion among the committee as to the recommended course of action. Lindenwood Drive is not an ideal situation but none of the alternatives that have been presented are even close to being as good. Bruce O'Neill reported on the options for obtaining funding for the tree planting project that has been discussed. It was decided because of submittal dates and funding available, that we would apply for funding through the AOT Trees Enhancement Grant. He also recommended that we submit the Existing path as our recommendation for the Walk Vermont Project even though it does not meet all of their criteria, particularly it is not a loop. The Committee agree. The Other Paper has solicited articles about the Path and we decided to supply such articles as public awareness of Path activities and progress is appropriate. The first article will probably be a short status report. The Committee is responsible for supplying agenda items to Darla for our next meeting, April 3, 1995 since that will be Bruce's first day back from vacation. The meeting was adjourned at approximately 8:45 pm. On December 8, 1977, Thomas B. Chastenay purchased a 2.7 acre parcel of land from Robert M. and Seraphine H. Cram. This deed is recorded in Vol 139, Pages 202-203 of the South Burlington Land Records. Mr. Chastenay constructed a duplex on this property and the premises are now designated as 114-116 Kirby Road. In 1987, Mr. Chastenay conveyed the northerly portion of this 2.7 acre parcel to Richard L. and Gary P. Caron. This northerly section of Mr. Chastenay's property was adjacent to the Carons' property at 215 Airport Parkway. The dimensions of the portion of the Chastenay parcel conveyed to the Carons is 117.21 feet by 357.74 feet. It is the conveyance of that parcel which is the subject of this Subdivision Application. At the time of the 1987 conveyance, no permits or approvals were obtained from the State of Vermont or from the City of South Burlington. The applicant is now trying to rectify that. So, the purpose of the subdivision was to convey approximately I acre of land from the northerly portion of the Chastenay lot to the Carons. The location of the property is between 114-116 Kirby Road and 615 Airport Parkway. The nature of the subdivision is simply to change the boundary line between the Chastenay lot and the Caron lot. The number of lots created is two ( the lot retained by Chastenay and the lot conveyed to Caron). The lot retained by Chastenay continues to be used for the duplex. It is the Applicant's understanding that the lot conveyed to the Carons is simply being used as a buffer between the Carons' business and adjoining property. Mr. Jacob moved to table this item until April 24, 1979 at 7:30 pm at City Hall. Mr. Mona seconded the motion and it passed unanimously. Continue public hearing on final plat application oL Thomas Chastenay) for a 1 lot subdivision at 114-116 Kirby Road Mr. Page said he had met on the site with a representative of the Soil Conservation Service who told him that erosion control should include the use of a filter fabric as well as hay bales during construction. He also noted that it would be hard to have vegetation take hold on a slope like that. The area proposed for division is about 2 acres in size but the usable area is less than that. Cverhead power lines are proposed. Mr. Mona felt that siting of a residence on the back portion of that lot was poor planning, particularly if the easement were to be the only means of access. Mr. Ewing did not object to the site as long as there was a restriction on the lot to allow for only one duplex. Mr. Jacob asked how deep the sewer line was and was told it was 7' but it would be deeper after more fill was put in. Mr. Page reiterated that underground power lines were standard and overhead lines required a waiver. He also was concerned about erosion control if the water or power lines ever need service and noted that the Commission could not insure that it would be contrQU ed under those circumstances. A 2. PLANNING COMMISSION APRIL 10, 1979 Mr. Levesque arrived at this point. Mir. Poger noted that the building could be built on the front of the lot but it was felt that such a proposal would have to be considered carefully and that it too might be denied as unfeasible. Fears were expressed on the subjects of erosion control, safe access to the building for tenants, and whether this was a reasonable request. It was also noted that any repairs to the sewer or water lines might make access to the building via the driveway impossible for an indefinite time. Mr. Levesque felt a good architect could design a home to fit in with the lot. Mr. Woolery moved to close the public hearing. The motion was seconded by Mr. Levesque and all except Mr. Poger voted yes. Mr. Draper then moved that the final plat application of Thomas Chastenay be denied. Mr. Levesque seconded the motion. Mr. Page said the Commission had not closed the door to any siting of a residence on the land, and said he would write up some findings of fact. The motion passed with Mr. Ewing voting no. Continue public hearing on final plat application of San Remo Realty for a 1 lot subdivision at 140 Kennedy Drive Mr. Fred Johnston said they would use an erosion dike and'some new filter fabric. They can go to a 4:1 slope instead of 3:1 if the city wishes and he said they would agree not to build over the pipes. Mr. Ewing asked who would be responsible for the culvert if there were damage to it after the building had been