SITE PLAN APPLICATION #SP-09-43
FINDINGS OF FACT AND DECISION
Heritage Flight, hereafter referred to as the applicant, requests site plan approval to
amend a previously approved plan consisting of: 1) constructing a 9,450 sq. ft. Customs
& Border Patrol Protection facility, 2) reconstruction/renovating an existing 65, 150 sq. ft.
maintenance hangar, 3) constructing a 40,850 sq. ft. hangar all connected to the existing
Pratt & Whitney hangar, and 4) installation of two (2) 25,000 gallon and one (1) 12,000
gallon above ground fuel tanks. The amendment consists of dividing the project into two
(2) phases to include site modifications. Phase I to consist of: 1) constructing a 9,450 sq.
ft. Customs & Border Patrol Protection facility, 2) reconstruction/renovating an existing
65, 150 sq. ft. maintenance hangar, and 3) installation of two (2) 25,000 gallon and one
(1) 12,000 gallon above ground fuel tanks. Phase II to consist of constructing a 40,850
sq. ft. hangar all connected to the existing Pratt & Whitney hangar, Aviation Avenue.
The Development Review Board held a public hearing on June 2, 2009. Greg Goyette
represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, requests site plan approval to amend a previously approved plan

2. The application was received on May 14, 2009.
3. The owner of record of the subject property is the City of Burlington, Burlington
International Airport
4. The subject property is located in the Airport Industrial Zoning District.

5. The plans submitted consist of a seven (7) page set of plans, page one (1) entitled,
"Heritage Flight Aviation Campus Expansion," prepared by Stantec, et al, dated 9/1/08
The application received approval on June 3, 2008 (Site Plan #SP-08-39) as well as a
six month extension of the approval to an expiration of June 17, 2009.
The Board has no concerns with the request for phasing and requires a five (5) year
deadline for the applicant to obtain a permit for Phase II.
DECISION [
Motion by G A A, 04 #, seconded by 106M J 4AC to
approve Site Plan Application # P-09-43 of Heritage Flight subject to the following
conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit for the site modification in Phase I within
six (6) months of this approval. The Development Review Board grants a period of
five (5) years for approval of Phase II of the proposed development from the original
approval date of 6/17/08. At such time as the five years is reached and the applicant
has not sought a zoning permit for Phase II, they shall be eligible, per Section 17.04
of the South Burlington Land Development Regulations, for one (1) extension to an
approval if the application takes place before the approval has expired and if the
Development Review Board determines that conditions are essentially unchanged
from the time of the original approval. In granting such an extension, the
Development Review Board may specify a period of time up to one (1) year for the
extension.
4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to occupancy of each phase.
5. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.
