In accordance with Chapter 221 of Title 18, V.S.A., Bio-Medical Applications of New
Hampshire, Inc. and Fresenius Medical Care -North America are seeking a Certificate of
Need to acquire outpatient dialysis facilities from Fletcher Allen Health Care, Inc. located
in South Burlington, Newport, Rutland, St. Albans and Berlin, Vermont. The total
proposed capital expenditure for this application is $28,633,873, including $26,000,000
for the purchase of the assets of five outpatient renal dialysis clinics along with a home
dialysis program based in South Burlington.
Competing application(s) and/or petition(s) to intervene must be submitted in writing to
the Division of Health Care Administration of the Department of Banking, Insurance,
Securities and Health Care Administration at the address below on or before July 14,
2011. Another opportunity to seek competing application status will also be provided
later in the CON review process when the application is found complete by the
Department of Banking, Insurance, Securities and Health Care Administration.

by Palmer Company, LTD, dated June 21, 1979, last revised June 28, 1979 (the "Plat"), which approval was not
appealed and became final; and
WHEREAS, said Plat was originally approved by the South Burlington Planning Commission on October
10, 1979 and recorded on December 21, 1979 in Volume 153 at Page 66 of the City of South Burlington Land
Records; and
WHEREAS, said Plat was not signed and/or otherwise endorsed by the City of South Burlington Planning
Commission at or prior to the date of its recording; and
WHEREAS, all of the lots depicted on said Plat have since been conveyed to Pizzagalli Properties, LLC, and
Joy Drive, also depicted thereon, has been dedicated to and accepted by the City of South Burlington as a public street;
and
WHEREAS, Section 508 of the City of South Burlington Subdivision Regulations and 24 V.S.A. §4416
require that an approved plat be endorsed in writing on such plat, and recorded in the office of the City Clerk within 90
days of such approval; and
WHEREAS, the current owner of lot 3 in the above -referenced subdivision has requested that this
Commission re -approve the above -described Plat in a legally sufficient manner; and
WHEREAS, the City of South Burlington Planning Commission having granted final plat approval relative to
said subdivision and the related plat, and the same having been previously recorded in the Land Records of the City of
South Burlington, wishes by the adoption and recording of this Notice to reaffirm and confirm said approval.
NOW THEREFORE NOTICE IS HEREBY GIVEN that: (i) the Plat as recorded December 21, 1979 shall
be deemed to have been stamped and endorsed by the South Burlington Planning Commission as required by and so as
to satisfy the requirements of section 508 of the City of South Burlington Subdivision Regulations and 24 V.S.A.
§4416, and (ii) the lots depicted on said Plat have been and shall continue to be subject to all of the conditions and
restrictions contained in the October 10, 1979 final plat approval which conditions and restrictions shall run with said
land and be binding upon the current owners thereof and their respective successors, heirs, and assigns, unless and
until modified or removed by the South Burlington Planning Commission.

I move the South Burlington Planning Commission approve the final plat application of Pizzagalli
Properties, LLC for the reapproval of a plat originally approved on 10/10/79 for a subdivision of
4.04 acres of land into two (2) parcels of 2.02 acres each, as depicted on a plat entitled
"Broadcast Park, Joy Drive, South Burlington, Vermont," prepared by Palmer Company, LTD,
dated June 21, 1979, last revised 6/28/79. This approval is to officially approve the plat recorded
in map volume 153, page 66 of the South Burlington Land Records, subject to the following
stipulation:
1. The Chair or Clerk of the Planning Commission shall stamp and sign the plat recorded in map
volume 153, page 66 of the South Burlington Land Records within 90 days or this approval is null
and void. Prior to the Chair or Clerk of the Planning Commission stamping and signing the
recorded plat, a legal document shall be recorded which explains the Planning Commission's
action regarding this approval. This legal document shall be approved by the City Attorney prior
to recording.
PLANNING COMMISSION 8 JUNE 1999
The South Burlington Planning Commission held a regular meeting on Tuesday, 8 June 1999, at 7:30
p.m., in the conference room, City Hall, 575 Dorset Street.

