Act 250 Application
work under Section 404 of the Clean Water Act was granted by the Army Corps of
Engineers on March 10, 2003 (see attached approval letter). The Categorical Exclusion
approval under the National Environmental Policy Act included a Wetland Finding
(attached) to satisfy Executive Order 11990.
Impacts to state and federal jurisdictional wetlands are expected to total approximately
0.35 acres, including 0.08 acres of impact to Vermont Class 3 wetlands, 0.27 acres of
impact to Vermont Class 2 wetlands, and 3.19 acres of impact to the 50-foot buffer zone
of Vermont Class 2 wetlands (Table 1). The Class 2 wetlands are large wetlands
associated with Potash Brook, and include emergent marsh, scrub -shrub, and open water
wetlands.

Project Address: Kennedy Drive (Dorset Street to Williston Road)
Project Description: The City of South Burlington Public Works Department, hereafter referred
to as the applicant, is requesting Conditional Use approval for wetland encroachment resulting
from the widening of Kennedy Drive to four (4) traffic lanes and adding 4' bike lanes.
Comments
Associate Planner Brian Robertson, hereafter referred to as staff, has reviewed the application
and has the following comments:
Pursuant to Section 14.10(E), shall consider the following criteria when reviewing
Conditional Use applications:
1. The proposed use, in its location and operation, shall be consistent with the planned
character of the area as defined by the City of South Burlington Comprehensive Plan.
Staff feels the proposed project is consistent with the planned character of the area.
2. The proposed use shall conform to the stated purpose of the district in which the
proposed use is to be located.
The location of the proposed project intersects numerous zoning districts. However, staff does
not feel it contradicts any of the stated purposes of the applicable zoning districts.
3. The proposed use shall not adversely affect:
(a) The capacity of existing or planned municipal or educational facilities.
Approval of the proposed project will support both existing and planned municipal facilities.
(b) The essential character of the neighborhood or district in which the property is located,
or the ability to develop adjacent property for appropriate uses.
The area where the project is proposed is currently developed with a three lane roadway. Staff
does not feel the expansion to a four lane roadway will have a significant impact on the character
of the area.
(c) Traffic on roads and highways in the vicinity.
Approval of the proposed project should improve traffic on the roads in the vicinity.

The proposed project will not adversely affect any of the City's bylaws in effect.
(e) Utilization of renewable energy resources.
Renewable energy resources will not be affected through this proposal.
(f) General public health and welfare.
General public health and welfare will not be adversely affected by the proposed project.
Pursuant to Section 12.02(E) of the Land Development Regulations, the Development
Review Board shall consider the following standards for wetlands protection:
(1) Consistent with the purposes of this Section, encroachment into wetlands and buffer
areas is generally discouraged.
As wetland are present to the north and south of Kennedy Drive, any expansion of the roadway
will require encroachment into wetland buffers. The project will primarily affect the 50' buffer to
the north of Kennedy Drive.
(2) Encroachment into Class II wetlands is permitted by the City only in conjunction with
issuance of a Conditional Use Determination (CUD) by the Vermont Department of
Environmental Conservation and positive findings by the DRB pursuant to the criteria in
(3) below.
The affected area does contain Class II wetlands. The applicant has obtained a CUD from the
Vermont Department of Environmental Conservation.
(3) Encroachment into Class II wetland buffers, Class III wetlands and Class III wetland
buffers, may be permitted by the DRB upon finding that the proposed project's overall
development, erosion control, stormwater treatment system, provisions for stream
buffering, and landscaping plan achieve the following standards for wetland protection:
(a) The encroachment(s) will not adversely affect the ability of the property to carry or
store flood waters adequately;
At the June 5, 2003 natural Resources Committee meeting (minutes enclosed), the Director of
Public Works and applicant, Bruce Hoar, stated that the water level in the pond connected to the
subject wetlands has been maintained at a consistent level in the three years he has been the
Director. A new culvert will be installed in replace of the existing culvert on the southern side of
the subject roadway.

