HomeMy WebLinkAboutSD-09-44 - Decision - 0030 Community Drive#SD-09-44 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING TECHNOLOGY PARK PARTNERS - 113 KIMBALL AVENUE AND 10 COMMUNITY DRIVE FINAL PLAT APPLICATION #SD-09-44 FINDINGS OF FACT AND DECISION Technology Park Partners LLC, hereafter referred to as the applicant, is seeking final plat approval to amend a previously approved 15 lot subdivision. The amendment consists of adjusting the boundary lot lines of 113 Kimball Avenue and 10 Community Drive. The Development Review Board held a public hearing on October 20, 2009. Evan Meenan represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval to amend a previously approved 15 lot subdivision. The amendment consists of adjusting the boundary lot lines of 113 Kimball Avenue and 10 Community Drive. 2. The owner of record of the subject property is Technology Park Campus, LLC. 3. The application was received on September 23,2009. 4. The subject property is located in the I - C Zoning District. 5. The plan submitted is entitled "Boundary Line Adjustment Plat Technology Park Assoc. to City of South Burlington Kimball Avenue South Burlington, Vermont," prepared by Trudell Consulting Engineers, dated 11/10/2008. The proposal would result in the transfer of two small pieces of land to the City of South Burlington: a 232.9 square foot triangle on the east side of Community Drive (shown as Lot 8C) and a 199.1 square foot triangle on the west side of Community Drive (Lot 1). This land will be necessary in order to improve the turning radii at the Community Drive/Kimball Ave intersection. The Board is supportive of the application, but will require that the applicant update the survey plat for the entire property. The plan submitted depicts only a small area of the subject lots. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The plat plan shall be revised to show the changes below and shall require approval of the Administrative Officer. Four (4) copies of the approved revised plat plan shall be submitted to the Administrative Officer prior to recording. a. The subdivision plat (sheet 1 of 4) submitted as part of the previously approved subdivision plat #SD-07-65 shall be revised to show the boundary line adjustments. This plat shall include the seal and signature of the land surveyor. 4. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 5. The final plat plan shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator.
