HomeMy WebLinkAboutSP-17-54 - Decision - 0120 Kimball Avenue#SP-17-54 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JIM FOSTER - 120 KIMBALL AVENUE SITE PLAN APPLICATION #SP-17-54 FINDINGS OF FACT AND DECISION Jim Foster, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 27,906 sq. ft. general office building. The amendment consists of: 1) installing landscaping to bring planting value up to previously approved levels, 2) documenting current site conditions, and 3) minor drainage modifications, 120 Kimball Avenue. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a 27,906 sq. ft. general office building. The amendment consists of: 1) installing landscaping to bring planting value up to previously approved levels, 2) documenting current site conditions, and 3) minor drainage modifications, 120 Kimball Avenue. 2. The owner of record of the subject property is 120 Kimball Corporation. 3. The subject property is located in the I-C Zoning District. 4. The application was received on July 18, 2017. 5. The plan set consists of a two (2) page set of plans, page one (1) is titled, "110 & 120 Kimball 110 & 120 Kimball Avenue South Burlington, Vermont", prepared by Trudell Consulting Engineers, dated June 30, 2017, and last revised on 7/17/17. DIMENSIONAL REQUIREMENTS 6. Building coverage is 16.3% (maximum allowed is 40%), overall coverage is 65.1% (maximum allowed is 70%), and front yard coverage is 13.1% along Shunpike Road and 25.6% along Kimball Avenue (maximum allowed is 30%). 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Vehicle and Bicycle Parking - 1 - #SP-17-54 8. The existing uses require 98 parking spaces and there are 100 spaces available, including three (3) handicapped spaces. The plan should be revised to include one (1) additional handicapped space to meet them minimum requirement for the number of handicapped spaces. 9. The plan complies with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate the minimum requirement of four (4) short-term bicycle parking spaces. Landscaping 10. The applicant is proposing to add trees and shrubs with a value of $3,057 to bring the planting value up to previously approved levels. The City Arborist on 7/26/17 indicated in an email that he has no issues with the new plantings. Stormwater 11. Minor drainage modifications are being proposed. The Assistant Stormwater Superintendent in an email to staff on 7/20/17 indicated that the decision should include a condition that the applicant regularly maintain all stormwater treatment and conveyance infrastructure. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-54 of 120 Kimball Corporation, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to add one (1) additional handicapped space. 4. The applicant must regularly maintain all stormwater treatment and conveyance infrastructure. 5. Prior to permit issuance, the applicant must post a $3,057 landscaping bond. This bond must remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival 6. Prior to issuance of a zoning permit for the project, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. -2- #SP-17-54 7. The applicant must obtain a zoning permit from within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 8. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 9. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the site modifications. 10. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. 17rSigned on this day of , 2017 by aymond J.
