Re: Findings of Fact, application of Pizzagalli Properties, LLC to amend a previously approved plan
for a 23,000 square foot general office building, 55 Joy Drive. The amendment consists of
constructing a vehicular access connection to the property to the west (35 Joy Drive).

On the day of June, 1999, the Director of Planning & Zoning (hereinafter Director) approved
the request of Pizzagalli Properties, LLC for site plan review under Section 26.10 of the South
Burlington Zoning Regulations based on the following findings:
1. This project consists of amending a previously approved plan for a 23,000 square foot general
office building, 55 Joy Drive. The amendment consists of creating a vehicular access connection to
the property to the west (35 Joy Drive).
2. The record owner of the property is Pizzagalli Properties, LLC.
3. This property is located at 55 Joy Drive and lies within the C2 District.
4. Access/circulatiom Approximately 625 square feet of green space will be paved in order to
provide a vehicular access connection to the property to the west (35 Joy Drive). The access
connection will be located along the north side of the property.
5. Coverage: Building coverage is 16.3% (maximum allowed is 30%). Overall coverage is 43%
(maximum allowed is 70%). Front yard coverage is 0.02% (maximum allowed is 30%).
6. Landscaping: No changes proposed.
7. Parking: No changes proposed.
8. Lighting: No changes proposed.

DECISION & CONDITIONS
Based on the above Findings of Fact, the Director approves the site plan application of Pizzagalli
Properties, LLC to amend a previously approved plan for a 23,000 square foot general office
building, 55 Joy Drive. The amendment consists of constructing a vehicular access connection to the
property to the west (35 Joy Drive) as depicted on a plan entitled, "55 Joy Drive, Proposed Office
Building, Site Plan," prepared by The Site Concern, Landscape Architects and dated 4/23/85, last
revised 6/7/99, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of
the zoning regulations or this approval is null and void.
3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer
prior to use of the access connection..
4. Any change to the site plan shall require approval by the South Burlington Planning Commission.
