On the 8th day of August 1994, the South Burlington Zoning
Board of Adjustment heard evidence regarding the appeal of
Cynosure, Inc., 115 Kimball Avenue, based on the following
facts and findings:
1) There is unnecessary hardship due to the pre-existing
building and the flatness of the land.
2) Reasonable use of the property requires construction of
a tower to utilize gravitational force as a vital
element in the manufacturing process. This vertical
process makes a variance necessary.
3) The hardship is the size and unique infrastructure of
the pre-existing building, not created by the appellant.
4) This is an industrial use in an industrial zone, and the
tower will be blended into its surroundings by special
landscaping efforts. This is a good adaptive reuse for
the existing building and will not alter the essential
character of the neighborhood.
5) As stipulated the variance, at less than 1% of the
existing structure and set in the middle of 175 acres,
is a minimal one.
Based upon the above facts and findings the appellant's
request for a variance is hereby granted.
