The amendment consists of site amendments, 120 Kimball Avenue. The site plan for this property was last approved by the Planning Commission on October 13, 1995 (minutes enclosed). DEVELOPMENT REVIEW BOARD MEMO JUKE 5, 200I MEETING This property is located within the IC District. It is bounded on the north by a single-family residence, on the east by Shunpike Road, on the south by Kimball Avenue, and on the west by an undeveloped lot. Access/circulation: Access is currently provided via a 24-foot curb cut on Shunpike Road and a 24-foot curb cut on Kimball Avenue. The applicant has proposed two additional curb cuts on the northern portion of the property which will allow access to the adjoining property to the north and Adelphia Drive. The western most curb cut will be 20 feet and the eastern most will be 24 feet in width. The Board, in their approval of 110 Kimball Avenue, recommended that this access be provided in an effort to consolidate traffic onto Adelphia Drive at their October 17, 2000 meeting (minutes enclosed). Coverage/Setbacks: Overall coverage will increase slightly from 64.9% to 65.3% (70% max). All setback requirements are being met. Parma The proposed circulation changes will result in the loss of 11 parking spaces for a total of 99 parking spaces. A total of 111 parking spaces are required for a 12 space or 11 % shortfall. Staff does not see a problem granting a 12 space parking waiver. Recommended Conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Pursuant to Section 25.256(b) of the zoning regulations, the Development Review Board approves a 12 space or 11% waiver for a total of 99 spaces approved. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The amendment consists of 1) converting 6,000 square feet of general office use to medical office, and 2) minor parking changes, 110 Kimball Avenue. This site plan for this property was last approved. by the Board on October 17, 2000 (minutes enclosed). DEVELOPMENT REVIEW BOAR MEMO .TUNE 5, 2001 MEETING This property is located within the Mixed Commercial and Industrial District. It is bounded on the south by Kimball Avenue, on the west by a commercial building, on the north by an undeveloped lot, and on the east by two residences and a commercial building. Access/Circulation: Access is provided via a 22-foot wide access drive off Adelphia Drive. The applicant has proposed sharing an existing point of access with 120 Kimball Avenue including two (2) access drives to their parking lot (see discussion for 120 Kimball Avenue). The Board, at their October 17, 2000 meeting (minutes enclosed) required the applicant to obtain approval to amend the site plan for 120 Kimball Avenue to include a shared curb cut and change in parking layout prior to issuance of a Certificate of Occupancy. Circulation on the site is adequate. Coverage/Setbacks: The building coverage will remain 7.3% (30% max). The total coverage will increase slightly from 33% to 35% (70% max). The front yard coverage is 23% (30% max). The applicant should revise the plans to include front yard coverage along Adelphia Drive. All setbacks are met. Parking: The proposed uses require 116 parking spaces including five handicapped spaces and 127 are proposed including six handicapped spaces. A bike rack is also provided. Traffic: ITE estimates that approved general office use generates 41.15 P.M. peak vehicle trip ends (vte's). ITE estimates that the proposed medical office use will generate an additional 13.02 P.M. peak vte's for a total of 54.17 P.M. peak vte's. The applicant should expect to pay the applicable impact fee for the additional vte's. Sewer: The applicant has not requested an additional sewer allocation. Dumpster: A screened dumpster is proposed. The trash should not be picked - up between the hours of 7:00 P.M. and 7:00 A.M. Recommended Conditions: 1. AIVIAND - APPEAL, OF ADMINISTRATIVE OFFICER'S DECISION This hearing was continued from the March 20, 2001 , meeting to provide the appellant time to remove the trailer after the snow melt. This hearing was previously continued from the February 6, 2001 meeting at the request of the applicant. This appeal is from a decision made by the Administrative Officer that the property at 46 Swift Street is in violation of the zoning regulations (see enclosed Notices of Violation). Enclosed is staffs 2/6/01 memo regarding this appeal. As of May 31, 2001 the trailer was