MOTION OF APPROVAL
TRIPP— CONDITIONAL USE APPLICATION — ACCESSORY APARTMENT 8
KEARI LANE
I move the South Burlington Development Review Board approve conditional use
application #CU-01-30 of Cathy E. Tripp seeking conditional use approval from Section
26.05, Conditional Uses, and Section 26.75, Accessory Residential Units, of the South
Burlington Zoning Regulations. Request is for permission for establishing an accessory
residential unit in a single family dwelling, g Kean' Lane, as depicted on a one (1) page set
of plans entitled "Sketch Plan Proposed Addition", with a stamped received date of 7/24/01,
with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2) The occupancy of this accessory unit will be limited to the conditions of Section 26.75 of
the Zoning Regulations including:
a) Occupancy of the accessory residential unit is restricted to not more than two (2)
persons, one of whom is related by blood or marriage to the owner of the primary
single-family residence, or is disabled as defined in subdivision 252(2) of Title 18,
or is at least 55 years of age.
b) Floor space of the accessory residential unit shall not exceed 30% of the floor space
of the existing living area of the primary single-family residence or 400 square feet,
whichever is greater.
c) The primary single-family residence is occupied by the owner.
3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the Zoning Regulations or this approval is null and void.
4) Any change to the site plan shall require approval by the South Burlington Development
Review Board.
No other issues were raised.

Ms. MacCallum said staff has no issues.
Ms. Anderson, a neighbor, noted the applicant is a potential owner of the property. Ms.
MacCallum reviewed the history of the application. The apartment already exists but was
never approved. The applicant is seeking an addition to the unit that meets all
restrictions. They potential owner can apply as long as they have the current owner's
consent.
Mr. Boucher moved that the Board approve Application #CU-01-30 of Cathy E.
Tripp, subject to the stipulations in the draft motion of 24 July 2001. Ms. Quimby
seconded. Motion passed unanimously.
7. Public Hearing: Appeal 9VR-01-01 of Arnold & Rite Cota seeking a variance
from Section 25.00, Area, Density, and Dimensional Requirement, of the
South Burlington Zoning Regulations. Request is for permission to allow a
front porch addition to project 2.5 feet into the required front yard setback
requirement, 12 Sherry Road:
Mr. Yeoman noted that he is helping the Cotas who have been displaced by airport
construction. He found them this property but they would like to add a front porch. He
said a 2 foot variance would work.
Mr. Dinklage noted that these houses were built with special considerations to allow them
to be inexpensive. With these considerations went a burden on homeowners that they
would have a problem if they sought to expand the properties into the front yard.
Mr. Cameron said if the numbers are accurate, he would not allow the application.
Mr. Cameron then moved that the Board deny the Applicants' request for a
variance as the five criteria necessary for the granting of a variance pursuant to 24
VSA 4468 have not been met. Ms. Quimby seconded. Motion passed unanimously.
No other issues were raised.

DEVELOPMENT REVIEW BOARD MEMO
DULY 24, 2001 MEETING
Setback requirements are not being met for the addition. It is proposed to be 15 feet from
the Farrell Street r.o.w. Farrell ,Street is designated as a future street which has a 4.0 foot
setback requirement. The Board previously modified this setback requirement to 15 feet in
their February 2001 approval (minutes enclosed). This modification of the standards was
based on elevations of the proposed addition which were deemed to provide a strong
pedestrian and human scale connection to the public street as recommended by the Resign
Review Committee. The applicant should submit elevations with the final plat application
to ensure that the proposed addition still achieves a high level of communication with the
streetscape.
Building Height: The previously approved addition was approved for a maximum height of
45 feet under Section 25.113c of the Zoning Regulations. The applicant should submit
information on the maximurn height of the proposed addition at final plat.
Parking. A total of 503 spaces are required and 471 spaces are provided including 19
handicapped spaces. This represents a 32 space or 6.4% shortfall. Staff does not have a
problem with granting a waiver for the parking shortfall. A bike rack is being provided as
required.
Landscaping; The applicant should submit building cost information and a landscape plan
with schedule at final plat.
Traffic: The applicant previously submitted a traffic impact analysis for the February 2001
approval. This study concluded that the reduction in overall size of the shopping center will
result in zero (0) additional P.M. peak vte's.
Sewer: This property is connected to the City of Burlington sewer system.
Lighting: The applicant should submit any changes to the approved lighting at final plat
application. Plans should depict the location of all exterior lights and cut sheets should be
submitted noting the wattage, type, and height of each proposed exterior light.
Dumpster: All dumpster/compactor storage areas are labeled and screened.
Other: A sound barrier fence should be erected between the loading area of the shopping
center and the adjacent residential area.
6) TRIPP — CONDITIONAL USE APPLICATION — ACCESSORY APARTMENT,
8 KEARI LADE
This project consists of a request under Section 26.05, Conditional Uses, and Section
26.75, Accessory Residential Units, of the South Burlington Zoning Regulations. The
request is for permission for establishing an 814 square foot accessory residential unit in
a 2,950 square foot single family dwelling, 8 Keari Lane.

This property is located within the Residential Two District. It is bounded on the north
by Kearl Lane, on the west by a single-family residence, on the south by a single-family
residence, and on the east by single-family residence.
The proposed use complies with the stated purpose of the Residential Two District to
"encourage lower moderate -density residential use."
The proposed use will not adversely affect:
a) the capacity of existing or planned community facilities. No effect expected.
b) the character of the area affected. No adverse effect is expected.
c) traffic on roads or highways in the vicinity. The proposed use is not expected to
affect traffic.
d) bylaws in effect. The proposal is in conforinance with the zoning regulations.
e) utilization of renewable resources. There is no utilization of renewable energy
resources to be affected,
f) general public health and welfare. No adverse effect is expected.

Section 26.75 of the Zoning Regglations: The occupancy of this dccessory unit will be
limited to the conditions of Section 26.75 of the Zoning Regulations including:
a) Occupancy of the accessory residential unit is restricted to not more than two (2)
persons, one of whom is related by blood or marriage to the owner of the primary
single-family residence, or is disabled as defined in subdivision 252(2) of Title 18,
or is at least 55 years of age.
b) Floor space of the accessory residential unit shall not exceed 30% of the floor space
of the existing living area of the primary single-family residence or 400 square feet,
whichever is greater. Infon-nation provided by the applicant indicates that the
accessory residential unit will not exceed the size limitation of 30%.
c) The primary single-family residence is occupied by the owner.
The applicant has been made aware of these conditions and does not have a problem with
them.
7'i COTA — VARIANCE REQUEST, 12 SHERRY ROAD
The applicants are seeking a variance from Section 25.00, Area, Density, and
Dimensional Requirements, of the South Burlington Zoning Regulations. The request is
for permission to allow a front porch addition to project 2.5 feet into the required 30 foot
front yard setback requirement, 12 Sherry Road.
This property is located in the Residential Four District. It is bounded on the west by
Sherry Road, on the north by a single-family residence, on the east by multi -family
housing, and on the south by a single family residence.
Section 25.00 Area, Density, and Dimensional Requirements Variance Criteria.,
There are no unique physical circumstances or conditions, including irregularity,
narrowness, or shallowness of lot size or shape, or exceptional topography or other
