HomeMy WebLinkAboutSP-92-0000 - Decision - 0060 Kimball AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT 5p- �'j 2- COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Patrick O'Brien for a contractor's yard/outside storage use, 60 Kimball Avenue. On the 26th of May, 1992 the South Burlington Planning Commission approved the request of Patrick O'Brien for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the use of an undeveloped lot for outside storage and contractor's yard on a temporary basis. The Zoning Board of Adjustment granted a conditional use permit for this use on April 27, 1992. 2. This property located at 60 Kimball Avenue (lot #3) and is within the Mixed Industrial and Commercial District. It is bounded on the west by a vacant lot, on the north by the rear portion of the former Mayo's Subaru property (now vacant), on the east by the INS building, and on the south by Kimball Avenue. 3. Access/circulation: Applicant is proposing to use two (2) existing curb cuts on Kimball Avenue. Section 19.103(a) of the zoning regulations states that there shall be only one (1) driveway per lot unless specifically approved by the Planning Commission. The westerly curb cut is proposed for ingress only and the easterly curb cut is proposed for both ingress and egress. 4. Coverage/setbacks: Building coverage does not apply since there are no buildings. Overall coverage is 23% (maximum allowed is 70%). Setback requirements do not apply since there are no buildings. 5. Parking: This project requires a total of two (2) parking spaces and the plan shows five (5) spaces. 6. Landscaping: There is no minimum landscaping requirement for this project. 7. Sidewalk: The current owner's of this property, Dan and Leo O'Brien, entered into an agreement on 6/25/90 which required that the developers of this lot pay into the City's sidewalk fund at the rate of $15 per foot for the length of the lot's frontage on Kimball Avenue. 8. Other: --- no exterior lighting proposed. --- the applicant is proposing a row of boulders along the front of the property within the City r.o.w. Staff will contact DECISION & CONDITIONS Based on the above Findings of Fact, the Planning Commission approves the site plan application of Patrick O'Brien for a contractor's yard/outside storage use at 60 Kimball Avenue, as depicted on a plan entitled "Business Park North, Daniel J. O'Brien - Lot 3" prepared by Civil Engineering Associates, Inc. and stamped received on April 28, 1992, with the following stipulations: 1. Prior to use of property, the plan shall be revised to show boulders along frontage moved back to at least 10 feet from the existing sidewalk. 2. In the event the sidewalk is cracked or otherwise damaged due to vehicles accessing the site, the applicant shall replace the damaged sidewalk with a new sidewalk of at least 8 inches thick. 3. Within three (3) years, the applicant shall submit a landscaping plan which provides for adequate screening of the storage yard from public view. The plan shall be submitted to the City Planner for approval. 4. Within three (3) years, the applicant shall contribute $5,280 to the City's sidewalk fund as agreed to in the letter addressed to William Burgess, dated June 25, 1990, and signed by the owners of the property, Daniel and Leo O'Brien, and Osgood - Hart properties. The amount of contribution is based on a frontage of 351 feet at $15 per foot of frontage. ChairmAn or Cler V2SI2--- Date