Staff feels this is sufficient to support the ability of the wetlands to store flood waters adequately.
(b) The encroachment(s) will not adversely affect the ability of the proposed stormwater
treatment system to reduce sedimentation according to state standards;
The applicant has obtained a CUD from the State, so staff feels this requirement is met.
(c) The impact of the encroachment(s) on the specific wetland functions and values
identified in the field delineation and wetland report is minimized and/or offset by
appropriate landscaping, stormwater treatment, stream buffering, and/or other mitigation
measures.
The applicant has stated that stormwater improvements will be incorporated into the proposed
project to maintain water quality.
Other
The South Burlington Natural Resources Committee (NRC) discussed the proposed project at
their June 5, 2003 meeting (minutes enclosed). The NRC had no problems with the proposal and
voted unanimously to approve the project.
Recommendation
Staff recommends that the Development Review Board approved Conditional Use application
#SD-03-16 as proposed.

The South Burlington Natural Resources Committee met on Thursday, June 5,
2003 at 7:00 P.M. A site visit was conducted to the Dubois property at 6:30 P.M.

New regulations require retention and controlled outflow rather than sheet flow.
Kennedy Drive: Bruce Hoar, Public Works Director, explained the project. 50'
buffer zone will be affected primarily on the westerly portions of the project. 4' bike
lanes and 4 traffic lanes from Dorset Street to Williston Road.
Bill asks whether the project will affect egret pond. Bruce responded the pond site
will not be affected. The road won't be widened on that side, but culvert will be
replaced on that side. Water level has been maintained in the three years that Bruce
has been the director.
Peter asked if wetland complex being improved in any way. Bruce said stormwater
improvements will be made that will maintain water quality. Peter was happy to hear
that there will be system improvements.
Lani Ravin said new regulations improve H2O quality but have unintended
consequences of uglifying the landscape. Bruce responded that the challenge is to
keep the parkway character of Kennedy Drive. Bill responded, "yes, lets do it as
environmentally and visually sound as we can.
Landfill: Arsenic Maganese and iron contaminants. Tony Stout described the
project designed to clean up contaminants from water seeping out. State ordered
necessitates the project. B/C of nature of landfill this is only location for the filter
beds and water collection.
We're pushing limit as to the size of the filter beds. Can't go any smaller.
Winooski River is directly across the road from here. State looking at this as pilot
project.
Bill said how are we getting ride of the arsenic? Bruce assumes it gets picked up in
filter media. Bill said then what happens to it? Goes to another landfill. Bruce says
they will get the answer for Bill who wants to know where it is going. Tony will
submit in writing. Could come back to NRC before the Development Review Board
hearing.
A & M Construction: Skip McClellan explained mapped wetland was in fact no
wetland. Cathy O'Brien who mapped wetland for the City, revisited and concluded it
was mapped in error. Spring is rectangular concrete structure dug to about 4'. No
wetland species found.
Existing man made pond will stay and buffer will not be affected. Feb by a well (300
ft. drilled well) dug to make swimming hole, which has been capped. 1 gal/min
allowed out now.
Committee members do not refuse the evidence and do not question Cathy O'Brien
conclusions. Brian waxler described the project. Six condo units are proposed.
Ron Lyons explained wetlands analysis. Charlotte Brodie, Wetland expert did
delineation. Building clustered to avoid wetlands as much as possible. Road passes
through narrower wetlands site. Plan minimizes impacts (stormwater treat plans).
Showed original plan. No way to avoid the buffer.
Peter Jones had questions about Charlotte Brodie's report.
Charlotte Brodie's conclusion is drainage way at the back of the lot not stream.
Forested wetland with Red Maple, Green Ash, Boxelder, etc. some fairly large trees
there. Charlotte Brodie commented that wetland has ground water discharge,
sediment retention/control, very few functions and very low value and surrounded by
development proposal includes adding stormwater treatment system that will serve
this function.
Brian notes that beyond what is necessary to cut down for construction, trees will
not be cut.
Peter is concerned about maintaining connectivity and note that 2 houses on
Imperial Drive abutting this project are on the market. Brian says much of heavy
wood portions will be retained. Bill notes once trees are removed water level will be
raised.

