SITE PLAN APPLICATION #SP-17-03
FINDINGS OF FACT AND DECISION
Olivia Kazak, hereinafter referred to as the applicant, is seeking to amend a previously
approved plan for a mixed -use three (3) building complex consisting of: 1) 12,521 sq. ft.
of general office use, and 2) 7,180 sq. ft. of medical office use, The amendment consists
of converting 1,109 sq. ft. of general office use to personal service use (3 treatment
stations), 1 Kennedy Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved plan for a mixed -use
three (3) building complex consisting of: 1) 12,521 sq. ft. of general office use,
and 2) 7,180 sq. ft. of medical office use, The amendment consists of converting
1,109 sq. ft. of general office use to personal service use (3 treatment stations),
1 Kennedy Drive.
2. The owner of record of the subject property is Albem, LLC.
3. The subject property is located in the Residential 7 Zoning District.
4. The application was received on January 13, 2017.
5. The plan submitted is titled, "1 Kennedy Drive Kennedy Drive & Dorset Street
South Burlington, VT", prepared by O'Leary -Burke Civil Associates, Inc., dated
3/12/02, and last revised on 12/29/16.
DIMENSIONAL REQUIREMENTS
6. There are no dimensional changes associated with this application.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Parking

8. The plan submitted for this application shows 84 parking spaces available
including four (4) handicapped spaces. The existing and proposed uses require a
total of 82 spaces, therefore the parking requirement is being met. Parking is
located on the front of the buildings. No changes to parking is being proposed.
TRAFFIC
9. The change in use is estimated to result in a reduction in PM peak hour vehicle
trip ends by 0.04 vtes.
OTHER
10. The current dumpster enclosure does not meet the standard that it be enclosed
on all four (4) sides with opaque fencing. The plan should be revised to note that
the enclosure will be screened to meet the standard.
11. The plan does not include the snow storage areas and therefore should be
revised to indicate the snow storage areas.
12. No additional water or wastewater allocation is needed for this project as
evidenced by the issuance of Wastewater System and Potable Water Supply
Permit #WW-4-4773 by the State Drinking Water and Groundwater Protection
Division.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-03 of Olivia Kazac, subject to the following conditions:
1) All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2) This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3) For the purpose of calculating road impact fees under the South Burlington
Impact Fee Ordinance, the Administrative Officer estimates that this project will
generate zero (0) additional vehicle trip ends during the p.m. peak hour.
4) The site plan must be revised to show the changes below and will require
approval of the Administrative Officer. Three (3) copies of the approved revised
plan must be submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to show the snow storage areas.
b. The plan must be revised to note that the enclosure will be screened with
opaque fencing on all four (4) sides.

5) The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
6) Prior to issuance of a zoning permit, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF)
format.
7) All exterior lighting shall be installed or shielded in such a manner as to conceal
light sources and reflector surfaces from view beyond the perimeter of the area to
be illuminated. All noncomplying exterior light fixtures must be removed or
replaced with conforming fixtures prior to the issuance of a Certificate of
Occupancy.
8) The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to using the building for the new use.
9) Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
