SITE PLAN APPLICATION #SP-17-64
FINDINGS OF FACT AND DECISION
Kimball Partners, LLC, hereinafter referred to as the applicant, is seeking approval to
amend a previously approved plan for a 23,242 sq. ft. general office building. The
amendment consists of replacing the ground mounted HVAC unit, 30 Kimball Avenue.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a
previously approved plan for a 23,242 sq. ft. general office building. The amendment
consists of replacing the ground mounted HVAC unit, 30 Kimball Avenue.
2. The owner of record of the subject property is Kimball Partners, LLC.
3. The subject property is located in the C1 - LR Zoning District.
4. The application was received on September 7, 2017.
5. The plan submitted is entitled, "Lot 5 Kimball Ave. Kimball Ave South Burlington,
Vermont Site Plan Replace Cooling Tower", prepared by O'Leary — Burke Civil
Associates, PLC, and dated 8/23/17.
DIMENSIONAL REQUIREMENTS
6. Coverages are not changing.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Bicycle Parking
8. The plan complies with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate the full requirement of five (5) bicycle
spaces.

9. The proposed HVAC unit will meet the setback requirement and will be screened
with $2,200 worth of evergreen trees to comply with Section 13.18 of the LDRs.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-64 of Kimball Partners, LLC, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. Prior to permit issuance, the applicant must post a $2,200 landscaping bond. This
bond must remain in full effect for three (3) years to assure that the landscaping has
taken root and has a good chance of survival.
4. The applicant must obtain a zoning permit from within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and void.
5. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the site modifications.
7. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

decision by filing a Notice of Appeal with the secretary of the Development Review
Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