The Vermont Agency of Natural Resources received application #2001-282 for a Conditional Use
Determination. This application has been publicly posted through March 27, 2003 and notice sent to
all parties as required by Section 8.3 of the Vermont Wetland Rules. One comment was received
during the public comment period.
Findings of Fact
After careful examination of this application, the Agency finds:
1. A complete application was received from Bruce Hoar, Director of Public Works for
Conditional Use Determination #2001-282 on February 25, 2003 .
2. The wetland and adjacent 50 foot buffer zone are located from the intersection with US Route
2/Williston Road to the intersection with Dorset Street in South Burlington.
3. Carl W. Pagel, State Wetlands Coordinator, conducted site visits to the subject property on
August 16, 2001 and October 3, 2001, respectively.
4. The reconstruction and widening of Kennedy Drive in South Burlington will have some
impact in 6 out of 7 mapped wetlands. Four wetland types are found in the project area and
include the following: 1) forested needle leaved evergreen/schrub-shrub wetland that is
seasonally saturated, 2) forested broad leaved deciduous wetland that is seasonally saturated,
3) scrub -shrub emergent wetland with a semi -permanent water regime, and 4) scrub -shrub that
is seasonally saturated. The wetlands are identified on the Vermont Significant Wetlands
Inventory maps and are therefore designated as Class Two wetlands by the Water Resources
Board in the Vermont Wetland Rules.

5. The seven wetlands will be described separately. Due to similarities, wetlands 1, 2, 3, 11, and
12 will be grouped together and wetlands I and 2A will be grouped together in describing
wetland values and functions.
Wetland 1 is approximately 14 acres in size. It is an open water marsh/forested wetland that is
currently being influenced by beaver. Vegetation in the area of impact includes broad-leaved
cattail, Phragmites, and red maple. The buffer zone is mostly pavement and mowed grasses
with a deciduous forest in the area of a proposed detention basin. The NRCS soil survey
shows Enosburg and Whately soils: poorly drained soils with sandy loam to loamy sand
textures. Since Kennedy Drive will be widened on the south side of the road, the edge of the
road and bike path along the north side will remain in their current locations. Impacts in this
area include 742 square feet in the wetland and 42,029 square feet in the buffer zone.
Wetland IA is approximately .5 acres in size. It is mainly a forested swamp. Vegetation in the
area of impact includes American elm and red maple. The buffer zone is pavement and
mowed road embankment. The NRCS soil survey indicates Hinesburg fine sandy loam, soil,
well drained, with 15 to 25% slopes. Kennedy Drive will be widened along the south side of
the road, so there will be little work beyond the existing road and embankment along the north
side at this location. There will be no wetland impact in wetland IA. Total buffer impact will
be 1,108 square feet.
Wetland 2 is approximately 5.0 acres in size. It is mainly marsh and shrub swamp. Dominant
vegetation in the area of impact is broad-leaved cattail. The buffer zone includes Kennedy
Drive, Twin Oaks Terrace, road embankment, commercial development, and limited
undeveloped land. The NRCS soil survey indicates Enosburg and Whately soils: poorly
drained soils with sandy loam to loamy sand textures. The detention basin at the corner of
Twin Oaks Terrace and Kennedy Drive will be constructed within a narrow, swale-like portion
of wetland 2. The drainage outlet at 20+340 right is being constructed to maintain natural
drainage patterns between wetlands 2 and 3 and to convey a limited amount of roadway runoff.
Impacts in this area include 3,260 square foot in the wetland and 26, 254 square feet in the
buffer zone.
Wetland 2A is approximately .5 acres in size. It is mainly a broad-leaved cattail marsh. The
buffer zone includes Kennedy Drive, road embankment, and second -growth uplands. The
NRCS soil surveys indicate Hinesburg fine sandy loam, soils, well drained, with 15 to25%
slopes. The soils are very poorly drained. Proposed are a new culvert, drainage outlets, and a
detention basin. The detention basin will treat roadway runoff that currently discharges
untreated into the wetland. Impacts in this area include 237 square feet in the wetland and
8,683 square foot in the buffer zone.
Wetland 3 is approximately 2 acres in size. It is an open water marsh with characteristics of a
shrub swamp. The buffer zone impact area includes Kennedy Drive, Twin Oaks Terrace, and
road embankments. The NRCS soil survey indicates Enosburg and Whately soils: poorly
drained soils with sandy loam to loamy sand features. Most of the impact in wetland 3 is at the
corner of Kennedy Drive and Twin Oakes Terrace, where road widening will push the road
embankment into a fringe of the wetland. Impacts in this area include 968 square foot in the
wetland 34,324 square feet in the buffer zone.
Wetland 11 is approximately 21 acres in size. It is a marsh and shrub swamp. Dominant
vegetation in the impact area includes reed -canary grass and tall goldenrod. The buffer zone
includes Kennedy Drive, road embankment, old field, and mowed upland. NRCS soil survey

