The total land involved in exchange is 0.15 acres. SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at acceptable pressure. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. No new buildings or infrastructure is proposed. Therefore, review by the Water Department or Water Quality Control department is not necessary. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. No new construction or alterations to grade are proposed. Therefore, an erosion control plan is not necessary as part of this application. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. The existing access will not change. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer. areas. There are no changes to the layout of the site. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. As no new infrastructure or buildings are proposed, there is no need for review by the Fire Department. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. There are no changes necessary with respect to this criterion. Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. As there are no changes to the road network and no new buildings are proposed, there is no need for review by the City Engineer. The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). Staff feels the proposed subdivision of this property is in conformance with the South Burlington Comprehensive Plan. J SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications. The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. Mr. Bernier displayed a drawing of the proposal and indicating the change made in the parking, with some in the front and some along the sides, with the parking being screened by white pines along the front and the sides. The'parking spaces are to be 10 x 18. The size of the building has been increased from the original plan. Mr. Ward referred to his memo of October 8th, saying 15 parking spaces are required, and from a circulation standpoint it would be necessary to increase the back line, and the further back this goes it would interfere with the root structure of the trees. If they maintain the existing line and the Commission would grant*a waiver, they could park 7 or 8 cars in back, but by increasing the size of the building there would be no parking in back at all. Chairman Wessel asked if this plan was sufficiently accurate to be filed in the City Clerk's office. Mr. Ward said in order to lay out the parking without damaging the root structures of the trees, Mr. Bernier had to come up -with this second plan. The alternative is having the parking up front or getting a waiver, he said, and indicated on the drawing where the would be interfering with the root structure of the trees. Mr. Le",ay said they should have the minimum parking, that is 15 spaces. j Tr. Bernier said they would be servicing about 15 cars a day, but they come and go. Mr. Poger asked if there would be any overnight parking in the outside lot. Yr. LeMay said there could be half a dozen cars waiting to be picked up. Mr. Woolery asked how much bigger the building would be than what was originally planned. Yr. Bernier said 10 feet wider and 60 feet longer, 140 x 60 whereas before it was 80x50. Mr. Woolery asked how close it would be to Green Mountain Drive. Mr. Bernier replied 80 feet, perhaps 95 feet from the pavement. Yr. LeMay said if they could go 17 feet from the road itself and not from the right of way, they could put the parking in there. Mr. Ward said the plan is in conformance and meets all the requirements, the existing driveway will be used where it wasn't before. he said he felt it was important to maintain all the existing vegetation on that site, which Is what they are trying to do, but the difference is they will have to park In front. This will staill maintain better than 50% of the front yard. he said the angled parking in the back of the lot would have needed more turning movement area plus parking area; it would have accomplished the 15 car parking; but since that time there appears to be a little bit more Involved in saving those trees, and they also feel they need more parking. They have doubled the size of the building. That is something the Tuff Yote representative has come up with because it was felt more space was needed. Mr. Lidral asked about the existing curb cut being closed. ?fir. Ward said that was immaterial because they are going to use it, but he said there should be a bond for landscaping. Mr. Bernier pointed to the existing storm drain on the drawing, saying they would tie into that. Mr. Ewing questioned the drainage from the parking lot, and also asked about the separator. Mr. Bernier said that had been approved by the City Zanager. Site Plan Review for Sambo's Restaurant, Mr. Finest Pomerleau Mr. Pomerleau displayed the site plan drawing of the proposal, saying it was the same type of broad plan as Burger King in order to expose as much visual line as possible. He said, as agreed, they would supply a sidewalk across the proposed parcel of 200 feet and tie into the Burger King parcel. They have talked with the Highway Department concerning the curb cut open- ings and have designed them according to the State's design specifications. They have made agreements that when they propose to utilize the future piece of property they will extend this single access through this back piece, tying in this proposed third parcel and also Burger king so that for over 700 feet of frontage there would be only two entrances. This would be no hardship for Burger King to be only 25 feet off the road, but for Sambo's it would be too far to be practical. They would also work in conjunction. with the Gulf Station with a network of connecting roadways so they would be all inter -related. Mr. Pomerleau said they had spent a great deal of time on their plan. They have an elaborate landscaping plan, incorporating low level lighting and also adequate lighting for the parking area which would be black anody zed illumination. They have met all the ordinances without requiring any variances; they have actually more land than they need. The signs are all in conformance with the zoning criteria. They have established earth mounds to break the contour of the land; have gone into a varied selection of trees from maples to junipers, and Japanese snowballs to dwarf burning bushes. These are good sized trees, 22" caliber. The plantings are specified on the plan by either height of planting or caliber. It is very heavily landscaped. and the way it is layed out should be aesthetically pleasing. For t.he. building, the design is low profile with fieldstone being used, and all four sides of the building are to be treated with either fieldstone or some type of wood effect. The business is not designed to be a fast food operation; it is designed primarily for sit down service, a varying menu, with not quite the turnover of a fast food style restaurant Mr. Poger asked if it would be unrealistic to stipulate that the possibility - of Sambo's being tied into a road in back could be left open, and the curb cut into Sambo's be closed, such as the stipulation with Burger King but depending on the way the rest of the land is developed; it may be desirable to do so at that time. The Commission cannot require it but it could look toward the possibility of closing the curb cut if in the requirements for the rest of the subdivision the acreage could be used for open space with nothing between Sambo's and that central road, that the curb cut be closed and Sambo's be connected to that central access road. Mr. Pomerleau said this would be no hardship to Burger King but would affect Sambo's. Mr. Poger felt there would be no hardship to Sambo's because if there was a straight line of sight it could be seen before anyone got to that road. This would be making a distinction between the fast food type of Burger King and a family style restaurant like Sambo's. Yr. Pomerleau felt it was a very highly traveled tourist area and not'h4,ving this entrance could eliminate 10% of the business and that 10% could be the entire profit margin -- just actual tangible facts. He was sure Sambo's would not like to take the chance of utilizing this particular piece of property. The question now arises as to whether the applicant must conform to the setback requirements of the proposed zoning regulations, or whether it has a vested right because of its prior subdivision approval. We feel that the subdivision approval in 1969 is not suffi- cient to give the applicant a vested right insofar as the setback requirements are concerned. Our reasoning is that the issues submitted to the Planning Commission did not include setback restrictions and this is in fact a zoning question. On the other hand, since the application will need to be reviewed by the City Council, the Council would be empowered to consider the physical features of the property and other aspects of the property which may dictate lesser setback requirements than those set forth in the proposed regulations.