still present on the property. SUBDIVISION, 304 LIME KILN ROAD This project consists of amending a planned unit development consisting of 85 residential units in four (4) buildings and a 42 unit congregate housing facility on two (2) lots. The amendment consists of subdividing lot #2 into two (2) lots, 304 Lime Kiln Road. This property lies within the Residential Four District. It is bounded on the north and west by the Winooski River and on the east by the farmlands of John Better. On the south, a residence and a commercial structure bound the property. Lime Kiln Road runs through the middle of the property dividing Lot #1 from Lot #2. Lots: The applicant has proposed subdividing lot #2 into two (2) lots in order to deed the a portion of the lot to the Winooski Valley Park District. Staff does not have a problem with this proposal. Staff recommends that a "Notice of Condition" be recorded which has been approved by the City Attorney which states that for zoning and subdivision purposes the two (2) lots will be treated as a one (1) lot. PLANNING COMMISSION 13 OCTOBER 1998 5. Site plan application of Jim Foster to construct a 27,616 sq. ft. 2 story general office building on a 1.96 acre parcel, 120 Kimball Avenue: Mr. Hart said the site was previously approved for an All American Fitness Center. They will tap into municipal water and sewer. Landscaping will be similar to what was approved. It was noted that Mr. Willis, the adjacent property owner, is concerned with drainage onto his property. He suggested a 12" culvert be added to redirect water away from his property. The applicant is willing to do that. Mr. Dinklage asked if the applicant can get by without the 2 parking spaces staff has asked to be removed. Mr. Hart said they would rather not. Mr. Dinklage suggested these not be paved right away. Then if they are not needed, it will be OK, and if they are, the applicant can discuss it with the Director of Planning & Zoning. The applicant agreed to this. Building envelopes: The plans should be revised to show building envelopes on all four (4) lots. The building envelopes should be located entirely outside of the 100 year floodplain and the 50 foot C.O. District/wetland buffer. 5 ) JIM FOSTER - OFFICE BUILDING - SITE PLAN This project consists of constructing a 27,616 square foot 2-story general office building on a 1.96 acre parcel. A mixed use building was approved on this lot on 1/28/97 but never constructed (minutes enclosed). This property located at 120 Kimball Avenue lies within the IC District. It is bounded on the north by a single family residence, on the east by Shunpike Road, on the south by Kimball Avenue, and on the west by an undeveloped lot. Access/circulation: Access is proposed to be provided by a 24 foot curb cut on Shunpike Road and a 24 foot curb cut on Kimball Avenue. Section 26.103 (a) of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be a maximum of one driveway per lot accessing a public street." Staff does not see a problem with two (2) curb cuts since this is a corner lot. Circulation on the site is adequate. 3 Memorandum - Planning October 13, 1998 agenda items October 9, 1998 Page 4 Coverage/setbacks: Building coverage is 16.3% (maximum allowed is 30%). Overall coverage is 64.9% (maximum allowed is 70%). Front yard coverage along Shunpike Road is 15.5% and along Kimball Avenue is 29.9% (maximum allowed is 30%). Setback requirements are met. Parking: A total of 111 spaces are required and 110 spaces are being provided including five (5) handicapped spaces and a bike rack. This is a one (1) space or 0.9% shortfall. Staff does not see a problem with granting a one space waiver. In fact, staff suggests that the two (2) spaces in front of the building along Shunpike Road also be eliminated. Landscaping_ The minimum landscaping requirement, based on building costs, is $15,500 which is being met. Plantings include: Burning Bush, Forsythia, Honeylocust, Juniper, Crabapple, Austrian Pine and Red Oak. Traffic: ITE estimates the proposed use to generate 72 vehicle trip ends (vte's) during the P.M. peak hour. The applicant should be aware that the road impact fee is approximately $15,000. Sewer: This project requires a total sewer allocation of 1080 gpd. The current approved allocation is 405 gpd. The applicant is requesting 675 gpd of additional allocation. The applicant will be required to pay the per gallon fee for the