indicates Enosburg and Whately soils: poorly drained soils with sandy loam to loamy sand
textures. Proposed work includes road widening, a detention basin, and basin outlet. The
detention basin will affect only a small, swale-like portion of the wetland at its western edge.
Impacts in this area include 1,291 square feet in the wetland and 7,134 square feet in the buffer
zone.
Wetland 12 is approximately .5 acres in size. It is a marsh and shrub swamp. Dominant
vegetation in the impact area is broad-leaved cattail, reed -canary grass and Phragmites. The
buffer zone includes Kennedy Drive, road embankment, and commercial land uses. The
NRCS soil survey indicates Enosburg and Whately soils in the northwestern corner of the
wetland. In the remainder of the wetland, closer to Potash Brook, soils are mapped as
Limerick silt loam, very wet. The soils within the impact area appear to be mostly fill
material. Proposed work is primarily road widening. Kennedy Drive will be widened mostly
along the south side, with the edge of pavement shifted about 42 feet south of the current edge.
Impacts in this area include 5,262 in the wetland and 19,368 square feet in the buffer zone.
6. The project involves widening Kennedy Drive from the current two or three lanes to four lanes
from Dorset Street to Williston Road, including full depth reconstruction. Also proposed are
four -foot shoulders, repaving the existing bike/pedestrian way, and a new sidewalk along the
south side of the road from Hinesburg Road to Williston Road. New stormwater treatment
systems will be constructed to minimize stormwater impacts to Potash Brook, an impaired
water body. One culvert carrying Potash Brook under the road will be replaced, and another
will be extended with a portion of the stream relocated. Portions of the project will be
constructed with a reinforced slope to minimize wetlands impacts. A total of 11,761 square
feet of Class Two wetland will be impacted by the proposal. A total of 138,901 square foot of
buffer impact is anticipated. The largest part of that impact is the existing road bed. Seven
small Class Three wetlands are located between VT Route 16 and Kimball Avenue. The
proposal will impact a total of 3,336 square feet of Class Three wetlands.
7. The applicant has submitted plans prepared by the Agency of Transportation entitled,
"Wetland Plan", South Burlington NH 121-1(1), Sheets 1 through 16, dated 1/01, and "General
Plan", South Burlington NH 121-1(1), Sheets 1-15, dated 1/01.
8. Wetlands 1, 2, 3, 11, and 12 are similar to each other in that they are all relatively large, have a
variety of wetland classes, are all within the Potash Brook drainage, and are closely associated.
Proposed impacts in these wetlands are also similar. The values and functions of the 5
wetlands will be described together. The protected functions of the above wetlands include at
least the following: water storage. for flood water and storm runoff (§5. 1), surface and
groundwater protection (§5.2), wildlife and migratory bird habitat (§5.4), education and
research in natural science (§5.7), recreational value and economic benefits (§5.8), open space
and aesthetics (§5.9), and erosion control through binding and stabilizing the soil (§5.10).
9. The following functions are either not present or are present at such a minimal level as to not
be protected functions: fisheries habitat (§5.3), hydrophytic vegetation habitat (§5.5), and
threatened and endangered species habitat (§5.6).
10. The wetland is significant for the water storage for flood water and storm runoff function
because these wetlands are within the 100-year floodplain, have densely vegetated areas, and
except for wetland 12, are relatively large. Collectively, they make up approximately 2.5% of
the Potash Brook watershed upstream of the project. There are large impervious areas within
the watershed and likely high rates and volumes of stormwater runoff. The proposed project

