HomeMy WebLinkAboutSP-11-30 - Decision - 0050 Joy Drive#SP-11-30 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING PIZZAGALLI PROPERTIES LLC 50 JOY DRIVE SITE PLAN APPLICATION #SP-11-30 FINDINGS OF FACT AND DECISION Pizzagalli Properties LLC, hereafter referred to as the applicant, is seeking site plan review to convert 15,000 sq. ft. of general office use to social services use and 5,000 sq. ft. to child care facility, licensed non-residential for 45 students, 50 Joy Drive. The Development Review Board held a public hearing on September 6, 2011. Bob Bouchard represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. Pizzagalli Properties LLC, hereafter referred to as the applicant, is seeking site plan review to convert 15,000 sq. ft. of general office use to social services use and 5,000 sq. ft. to child care facility, licensed non-residential for 45 students, 50 Joy Drive. 2. The application was received on July 25, 2011. 3. The owner of record of the subject property is Pizzagalli Properties LLC. 4. The subject property is located in the C1-R15 Zoning District. 5. The plan is entitled "Pizzagalli Properties LLC 50 Joy Drive South Burlington, Vermont 05403," prepared by Summit Engineering, dated July 22, 2011. While there are no physical changes to the site layout or transition proposed, the proposed shift in use results in increased parking demands and traffic generation. CADocuments and Settings\Mark C. Based on 20,000 square feet of general office, 70 parking spaces are required. Traffic generation at the PM peak is estimated at 29.8 vehicle trip ends. The proposed use of 15,000 SF of social service and 5,000 SF of child-care (with an enrollment capacity of 45 students and 14 staff members) use would require 79 parking spaces. 61 parking spaces are provided on site. This represents a 18 space or 23.1 % shortfall. The applicant has stated that they find the parking will be more than adequate on site. They have stated than 90% of their educational and child care clients use public and other means of transportation. The Board discussed request for a parking waiver along with the availability of additional land for additional parking should it be required, and decided that the parking is adequate. The applicant is proposing to add a 3,800 SF fenced -in play area near the southeast corner of the property. The Board has no concerns with this. The applicant has stated that there are no other changes to the site plan as a result in the proposed change of use. DECISION Motion by Joe Randazzo, seconded by Tim Barritt, to approve Site Plan Application #SP-11-30 of Pizzagalli Properties LLC subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The Board grants a parking waiver of 18 spaces or 23.1 %. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use and occupancy of the newly converted space. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. 2 CADocuments and Settings\Mark C.
