Re: Findings of Fact, application of Eugene LeClair for
subdivision of 1.78 acres of land into two (2) lots of 1.02 acres
and 0.76 acres, 110 Kirby Road.
On the 29th of November, 1994, the South Burlington Planning
Commission approved the request of Eugene LeClair for final plat
approval under Section 202 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of the subdivision of a 1.78 acre parcel
into two (2) parcels of 0.76 acres and 1.02 acres. The larger lot
(lot #1) is developed with a single family dwelling. Sketch plan
was reviewed on 10/25/94.
2. This property located at 110 Kirby Road lies within the R4
District. It is bounded on the west and east by a duplex, on the
north by land owned by the City and on the south by Kirby Road.
3. Access: The developed lot has a curb cut on Kirby Road which
is shown on the plat. The proposed curb cut for lot #2 is also
shown on the plat.
4. Lot size/frontage: The minimum lot size of 9,500 square feet
(0.22 acres) is being met.
The minimum frontage requirement of 80 feet is being met.
5. Setbacks: Setback requirements are being met.
6. C.O. Zone: A small portion of lot #1 is in a C.O. Zone. This
area is shown on the plat and will not be impacted by this
subdivision.
7. Sewer: The sewer allocation needed for a four (4) bedroom home
would be 600 gpd. The applicant will be required to pay the per
gallon fee prior to issuance of a zoning building permit.
8. Recreation Fee: The applicant will be required to pay the
recreation fee in effect at the time of issuance of the
zoning/building permit.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the final plat application of Eugene LeClair

for subdivision of 1.78 acres of land into two (2) lots of 1.02
acres and 0.76 acres, 110 Kirby Road, as depicted on a plan
entitled "Plat of Survey Showing Lands of Eugene A. LeClair, 110
Kirby Road, South Burlington, Vermont", prepared by Harold N. Marsh
and dated October, 1994 subject to the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. A sewer allocation of 600 gpd is approved for lot #2. The
applicant shall pay the per gallon fee prior to the issuance of a
zoning permit for any land development on lot #2.
3. The applicant shall pay the recreation fee in effect at the
time of issuance of the zoning permit for lot #2.
4. The final plat plan shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chair or Clerk prior to
recording.