entire 1080 gpd prior to permit issuance. Sidewalks: The applicant is proposing sidewalks along the property's frontage with Kimball Avenue and Shunpike Road. Lighting Exterior lighting will consist of the following: two (2) 250 watt metal halide lamps with downcasting shielded fixtures mounted on 15 foot poles. one (1) 100 watt metal halide lamp mounted on the building with a downcasting shielded fixture. Mr. Hart showed the location of lighting on four islands. Mr. Burgess said the maximum height of lights is 20 ft. and the Commission will require a design that does not allow light off the property. Ms. Griffiths asked if trash will be picked up at very early hours as the bedrooms of her home are on that side of the house. South Burlington, VT," prepared by Trudell Consulting Engineers, Inc. dated 11/25/96, last revised 1/9/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed uses will generate 84.9 vehicle trip ends during the P.M. peak hour. 3. The Planning Commission approves a sewer allocation of 2180 gpd. The applicant shall pay the per gallon fee prior to permit issuance. 4. The applicant shall post a $13,500 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. The plan shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plans shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to relocate the parking space closest to Shunpike Road at the northeast corner of the building to provide a continuous green strip 15 feet in width, traversed only by the driveway, between the street r.o.w. line and the balance of the lot. b) The site plan shall be revised to show the two (2) proposed sidewalks connected at the intersection. A bike rack should also be provided as required under Section 26.253(b) of the zoning regulations. Sewer: The sewer allocation request should be submitted with the preliminary plat application. Multi -Family Dwelling: The two (2) multi -family buildings on lot #2 must be connected to form one (1) building. The two (2) building configuration can only be approved as a PRD but this provision can not be used because the 50 foot PUD/PRD perimeter setback requirement can not be met. Preliminary plat: The preliminary plat plans should include all information required under Section 203.1 of the subdivision regulations. IE RICK POSTON - INDOOR RECREATION & OFFICE BUILDING - SITE PLAN This project consists of constructing a 2-story 20,000 square foot building consisting of 15,000 square feet of indoor recreation use and 5,000 square feet of office use. the ZBA on 1/13/97 granted the applicant a conditional use permit for the multiple use. This property located at 120 Kimball Avenue lies within the IC District. It is bounded on the north by a single family residence, on the east by Shunpike Road, on the south by Kimball Avenue, and on the west by an undeveloped lot. Access/circulation: Access is proposed to be provided by a 24 foot curb cut on Shunpike Road and a 24 foot curb cut on Kimball Avenue. Staff recommends that the Kimball Avenue access be moved further to the west away from the intersection. Section 26.103(a) of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be a maximum of one driveway per lot accessing a public street." Staff does not see a problem with two (2) curb cuts since this is a corner lot. Circulation on the site is adequate. 10 Memorandum January 28, January 24, Page 11 - Planning 1997 agenda items 1997 Coverage/setbacks: Building coverage is 12% (maximum allowed is 30%). Overall coverage is 69% (maximum allowed is 70%). Front yard coverage along Shunpike Road is 16.9% and along Kimball Avenue is 27.6% (maximum allowed is 30%). Setback requirements are met. Parking: A total of 140 spaces are required and 140 spaces are C being provided including five ( 5 ) handicapped spaces and a bike J_p�A"`` rack. The space closest to Shunpike Road at the northeast corner of the building should be relocated to provide a 15 foot green strip interrupted only by the driveway (Section 25.107 of the zoning regulations). Landscaping: The minimum landscaping requirement, based on building costs, is $13,500 which is being met. Plantings include: Burning Bush, Forsythia, Honey Locust, Juniper, Crabapple, Austrian Pine and Red Oak. Traffic: ITE estimates the proposed uses to generate 84.9 vehicle trip ends (vte's) during the P.M. peak hour. The applicant should be aware that the road impact fee is approximately $18,000.
