Re: Findings of Fact, application of Adult Day Care to convert
2400 square feet of medical use to a 30 person adult day care in an
18,000 square foot general and medical office complex, 1 Kennedy
Drive.
On the 18th day of June, 1996, the South Burlington Planning
Commission approved the request of Adult Day Care for site plan
review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of converting 2400 square feet of medical
office space to a 30 person adult day care in an 18,000 square foot
general and medical office complex. This office complex was
approved on 9/28/82. The ZBA on 6/10/96 granted the applicant a
conditional use permit for the proposed use.
2. This property located at 1 Kennedy Drive lies within the R7
District. It is bounded on the north by Kennedy Drive, on the west
by Dorset Street and on the south and east by Potash Brook.
3. Access/circulation: Access is provided by a 25 foot curb cut
on Kennedy Drive and a 22 foot curb cut on Dorset Street. No
changes proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 9.1% (maximum allowed
is 30%). Overall coverage is 36.5% (maximum allowed is 70%).
Front yard coverage along Kennedy Drive is 55.5% and along Dorset
Street is 50.4% (maximum allowed is 30%). This is an existing
situation which will not be made worse by this application.
Setback requirements are met.
5. Parking: The existing and proposed uses require a total of 80
parking spaces. A total of 84 spaces are being provided including
four (4) handicapped spaces.
6. Landscaping: There is no minimum landscaping requirement,
based on building costs, for this project. The site is well
landscaped and no additional landscaping is recommended.
7. Sewer: No additional allocation needed.
8. Traffic: This property is located in Traffic Overlay Zone 5
which will allow this property to generate a maximum of 116.6

vehicle trip ends (vte's) during the P.M. peak hour. It is the
Planning Commission's determination that the change is use will not
generate any additional vte's during the P.M. peak hour.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Adult Day Care to
convert 2400 square feet of medical use to a 30 person adult day
care in an 18,000 square foot general and medical office complex,
1 Kennedy Drive, as depicted on a two (2) page set of plans, page
one (1) entitled, "One Kennedy Drive, South Burlington, Vermont,
Updated Site Plan," prepared by FitzPatrick-Llewellyn, Inc., dated
June, 1996, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the change is use will generate zero (0) additional vehicle
trip ends during the P.M. peak hour.
3. The applicant shall obtain a zoning permit for the change in
use within six (6) months pursuant to Section 27.302 of the zoning
regulations or this approval is null and void.
4. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to
occupancy of the building.
5. Any change to the site plan shall require approval by the South
Burlington Planning Commission.
