HomeMy WebLinkAboutSP-05-25 - Decision - 0030 Kimball AvenueCITY of SOUTH BURLINGTON DEPARTMENT of PLANNING AND ZONING OSGOOD-HART PROPERTIES, LLC. - 30 KIMBALL AVENUE SITE PLAN #SP-05-25 FINDINGS of FACT AND DECISION Winston (Chip) Hart, hereinafter referred to as the "Applicant", is requesting to amend a previously approved plan for a 32,000 sq. ft. general office building. The amendment consists of revising the landscaping plan, 30 Kimball Avenue. Based on the plan and supporting materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following. FINDINGS of FACT 1. The project consists of amending a previously approved plan for a 32,000 sq. ft. general office building. The amendment consists of revising the landscaping plan. 2. The owner of record of this property is Osgood -Hart Properties, LLC. 3. The site plan application was submitted on 5/25/05. 4. 'This property located at 30 Kimball Avenue lies within the Cl-LR District. 5. The original site plan for this property was approved by the Planning Commission on 3/23/85. DIMENSIONAL REQUIREMENTS 6. No changes proposed. Building coverage is 15.8% Overall coverage is 64% (maximum allowed is 70%) 29% (maximum allowed is 30%). SITE PLAN REVIEW STANDARDS Vehicular access 7. No changes from the previously approved plan. Circulation 8. No changes from the previously approved plan. (maximum allowed is 40%). . Front yard coverage is - 1 - Parking 9. No changes from the previously approved plan. Landscaping 10. The applicant is proposing to remove eight (8) Lindens from the front entry area and 3 to 4 Lindens from the rear entry area. These large overgrown trees are being removed for the following reasons: a. the detritus from the aphids in the trees has blackened the sidewalks, making them slippery when wet; b. there is evidence of borer damage; c. the trees are so large as to entirely block the view of the main entry. The applicant is proposing to make up for the loss of the Lindens by planting approximately $6900 worth of new plant material along the front of the building, at the rear entry area, and along the westerly and northerly boundaries. Outdoor Lighting 11. No changes from the previously approved plan. Traffic 12. No changes from the previously approved plan. GENERAL REVIEW STANDARDS (a) The relationship of the proposed development to goals and objectives set forth in the City of South Burlington Comprehensive Plan. 13. This standard is still being met- (b) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. 14. This standard is still being met. (c)Parking shall be located to the rear or sides of buildings to the greatest extent practicable. 15. This standard is still being met. -2- (d) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. 16. This standard is still being met. (e)Newly installed utility service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 17. This standard is still being met. (0 The combination of common materials and architectural characteristics, landscaping, buffers, screens, and visual interruptions to create attractive transitions between buildings or different architectural styles shall be encouraged. 18. This standard is still being met. (g) Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. 19. There are no new proposed structures. The building exists according to a previously approved plan. In addition, to the above general review standards, site plan applications shall meet the following specific standards set forth in Section 14.07 of the Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial or collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. 20. The reservation of land is not necessary. (b) Electric, telephone, and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. 21. No changes to existing underground utilities are proposed. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 22. This standard is still being met. -3- DECISION Based on the above Findings of Fact, the South Burlington Administrative Officer herby approves site plan application #SP-05-25 of Winston (Chip) Hart to amend a previously approved plan for a 32,000 sq. ft. general office building. The amendment consists of revising the landscaping plan, 30 Kimball Avenue, as depicted on a plan entitled, "Lot 5 Kimball Ave. Kimball Drive Williston, Vermont", prepared by O'Leary -Burke Civil Associates, PLC, dated 2/4/05, last revised on 5/20/05, with the following stipulations: 1) All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2) The plan shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans shall be submitted to the Administrative Officer prior to permit issuance. a) The plan shall be revised to correct the project location in the title block to South Burlington. 3) Prior to permit issuance, the applicant shall post a $6900 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 4) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5) The applicant shall obtain a Certificate of Occupancy from the Administi ative Officer after planting all the landscaping. 6) Any change to the site plan shall require approval by the South Burlington Development Review Board. 4,41 Signed this � I day of May, 2005 by rnond J.