will impact small amounts of these wetlands. Stormwater treatment practices will result in a
net reduction in stormwater runoff rates and volumes for the project area. Based on the factors
described above, the proposed project will not result in an undue adverse impact to this
function.
11. The wetland is significant for the surface and ground water protection because Potash Brook is
in violation of water quality standards and is considered an impaired water body. There are
many sources of non -point pollution, primarily stormwater runoff, in the area. Much of the
runoff outlets to these large densely vegetated wetlands, allowing them to provide an important
water treatment function. Water quality is a critical concern of this project. Stormwater
treatment practices will treat most road runoff before it is discharged into the brook or wetland,
whereas most runoff is currently discharged untreated. This project is expected to result in a
net improvement in water quality within the wetlands and Potash Brook. Based on the factors
described above, the proposed project will not result in an undue adverse impact to this
function.
12. The wetlands are significant for the wildlife and migratory bird habitat function because the
wetlands have various amounts of open water, marsh, shrub swamp, forested wetland, and
stream habitat. Mallards, great blue herons, and a snowy egret have been observed in Wetland
1 and may utilize other wetlands as well. Beaver have been active in Wetland 1 and all of
these wetlands have potential habitat for muskrats and other wildlife. Wetland 12 is relatively
small, has limited marsh habitat, is disturbed, and lies within a highly urban surrounding.
Several measures have been taken to minimize wildlife impacts to these wetlands. Kennedy
Drive will be reconstructed on approximately the existing road alignment. Road widening will
occur along the south side, away from the higher value wetlands. The new road will be limited
to 4-foot shoulders, and a stabilized 1.5:1 earthen slope. Detention basins will be located
outside of wetlands or in smaller and disturbed portions of wetlands. The greatest individual
wetland impact will be to Wetland 12, which has limited habitat value. The constructed
detention basins should help preserve the integrity of the wetlands by improving water quality
and preventing channel scour or excessive discharge rates. Based on the factors described
above, the proposed project will not result in an undue adverse impact to this function.
13. The wetlands are significant for the education and research in natural science function because
Wetland 1 is adjacent to a high school and has foot trails and appears to be well suited to
educational and research activities. Wetlands 2, 3, and 11 are close to the school and densely
settled residential areas and also have educational potential. The proposed project will only
impact small appendages of these wetlands and will not significantly alter wetland
communities, impair access, or adversely affect potential educational or research features.
Based on the factors described above, the proposed project will not result in an undue adverse
impact to this function.
14. The wetlands are significant for the recreational value and economic benefit function because
Wetland 1 has clear recreational value as it has a kiosk and established trails. Wetlands 2, 3,
and 11, with a large residential population in the area, are also likely to be used for recreational
purposes. Wetland 12 does not have easy access or recreational features. The proposed
project will not affect access, trails, or other recreational features of the wetlands. Based on
the factors described above, the proposed project will not result in an undue adverse impact to
this function.

