HomeMy WebLinkAboutSP-16-32 - Decision - 0050 Joy Drive#SP-16-32 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING LUND FAMILY CENTER -- 50 JOY DRIVE SITE PLAN APPLICATION #SP-16-32 FINDINGS OF FACT AND DECISION Lund Family Center, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 21,664 sq. ft. building consisting of 14,996 sq. ft. of social services use and 6,668 sq. ft. of child care facility use. The amendment consists of: 1) adding a 12' X 14' detached accessory structure, 2) adding a dumpster enclosure, and 3) expanding the outside play area, 50 Joy Drive Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 21,664 sq. ft. building consisting of 14,996 sq. ft. of social services use and 6,668 sq. ft. of child care facility use. The amendment consists of: 1) adding a 12' X 14' detached accessory structure, 2) adding a dumpster enclosure, and 3) expanding the outside play area, 50 Joy Drive 2. The owner of record of the subject property is Lund Family Center, Inc. 3. The subject property is located in the Commercial 1 — Residential 15 Zoning District. 4. The application was received on May 26, 2016. 5. The plan submitted is entitled, "Lund Family Building 50 Joy Drive South Burlington, Vermont 05403", prepared by Summit Engineering, Inc., and dated 4/29/16. DIMENSIONAL REQUIREMENTS 6. Building coverage is 11.3 %( 40% is maximum). Overall coverage is 50.7% (70% is maximum). Front yard coverage is 13.3% (maximum allowed is 30%). 7. Setback requirements are being met for the new detached accessory structure. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. - 1 — #SP-16-32 (c) Alf dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shaft be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), 8. A new screened dumpster enclosure is shown on the plan. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves Site Plan Application #SP-16-32 of Lund Family Center, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy or use of the site modifications. 5. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