constructed but Mr. Page did not know. Mr. Johnston said he had talked to Rev. Stoddard from the Church of God and that he was satisfied with the plans. Mr. Page said that if the pipes were put in with an elbow, that would leave more room on the site for a building but Mr. Johnston said they would like to go with this plan and reapply if they felt an elbow would be better. There will be a 36" pipe put in under the church driveway. Mr. Poger felt the Comprehensive Plan called for protection of drainageways and that this would be a mistake and would go against the Plan. Mr. Ewing noted that the Zoning Ordinance prohibited building within 50' of the centerline of a minor stream. Mr. Page felt there were contradictory provisions in the ordinances and said the review the Commission was going through was the same kind the Zoning Board would go through in dealing with a conditional use variance request for filling. Mr. Johnston pointed out that there were two drainageways through the lot and that the one proposed for filling was not considered to be the major one. Mr. :Iona felt the real issue was the effect of the fill on the drainage that comes off this property. Mr. Page read the City Engineer's memo on this application and Mr. Johnston said they had no objections to it. Mr. Lowell Krassner felt the Commission had no grounds for allowing fill such as this in an area which was a wetland and contained a drainageway. He also remarked that he did not think it could be denied that if the area were filled and a building and parking lot were constructed, that would increase the amount of runoff in the area. He also said that to allow filling because that is all that is requested, without looking at what will happen after the fill is in, is blindfolding the city. He felt that traffic and drainage impacts on the area after a building is up on the lot should be considered by the Commission now. Mr. Page said the area was zoned R7 and had a CO district in it. Mr. Page said that the City Attorney had said that if there was a quorum present to open a meeting and one member subsequently abstained, a vote could still be made. Mr. Palmer said that the line between the Industrial zone and the Airport Industrial zone ran through this piece of land. He has one tenant in mind and he would not be allowed to go on the lot he wants. Xr. Page said that the line is very hard to determine from the available maps and that he and Mr. Ward recommended that the Commission establish it where it is shown on the plat except that it should end in the center of the brook. Most of the land is very steep, due to a stream flowing in a deep ravine, east to west. The ravine is bridged by a sewer easement which leads to a level, buildable area at the extreme northeast corner of the property. Access to the proposed lot is via this easement. Substantial filling will be required over the easement to bring the driveway up to an acceptable grade; also, the access way drops off very steeply on both sides and posts or guard rails may be warranted. Submitted plans show profile of proposed drive.However, we must have a typical section of what is to be constructed also proposed contours on how the side slopes are to be constructed. The fill was constructed to accommodate the sewer main that crosses the ravine. This was done about 12 years ago. Initially there was some difficulty maintaining the side slopes. Now there is a good growth along these slopes and they are stable. By adding fill to accomodate a drive, the filling must extend onto these Videslopes. This together with excavation for a water line and power line will most probably disturb these slopes and make them unstable. If a driveway is permitted,a method of intercepting the storm water and piping it to the drainageway must be included, also the responsibility for maintenance of this fill should be the responsibility of the owner. #3 San Remo Realty Subdivision 1. No structure will be built on top of the storm drainpipe. 2. The entire drainage system shall be built and a minimum of two feet of cover placed over pipe prior to construction of the fill. 3. A headwall or manufactured spillway shall be placed over end of pipe. 4. Pipe gauge shall be specified. 5. Only clean fill shall be used to construct the embankment. No trees, wood, or demolition waste shall be used as fill. 6. If filling is to be done on an as available basis, a gate or other method of access control shall be installed to discourage illegal dumping_ 7. I would recommend that access to the site be via the existing curb opening to the existing office building. 8. I question the adqquacy of the 24' x 36" culvert at the church entrance road. 9. Monday. #4 Treetops, Phase II The on -site inspection is set for 5:30 P.M., The additional parking that was requested is being added. Due to their coarse texture, they tend to be drouthy, making the establishment of vegeta- tion difficult. There would not be any significant erosion problems on the flat slope of the Adams & Windsor soils. There could be some serious problems if the steep Hartland soils are disturbed. The steep sideslopes for the existing sewer easement were only stabilized with great difficulty after initial construction; the addition of substantial amounts of fill to improve the driveway grade, plus the excavation for underground utilities (power and water) will create an in- ordinate potential for erosion; further there is no assurance of erosion control when and if routine maintainence on the power or water line is necessary (after initial installation). 