FINDINGS OF FACT AND DECISION
Heritage Flight is seeking site plan approval to amend a previously approved plan for a
65,150 sq. ft. aircraft maintenance hangar. The amendment consists of after -the -fact
approval to install barbed wire on the chain link fence surrounding the above ground
storage tanks, 228 Aviation Avenue.
The Development Review Board held a public hearing on August 3, 2011. Jon Lienwohl
represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. Heritage Flight is seeking site plan approval to amend a previously approved plan for
a 65,150 sq. ft. aircraft maintenance hangar. The amendment consists of after -the -fact
approval to install barbed wire on the chain link fence surrounding the above ground
storage tanks, 228 Aviation Avenue
2. The application was received on June 29, 2011.
The owner of record of the subject property is City of Burlington, Burlington
International Airport.
4. The subject property is located in the Airport Industrial Zoning District.
5. The plans submitted consist of a three (3) page set of plans, page one (1) entitled
"Fuel Farm and ADF Tank Pad Expansion (LP-1)", prepared by Truex Cullins, dated
October 22, 2009.
6. Section 13.17 (C) (1) of the SBLDR's prohibits the use of barbed wire on fences.
7. The applicant has installed barbed wire on the fence surrounding the fuel tanks.
8. The applicant submitted documentation from the FAA indicating that the DRB is pre-
empted from prohibiting barbed wire for airport security reasons. The Board
acknowledges that it is pre-empted from denying the request by FAA regulations.

DECISION
Motion by Joe Randazzo, seconded by Tim Barritt, to approve Site Plan Application
#SP-11-26 of Heritage Flight subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant and
on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to the use of the building and the storage tanks.
5. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.
