HomeMy WebLinkAboutSD-99-28 - Supplemental - 0035 0055 Joy DrivePUBLIC NOTICE In accordance with Chapter 221 of Title 18, V.S.A., Bio-Medical Applications of New Hampshire, Inc. and Fresenius Medical Care -North America are seeking a Certificate of Need to acquire outpatient dialysis facilities from Fletcher Allen Health Care, Inc. located in South Burlington, Newport, Rutland, St. Albans and Berlin, Vermont. The total proposed capital expenditure for this application is $28,633,873, including $26,000,000 for the purchase of the assets of five outpatient renal dialysis clinics along with a home dialysis program based in South Burlington. Competing application(s) and/or petition(s) to intervene must be submitted in writing to the Division of Health Care Administration of the Department of Banking, Insurance, Securities and Health Care Administration at the address below on or before July 14, 2011. Another opportunity to seek competing application status will also be provided later in the CON review process when the application is found complete by the Department of Banking, Insurance, Securities and Health Care Administration. PLANNING COMMISSION 8 JUNE 1999 The South Burlington Planning Commission held a regular meeting on Tuesday, 8 June 1999, at 7:30 p.m., in the conference room, City Hall, 575 Dorset Street. Other Business: Mr. Weith advised that the Regional Planning Commission will be presenting the proposed update of the Regional Plan to the City Council at its 21 June meeting. 2. Review Minutes of 25 May 1999: Ms. Quimby moved that the Minutes of 25 May be approved as written. Mr. Beaudin seconded. Motion passed. 3. Report on recent site plan decisions issued by the Director of Planning and Zoning: a) Site plan application of HCA Aircraft Services to amend a previously approved plan for a 28,600 sq. ft. building with 2500 sq. ft. of general office use, 3000 sq. ft. of warehouse use and 23,100 sq. ft. of airport related uses, 1150 Airport Drive. The amendment consists of converting 3700 sq. ft. of airport related uses to light manufacturing use. APPROVED. The Chair asked if there was anyone on the Commission or in the audience who wished to comment on these actions. No comments were offered 4. Public Hearing: Final Plat Application of Pizzagalli Properties, LLC for reapproval of two lot subdivision on Joy Drive originally approved on 10/9/79. The application involves subdivision of 4.04 acres of land into two lots 2.02 acres each. The applicant failed to get the original plat signed by the Planning Commission within the required 90 day time limit: Mr. Bouchard explained they are now developing the remaining parcel, and this oversight was brought to their attention. PLANNING COMMISSION 8 JUNE 1998 Mr. Weith said there are no changes from the original application. Mr. O'Rourke moved the Planning Commission approve the final plat application of Pizzagalli Properties, LLC, for the reapproval of a plat originally approved on 10/10/79 for a subdivision of 4.04 acres of land into two (2) parcels of 2.02 acres each, as depicted on a plan entitled "Broadcast Park, Joy Drive, South Burlington, Vermont," prepared by Palmer Company, LTD, dated June 21, 1979, last revised 6/28/79. This approval is to officially approve the plat recorded in map volume 153, page 66 of the South Burlington Land Records, subject to the following stipulation: 1. Public Hearing: Final Plat application of Homestead Design, Inc, to amend a planned residential development consisting of 244 residential units and an 18-hole golf course, Dorset Street. The amendment consists of revising the plat for the footprint lots along Golf Course Road by providing survey tie lines for the next phase of development (units 112-114 and 140 and 141). Mr. O'Rourke stepped down during this hearing due to a conflict of interest. Mr. Burgess noted that a unanimous decision would be required since one member was absent and another had stepped down. Mr. Marcellino said when the Commission had approved the units, the applicant had asked for flexibility in order to preserve trees, etc. They had agreed to come back once the units were built. Ms. Quimby expressed concern that the rec path was not shown on the plans. Mr. Weith said the plat shows the bike path easement on this property and it has been moved. Mr. Marcellino said the approval was for the bike path to be sited off the lots with an as -built survey, but it was to be kept on the plan until then. Mr. Weith suggested a stipulation that the bike path easement be removed from the plat prior to recording if it is found that the Planning Commission has approved another location. Mr. Taber asked if this application is relative to work which is now happening on Dorset St. Mr. Marcellino said it is not. Access for both lots is via a single curb cut. On site sewer and municipal water are in place for both residences. Both lots meet the area and dimensional requirements of the R-1 district; however, the farmhouse does not conform to the 75' front yard setback; the other house has a non -conforming side yard which can be resolved by adding a slight jog to the intervening property line. The Comprehensive Plan shows a proposed east -west street in the vicinity of this proposal. It appears that this road could be routed close to the southern boundary of lot #2, although this should be confirmed in the field. ,'#3 Vermont Broadcasting Treliminary Plat All is in order. #4 Sears Rent - A - Car This proposal is to convert a former residence into an automobile rental business. He also said that putting such a right of way through the 43 acres would divide the land and mentioned that some of the land was very Wei Mr. Poger felt that if access to Van Sicklen were not possible, the best thin would be one access to Route 116 for the three lots with a shared right of way. He said the lot was 60' z 158'. They will screen between the Interstate fence and the parking lot with trees, and there will also be a burm between the present and proposed parking areas with trees. Mr. Farrell said that there was a required setback from the Interstate of 150' from the right of way, but that it is just a ramp which is near this lot. They will be within 35' of the fence with this lot but they are probably 300' from the main Interstate itself, he said, and about 85-90' from the ramp itself. Mr. Page, who attended the Zoning Board hearing, said the Board felt the setback from the ramp was like a setback from a major road. Kr. Mona said it was clear to him that the Zoning Board had been in possession of all the facts when it made its decision. Mr. Woolery felt it was very important that the trees be evergreen, so they would provide year-round screening and he suggested arborvitae. Yrs. Bailey said she realized that it was after the fact, but she questioned how many variances to the C:) district the city was going to give. N.r. roger replii that the Zoning Board had already given the variance and he noted that it was an administrative decision as to whether the CO zone refers to the main road or to the ramps also. This variance, as you may re- call, is from the 150' C-0 District along the Interstate, where there is an odd bulge in the right of way. I recommend the Commission endorse this proposal before the Zoning Board. #4 (Vermont Broadcasting: Sketch Plan for 2 lot subdivision The division of a 4 acre parcel into 2 equal lots is proposed. There is adequate frontage, and sewer, water, and storm drainage are in place in Joy Drive. Improvements to the road are being made in the area of this proposed subdivision and another is expected to commence very soon in the vicinity of the intersection of Cheesefactory Road, these improvements will encourage high speed travel in this vicinity. Road openings on to Hinesburg Road should be discouraged. It would be my preference to see a road constructed from Van Sicklen Road to serve this subdivision. Re: Broadcast Park Two lot subdivision, Joy Drive - No comments Kennedy_Lane_Apartments, _Kennedy Drive 1. Considerable fill will be required alongthe west side of building #2. This filling will extend over the drainage way. 2. It appears a minor drainage way will be obstructed by the north end of building #1. 3. The water main on Kennedy Drive must be extended along the entire frontage of this development. Plans must also be reviewed by City Water Department. 4.
