That the South Burlington City Council deny the conditional
use application of Burlington Data Processing, Mr. Richard Tarrant
(agent) for construction of an office complex on Kennedy Drive, as
depicted on the plan of record, based on the following findings:
1) the proposes use is not consistent with standards 2,3 anc
4 of Section 5 of the city's Interim Zoning Regulations.
2) the proposed use would be detrimental to the general char-
acter of the area.
3) the area in question is zoned Residential (multi -family)
under the city's permanent zoning regulations, and should be de-
veloped in conformance with those regulations.

Dear Dick:
At the September 5, 1978 hearing on the above
application, the City Council asked us to provide,
in writing, further information as to the size of
the individual parking spaces shown on the plot
plan which we submitted. This is in response to
that request.
Each parking space is 20 feet by 9 .feet.
At the conclusion of our presentation last night,
the Council indicated that it would discuss and
decide on our application at a later meeting. Would

Dear Ms. Cain:
Be advised that both of the above named projects have been approved
by the City. Both are in conformance with the City's Comprehensive
Plan and will be served by municipal sewer and water facilities.
Enclosed is a copy of the January 8, 1979 minutes of the City
Council, you will note the first condition of approval, which
provides for a setback allowing for the proposed southern connector.
On page 3 the condition was amended to a setback of 150 feet.

Date: September 1, 1978
Additional information has been obtained from the applicant
relating to the useable floor area of the proposed building.
The building containing 10,000 square feet will have 3,202 sq.
ft. of office area with the remaining area used for storage and com-
puters. The proposed expansion will be constructed along with the
original building, the proposed office area in total (8,380 s.f.)
would require 41 parking spaces, 50 spaces are proposed.

Re: Upcoming conditional use application (1) Burlington Data
Processing, Inc.
Date: August 28, 1978
Proposed is the construction of a new facility, containing 10,368
square feet with an future expansion of 5,184 square feet. Parcel
of land in question containing 2.4 acres and is located southerly of
the Georgetown Apartments on Kennedy Drive.
Attached is the applicant's information sheet regarding the use,
number of vehicles per day entering and leaving the subject property,
and a general description addressing the review criteria.
Upon review to the sketch plan I find that the building does not
comply with the demensional requirements. Upon discussing this
with the developer he informs me that a revised plan will be sub-
mitted at a later date.
Parking as proposed is in compliance for the first phase, the
proposed expansion will require an additional twenty-five (25) park-
ing spaces. On -site water and sewer is proposed, municipal water
and sewer should be extended to this property.
Under the 1974 zoning regulations this area is zoned Residential
the character of the area is residential with the exception of one
office building across the street.

APPENDIX TO APPLICATION FOR CONDITIONAL USE OF
BURLINGTON DATA PROCESSING, INC.
Applicant proposes to construct a building on the
subject property in compliance with the dimensional require-
ments applicable to the R7 district. Access to the property
will be through 1 curb cut (2 lanes wide) on Kennedy Drive.
A rough sketch map is attached. A more precise sketch map will
follow.
The building will be used to house the operations
of applicant, a data processing company.
This proposal will not materially increase the traffic
on Kennedy Drive nor on roads and highways in the vacinity.
Applicant has 28 employees and the visits of customers, delivery
persons and others to its premises are infrequent. A recent
survey of persons entering and leaving applicant's present
premises over a period of 10 days indicates that a total of
between 31 and 38 cars per day would enter and leave the sub-
ject property.
This proposal will not tax the capacity of community
facilities or services. The use to which the property will be
put will not require much water nor produce much sewage. In
any event, if possible, applicant would prefer to install its
own well and subsurface sewage disposal system. The anticipated
use of police and fire services would be minimal. There would
be no burden on the South Burlington School System, since applicant
is merely moving from downtown Burlington and it is unlikely
that any employees will move their familes to South Burlington
because of this shift.

This proposal will be compatible with the compre-
hensive plan and the existing patterns and uses of develop-
ment in the area. The nature of applicant:'s business and
anticipated traffic patterns will not pose a threat to the
high density residential use to which much of the nearby
property has been put. In fact, it may be preferable to
residential use of the subject property.
The subject property is not in a significant natural
resource area. Furthermore, there are no environmental
limitations to the property which would prevent the construction
of the proposed building.

1. As purchasers of housing in a residentially zoned area, we
respectfully submit that the council has a responsibility to
continue to maintain a residential zoning requirement.
2 We feel to alter the zoning requirement thereby creating a
mixture of commercial building will devalue residential use
housing.
3. We feel that since Kennedy Drive acts as ingress and egress
to the interstate system that additional traffic is undesirable
and even dangerous to residents and retirees as well.
4. We feel that the ecology of the area will suffer by substituting
concrete parking lots for natural cover. Trees also improve
the quality of air and act as noise barriers.