15. The wetlands are significant for the open -space and aesthetics function because Wetlands 1, 2,
3, and 11 are large and easily visible from adjacent roadways. Wetlands 1 and 3 both have
marsh and open water habitats, and Wetland 1 has recreational trails and easy access. Wetland
12 is smaller and more disturbed, with a developed surrounding, and is not significant for this
function. The project will result in a wider road, steeper side slopes, and new detention basins.
In general, the wetlands will be little affected and their general appearance is not expected to
change. Based on the factors described above, the proposed project will not result in an undue
adverse impact to this function.
16. The wetlands are significant for the erosion control through binding and stabilizing the soil
function because stormwater runoff from adjacent roadways and developed land enters the
wetlands with very dense emergent and shrub vegetation. This helps to slow runoff rates and
bind the soil in place, reducing erosion potential. Potash Brook meanders through Wetlands 1,
2, 11, and 12 where the stream banks are vegetated with dense emergent and shrub species
helping to stabilize the substrate. The proposed stormwater treatment practices will meet
channel scour protection requirements and will in general result in lower runoff discharge
rates. Based on the factors described above, the proposed project will not result in an undue
adverse impact to this function.
17. Wetlands lA and 2A are similar to each other in that both are small, on slopes, are partially
disturbed, receive stormwater runoff, and are associated with larger wetlands down slope. The
values and functions of these two wetlands will be described together. The protected functions
of the above wetlands includes at least the following: surface and groundwater protection
(5.2), wildlife and migratory bird habitat (5.4), education and research in natural sciences (5.7),
recreational value and economic benefits (5.8), and erosion control through binding and
stabilizing the soil (5.10).
18. The following functions are either not present in Wetlands I and 2A or are present at such a
minimal level as to not be protected functions: water storage for flood water and storm runoff
(5.1), fisheries habitat (5.3), hydrophytic vegetation habitat (5.5), threatened and endangered
species habitat (5.6), and open -space and aesthetics (5.9).
19. The wetlands are significant for the surface and ground water protection function because
Potash Brook is down slope within Wetlands 1 and 2, and is designated as an impaired water
body. Although the wetlands are small and on slopes, they nevertheless are densely vegetated
and appear to receive substantial stormwater runoff from roads and parking lots. This proposal
involves collecting roadway stormwater runoff and treating it in a detention basin before
discharging it to Wetland 2A, from where it will flow into Wetland 2. Direct physical impacts
to both wetlands will be limited. Based on the factors described above, the proposed project
will not result in an undue adverse impact to this function.
20. The wetlands are significant for the wildlife and migratory bird habitat function because both
wetlands have low to moderate wildlife habitat value. Both wetlands are small and somewhat
disturbed, with stormwater inputs and the adjacent roadway, commercial land use, and school
parking lot. They are part of larger communities that are very valuable wildlife habitat.
Wetland lA is along the edge of upland woods which are adjacent to the large and functionally
important Wetland 1. Wetland 2A is contiguous with old field habitat (along the road) and
Wetland 2. Based on the factors described above, the proposed project will not result in an
undue adverse impact to this function.

21. The wetlands are significant for the education and research in natural sciences function
because Wetland 1A is immediately adjacent to the high school and recreational trails, and
therefore has limited educational potential. There will be little physical changes in these
wetlands or buffer zones and no effects on the features that make them educationally
significant. Based on the factors described above, the proposed project will not result in an
undue adverse impact to this function.
22. Wetland I is significant for the recreational value and economic benefits function because it
is part of the recreational area associated with Wetland 1. Although small and adjacent to the
road and parking lot, it has limited recreational value as part of the large habitat system. Based
on the factors described above, the proposed project will not result in an undue adverse impact
to this function.
23. These wetlands are significant for the erosion control through binding and stabilizing the soil
function because stormwater runoff from adjacent roadways and developed land enters the
wetlands, and the dense vegetation helps stabilize the soil and prevent erosion. The proposed
project will control stormwater runoff discharge locations and rates and will construct stone
pads at outlets. These measures will lower the potential for erosion. Based on the factors
described above, the proposed project will not result in an undue adverse impact to this
function.
24. The proposed project has undergone a number of revisions to meet the avoidance and
minimization criteria of the Vermont Wetland Rules. The proposed alignment has been
selected to minimize impacts to wetlands on both sides of the road. Reinforced earth slopes
are proposed in the vicinity of the larger wetlands to further reduce impacts and only narrow
fringes of these wetlands will be affected. Stormwater treatment practices will be located
outside of wetlands where possible or in small portions of relatively disturbed wetland areas.
Stormwater treatment practices will help compensate for water quality protection and water
storage function affected by the proposed work.
25. Comments were received from the Department of Fish and Wildlife stating their concern of the
proposed project on wildlife and migratory bird habitat. This concern was presented to the
project consultants during early site visits. A true effort was made to avoid and minimize
impacts to wetlands with significant wildlife values.
26. If the project is constructed according to the specifications of the application and
accompanying site plans, and the conditions of this Conditional Use Determination, the
resulting wetland filling and alteration is not expected to result in any violations of the
Vermont Water Quality Standards.
Conclusions of Law
Based on information provided by the applicant and their representatives in the application for
Conditional Use Determination, the Agency of Natural Resources concludes:
Under Section 8 of the Vermont Wetland Rules, effective February 23, 1990, the Secretary
may authorize conditional uses in a significant wetland or in its adjacent buffer zone. The
Rules state that each Class Two wetland is presumed to serve all of the wetland functions
identified in the Rules (Section 4.2b). Protected functions are distinguished from other
wetland functions in Section 2.20, as those functions that make a wetland so significant they
merit protection under these rules. Under Section 8.5a, the Secretary may only authorize a