4. The applicant appears to be unaware of the volume of fill required as well as the cost of the erosion control measures shown on the plans sub- mitted. 5. The proposed plan conflicts with sections 412, 413, and 504 of the Subdivision Regulations, which pertain to site preservation, excavation and grading, and suitability of land, respectively. The filling proposed conflicts with the letter and intent of the C-0 district (which is a 100 strip centered over the drainageway). 6. Applicant already enjoys a reasonable economic use of his property and has indicated a further return is possible, by selling to an abutting landowner, whereby the proposed filling and access drive would not be necessary. PLANNING COMMISSION NOVEIOER 14, 1978 Item #3 was postponed because a.member had a conflict of interest and if he stepped down there would be no quorum. The Commission wanted to wait until another -member came. Sketch plan review, 1 lot subdivision of Chastenay property, east bf Kirby Road -- Mr. Thomas Chastenay said that his parcel of land was about 3 acres in size and that he wanted to cut it into two pieces - 1 1 acre parcel and 1 2 acre piece. The dividing line would be just to the west of the existing sewer easement.. Nlr. Chastenay said that he had a duplex on the southwest corner of the lot and wanted to put a dwelling in the northeast corner also. Access to this new dwelling would be over the sewer easement, which would need some additional fill in order to do this. The land is zoned R4. Mr. Chastenay felt there was more than adequate buildable area in the back. S. Foger brought up the question of the pedestrian easement over the sewer easement and was told that Mr. Chastenay did not mind if people walked on the driveway, as they do now. Mr. Chastenay noted that the only things at the end of the easement were the dump and the sewage treatment plant, neither of which were the most popular places in town. Mr. Chastenay felt he had 8 or 9,000 square feet of level land on which to build the dwelling in the back and S. Page added that completion of a contour map would tell them more about that. He also noted that this parcel came very close to a parking lot for a business on Airport Parkway and that any emergency vehicles needing to get close to the dwelling could do it from there rather than coming down the new long narrow drive. Asked about utilities, Mr. Chastenay said they would come from Kirby Road, since he had tried but was unable to get an easement across anyone else's property so they could come from Airport Parkway. The Commission was not sure it would be a good idea to have several utilities one over the other underground. If any problem developed with one of them, the others might be disturbed while people were trying to fix the one with the problem. It was also noted that if any utilities had to be dug up, the driveway would not be passable. I,Ir. Chastenay said the people living in the dwelling could walk in if they had to. The drive would be 20' wide, he said. Mr. Chastenay said that the sewer was quite deep, perhaps 20-25' below the street level and he felt that other utilities could be moved 12-15' to one side of the sewer line and run alongside it instead of over it. G. Mona wanted to know more about where and how much fill there would be at the next meeting. Site plan review, proposed office building north of Nordic Ford S. Page said this lot was part of the old National Life Subdivision and was almost 5 acres large. Mr. Richard Tarrant, president of Burlington Data Processing, said that company wanted to build a new building on this site. He said that they would change the angle of the gooseneck which is there to serve two lots beyond this one so that it meets the road differently. This will make turns onto it easier. He said that they were planning to build a 14,000 square foot building on the lot and use 7,000 square feet themselves, renting the rest for now and hoping to expand into that space later. PLANNING COINIMISSION SEPTEMBER 26, 1978 Sketch Plan Review, 1 lot subdivision, Kirby Road, Mr. John Trono Mr. Trono said the lot had 100' of frontage and that either a single family home or a duplex would be built on the lot. Mr. Page said it was an excellent building spot and that they had a little over 112 an acre. The Commission saw no problems with it. Sketch Plan Review, 1 lot subdivision, Spear St. y, Mr. Nile Duppstadt said that there would be two lots with 1/2 acre each, opposite the East Terrace cul-de-sac. Access to the lots will be off Quarry Hill Road and there will be one driveway for each of the lots. The question of a shared drive came up but Mr. Duppstadt and several Commissioners felt that would create problems for the owners of the two lots. In lieu of a shared drive, the Commission suggested that the drive for lot "l be as far from Spear Street as possible. Site Plan Review, addition to 7-Up warehouse,. Berard Drive Mr. Randy Berard said that there was an existing 70' x 100' building on the lot and that they wanted to add an addition also 70' x 100' and combine two lots into one. Ix. Berard said this would not increase the traffic in the area. A survey of the property will be required. What is most important is that the size of the buildable area along Kirby Road and the break in grade be accurately determined. City water and sewer are available at the site. Soils are sandy, and susceptible to erosion on steep banks.
