FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of Pizzagalli Properties, LLC to construct an 8,664 square foot medical
office building on a 2 acre lot, 35 Joy Drive.
On the 27'a' day of April, 1999, the South Burlington Planning Commission approved the request of Pizzagalli
Properties, LLC for site plan review under Section 26.10 of the South Burlington Zoning Regulations based
on the following findings:
1. This project consists of constructing an 8,664 square foot medical office building on a 2 acre lot.
2. The owner of record of this particular property is Pizzagalli Development Company.
3. This properth located at 35 Joy Drive lies within the C2 District. It is bounded on the north by Rice High
School, on the cast by an office building, on the south by Joy Drive, and on the west by indoor recreation/day
care center.
4. Access/circulation: Access is to be provided by a 24 foot curb cut on Joy Drive and an access drive to the
property to the cast. The site plan for the property to the east will have to be amended to incorporate this
connection.
Circulation on the site is acceptable.
5. Coverage/setbacks: Building coverage is 9.9% (maximum allowed is 30%). Overall coverage is 42.6%
(maximum allowed is 70%). Front yard coverage is 7.0% (maximum allowed is 30%).
Setback requirements arc met.
6. Parking: A total of 44 parking spaces arc required and 52 spaces including six (6) handicapped spaces and
a bike rack are being provided. The note on sheet I regarding parking should be revised to note the correct
number of spaces required.
7. Landscaping: The minimum landscaping requirement, based on building costs, is $16,500 which is being
met. Plantings will include Serviceberry, Sugar Maple, Ash, Burning Brush, Coral Berry, Yew and Spruce.
The landscaping plan should be revised to show the landscaping around the dumpster as shown on the site plan.
8. Sewer: The sewer allocation requested is 9045 gpd. The applicant will be required to pay the per gallon
fee prior to permit issuance. There is currently no reserve capacity available at the Bartlett Bay Wastewater
Treatment Facility. The approved allocation will be placed on a waiting list until such time as capacity is
available. Staff recommended a condition that a Certificate of Occupancy/Compliance not be issued until the
sewer capacity is available.
9. Traffic: ITE estimates that this facility will generate 31.96 vehicle trip ends (vte's) during the P.M. peak
hour. The applicant has submitted a trip generation estimate of 17 vte's during the P.M. peak hour. The
applicants estimate is based on a specific tenant with certain trip generation characteristics. Since this
building could be changed to another medical office tenant without site plan review, staff recommended that
the ITE trip estimate be used for this building. The applicant was made aware that the traffic impact fee is
approximately $6600.
10. Sidewalk: The applicant will be constructing a sidewalk along the property's frontage.
11. Lighting: Exterior lighting consists of the following:
— seven (7) 175 watt metal halide lamps with downcasting shielded fixtures mounted on 18 foot poles.
12. Dumpster: A screened dumpster storage area is provided.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan
application of Pizzagalli Properties, LLC to construct an 8,664 square foot medical office building on a 2 acre
lot, 35 Joy Drive, as depicted on a three (3) page set of plans, page one (1) entitled, "Renal Dialysis Center Lot
#3 Broadcast Park 35 Joy Drive South Burlington, Vermont," prepared by Donald L. Hamlin Consulting
Engineers, dated 3/23/99, last revised on 4/15/99, with the following stipulations:
1) All previous approvals and stipulations which arc not superseded by this approval shall remain in effect.
2) The plans shall be revised to show the changes below and shall require approval of the Director of
Planning & Zoning. Three (3) copies of the approved revised plans shall be submitted to the Director of
Planning & Zoning prior to issuance.
a) The site plan shall be revised to amend the note on sheet 1 regarding parking to note the correct
number of spaces required.
b) The landscape plan shall be revised to show the landscaping around the dumpster as shown on the
site plan.
c) The site plan shall be revised to intercept the runoff from the northerly part of the lot and pipe it into
the Joy Drive storm system in a method approved the City Engineer.
d) The site plan shall show the sidewalk extending across the proposed driveway in a manner
acceptable to the City Engineer.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the
Planning Commission estimates that the medical office will generate 31.96 vehicle trip ends during the P.M.
peak hour.

4. All exterior lighting shall consists of downcasting shielded fixtures. Any change to approved lights shall
require approval of the Director of Planning & Zoning prior to installation.
5. Prior to issuance of a zoning permit, the applicant shall post a $16,500 landscape bond. The bond shall
remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving.
6. The Planning Commission approves a sewer allocation of 9045 gpd (includes 20% reduction allowed by
State). The applicant shall be required to pay the per gallon fee prior to permit issuance. There is currently
no sewer allocation available at the Bartlett Bay Wastewater Treatment Facility. The allocation granted shall
be placed on a waiting list until such time as the allocation is available. No Certificate of
Occupancy/Compliance: will be issued and the building can not be occupied until such time as sewer capacity
is available.
7. Prior to permit issuance, the applicant shall post a bond to cover the cost of the sidewalk. The sidewalk
shall be constructed in a location approved by the Director of Public Works and completed prior to the issuance
of a Certificate of Occupancy/Compliance.
8. The building shall be sprinklered.
9. The site plan for the property at 55 Joy Drive shall be amended prior to the construction of the access drive
connection between the properties at 35 and 55 Joy Drive.
10. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 ofthe zoning
regulations or this approval is null and void.
11. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior
to the use of the building.
12. Any change to the site plan shall require approval by the South Burlington Planning Commission.
