FINDINGS OF FACT AND DECISION
Site plan application #SP‐19‐11 of Edward G. Hoehn III to renew a condition of a previous subdivision
approval which required a zoning permit to be obtained within six (6) months, 1700 Dorset Street.
The Development Review Board held a public hearing on June 4, 2019. Dan O’Rourke represented the
applicant.
Based on the plans and materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, Edward G. Hoehn, seeks to renew a condition of a previous subdivision
approval which required a zoning permit to be obtained within six (6) months, 1700 Dorset
Street.
2. The owner of record of the subject property is Edward G. Hoehn III.
3. The application was received on April 26, 2019.
4. The subject property is located in the Southeast Quadrant Village Residential Zoning District.
5. The plan submitted consists of three (3) pages, with page 1 entitled, “Site Plan Hoehn Subdivision,”
prepared by Grover Engineering PC, dated April 14, 2017, and last revised on October 19, 2017.
6. The Board signed the decision on final plat application #SD‐17‐11 more than six (6) months ago
(June 21, 2017). The applicant is asking the Board to renew the contents of condition #10 of
#SD‐17‐11, which will reset the timeline for acquiring a zoning permit.
DECISION
Motion by __, seconded by __, to approve site plan application #SP‐19‐11 of Edward G. Hoehn subject
to the following stipulations:
1. All previous approvals and stipulations will remain in full effect except as amended herein.
2. This project must be completed as shown on the plans submitted by the applicant and on file in the
South Burlington Department of Planning and Zoning.
3. All new buildings are subject to the Stretch Energy Code pursuant to Section 3.15: Residential and
Commercial Building Energy Standards of the Land Development Regulations.

4. The applicant must obtain a zoning permit for the first home within six (6) months of this approval.
The Development Review Board grants a period of five (5) years for approval of the second home. At
such time as the five years is reached and the applicant has not sought a zoning permit for the
second home, they will be eligible, per Section 17.04 of the South Burlington Land Development
Regulations, for one (1) extension to an approval if the application takes place before the approval
has expired and if the Development Review Board determines that conditions are essentially
unchanged from the time of the original approval. In granting such an extension, the Development
Review Board may specify a period of time up to one (1) year for the extension.
5. All changes to the plan will require approval of the South Burlington Development Review Board or
Administrative Officer.