conditional use when it is determined that the proposed conditional use will have no undue
adverse effect on the protected functions, unless the Secretary determines such impacts arc
sufficiently mitigated.
The proposed conditional use cannot practicably be located on an upland portion of the site or
on another site owned, controlled or available to satisfy the basic project purpose. All
practicable measures have been taken in this proposal to avoid adverse impacts on protected
functions.
The Agency determines that the proposed conditional use, described in the Findings of Fact
and in the Conditional Use Determination application in question, will have no undue adverse
impacts to the protected functions of the Class Two wetland, associated buffer zone on this
subject property or the adjacent wetland complex.
Decision
The Vermont Agency of Natural Resources finds, that on the basis of the information provided
in the application for Conditional Use Determination, there is reasonable assurance that the
proposed conditional use will have no undue adverse effects on the protected functions of the
significant wetlands on this property provided the provisions of the application are
supplemented with the procedures described below. This Conditional Use Determination is
therefore approved with the following conditions:
A. All activity shall be completed, operated and maintained as set forth in accordance with
the proposal in Conditional Use Determination Application #2001-282 and all submittals
listed in Finding of Fact #7 above. No material or substantial changes shall be made in
the project without the written approval of the Vermont Wetlands Office.
B. The applicant shall notify the Vermont Wetlands Office in writing prior to the start of
this project.
C. A continuous line of silt fence shall be properly installed by the applicant prior to any
construction and shall be regularly maintained. Care should be taken to ensure that silt
fence is installed on the contour and not in areas of concentrated flow such as stream
channels or ditches. Sediment shall be cleaned out before and after any significant
storm event or when they have reached less than half the height of the fence. Removed
sediments shall be disposed of in a stable, upland area outside the 50-foot buffer zone at
least 200 feet from waters of the state and stabilized immediately with seed and mulch
at a minimum. All other disturbed soils shall be seeded and mulched within 48 hours of
final grading. All sediment barriers and construction fencing shall be removed following
the successful establishment of vegetation. NOTE: Erosion and sediment control shall
be performed in accordance with the NPDES discharge permit.
D. Within 30 days upon completion of the proposed work in the wetland and/or buffer zone,
the applicant or their representative shall supply the Vermont Wetlands Office with a
letter certifying that the project was constructed in compliance with the conditions of this
determination.
E. All proposed activities in the wetland and adjacent 50-foot buffer zone, carried out in
compliance with Condition A, must be completed within four years of the date of the
Conditional Use Determination or it will expire. An extension of time may be granted

for cause. A request for an extension must be received by the Department at least 30
days prior to the end of the four year period in order to prevent the expiration of this
Conditional Use Determination. A request for extension will be considered a minor
modification.
F. The terms and conditions of this decision shall run with the land.
G. The applicant shall monitor the portions of the wetlands in question annually during
early July for five years following construction for the nuisance plant species purple
loosestrife (Lythrum salicaria) and common reed (Phragmites australis). All nuisance
plants found shall be pulled by hand and disposed of by burial or burning in a non -
wetland location. Additionally, the contractors equipment shall be cleaned so as to
contain no observable soil or vegetation prior to work in wetlands and buffer zones to
help prevent the spread of invasive species.
2. The Agency maintains continuing jurisdiction over this project and may at any time order
remedial measures be taken if it appears likely that adverse impacts to the protected functions
and values will occur.
3. This Conditional Use Determination does not relieve the applicant of the responsibility to
comply with any other applicable federal, state, and local laws, regulations, and permits.
4. By acceptance of this Conditional Use Determination the applicant agrees to allow
representatives of the Department of Environmental Conservation access to the property
covered by the Conditional Use Determination, at reasonable times, for the purpose of
ascertaining compliance with the Vermont Wetland Rules and the Vermont Water Quality
Standards.
5. The Department, by issuing this Conditional Use Determination, accepts no legal responsibility
for any damage direct or indirect of whatever nature and by whoever suffered arising out of the
project described.
