FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-01-84 of Edlund Company, Inc. to amend
a previously approved site plan for a 27,616 square foot general office building. The
application consists of a minor site plan amendment to enlarge the area of a dumpster
enclosure,120 Kimball Avenue.
On the 5' day of November, the Director of Planning & Zoning approved the site plan
application of Edlund Company, Inc. under Section 26.10(b) of the South Burlington
Zoning Regulations, based on the following findings:
1. This project consists of a site plan application to amend a previously approved site
plan for a 27,616 square foot general office building. The amendment consists of
enlarging the fenced dumpster enclosure area and concrete pad in order to serve
the properties at 110 and 120 Kimball Avenue.
2. The owner of record is Edlund Company, Inc.
3. This property is located within the IC -Mixed Industrial Commercial District. It is
bounded on the north by a single-family residence, on the east by Shunpike Road,
on the south by Kimball Avenue, and on the west by a lot in the IC zone.
4. Access/circulation: No changes to access and circulation will result.
5. Coverage/setbacks: The proposed enlargement of the fenced dumpster enclosure
area and concrete pad by 80 square feet will increase overall lot coverage from
65.3% to 65.4%. The maximum for the IC district is 70.0%. Coverage requirements
are therefore met. All setback requirements are met.
6. Parking. No changes to parking will result.
DECISION AND CONDITIONS
Based on the above Findings of Face, the South Burlington Director of Planning and
Zoning approves site plan application #SP-01-84 of the Edlund Company, Inc. to amend
a previously approved site plan for a 27,616 square foot general office building. The
amendment consists of expanding the area of a fenced dumpster enclosure and concrete
pad by 80 square feet,120 Kimball Avenue, as depicted on a set of plans entitled "Jim
Foster 120 Kimball LLC, Kimball Avenue & Shunpike Road, South Burlington, Vt., Site
Plan," prepared by Trudell Consulting Engineers, dated 8/7/98 and with a date received
stamp of September 21, 2001, with the following stipulations:
All previous approvals and stipulations that are not superseded by this approval
shall remain in effect.
2. The dumpster area shall be fenced to fully screen dumpsters from view.
3. The applicant shall obtain a zoning permit within six (6) months of the date of this
decision, pursuant to Section 27.302 of the Zoning Regulations, or this approval is
null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer.
5. Any change to the approved site plan shall require approval of the South
Burlington Development Review Board.