1. Other Business:
Mr. Weith advised that the Regional Planning Commission will be presenting the proposed update
of the Regional Plan to the City Council at its 21 June meeting.
2. Review Minutes of 25 May 1999:
Ms. Quimby moved that the Minutes of 25 May be approved as written. Mr. Beaudin seconded.
Motion passed.
3. Report on recent site plan decisions issued by the Director of Planning and Zoning:
a) Site plan application of HCA Aircraft Services to amend a previously approved plan for
a 28,600 sq. ft. building with 2500 sq. ft. of general office use, 3000 sq. ft. of warehouse
use and 23,100 sq. ft. of airport related uses, 1150 Airport Drive. The amendment consists
of converting 3700 sq. ft. of airport related uses to light manufacturing use. APPROVED.
The Chair asked if there was anyone on the Commission or in the audience who wished to comment
on these actions. No comments were offered
4. Public Hearing: Final Plat Application of Pizzagalli Properties, LLC for reapproval of two lot
subdivision on Joy Drive originally approved on 10/9/79. The application involves subdivision of
4.04 acres of land into two lots 2.02 acres each. The applicant failed to get the original plat signed
by the Planning Commission within the required 90 day time limit:
Mr. Bouchard explained they are now developing the remaining parcel, and this oversight was
brought to their attention.

Mr. O'Rourke moved the Planning Commission approve the final plat application of Pizzagalli
Properties, LLC, for the reapproval of a plat originally approved on 10/10/79 for a subdivision of

Park, Joy Drive, South Burlington, Vermont," prepared by Palmer Company, LTD, dated June 21,
1979, last revised 6/28/79. This approval is to officially approve the plat recorded in map volume
153, page 66 of the South Burlington Land Records, subject to the following stipulation:

Ms. Quimby seconded the motion which was then approved unanimously.
5. Public Hearing: Final Plat application of Homestead Design, Inc, to amend a planned residential
development consisting of 244 residential units and an 18-hole golf course, Dorset Street. The
amendment consists of revising the plat for the footprint lots along Golf Course Road by providing
survey tie lines for the next phase of development (units 112-114 and 140 and 141).
Mr. O'Rourke stepped down during this hearing due to a conflict of interest.
Mr. Burgess noted that a unanimous decision would be required since one member was absent and
another had stepped down.
Mr. Marcellino said when the Commission had approved the units, the applicant had asked for
flexibility in order to preserve trees, etc. They had agreed to come back once the units were built.
Ms. Quimby expressed concern that the rec path was not shown on the plans. Mr. Weith said the plat
shows the bike path easement on this property and it has been moved. Mr. Marcellino said the
approval was for the bike path to be sited off the lots with an as -built survey, but it was to be kept
on the plan until then. Mr. Weith suggested a stipulation that the bike path easement be removed
from the plat prior to recording if it is found that the Planning Commission has approved another
location.
Mr. Taber asked if this application is relative to work which is now happening on Dorset St. Mr.
Marcellino said it is not.

Enclosed are the Findings of Fact and Decision for the following site plan application:

This project consists of the reapproval of a two (2) lot subdivision plat approved on 10/9/79 (minutes
enclosed). The approved plat was not signed by the Commission within the 90 days mandated by
State Statutes. The purpose of this application is to legitimize the recorded plat to cure any question
regarding the lawful existence of those lots within the subdivision that have the same boundaries as
shown on the 1979 plat.
Once this plat is approved, the Chairman should sign and stamp the recorded plat and a legal
document should be recorded which describes the Commission's action.
5) HOMESTEAD DESIGN INC. - FOOTPRINT LOTS PHASE II - REVISED FINAL
PLAT
This project consists of amending a planned residential development consisting of 244 residential units
and an 18 hole golf course. The amendment consists of revising the plat for the footprint lots along
Golf Course Road approved on 11 /24/98 (minutes enclosed) by providing survey tie lines for the next

PUBLIC HEARING
SOUTH BURLINGTON PLANNING COMMISSION
The South Burlington Planning Commission will hold a public hearing at the South Burlington City Hall,
Conference Room, 575 Dorset Street, South Burlington, Vermont on Tuesday, June 8, 1999, at 7:30
P.M. to consider the following:
1) Final plat application of Homestead Design, Inc. to amend a planned residential development
consisting of 244 residential units and an 18 hole golf course, Dorset Street. The amendment consists
of revising the plat for the footprint lots along Golf Course Road by providing survey tie lines for the
next phase of development (units 112 - 114 and 140 and 141).
2) Final plat application of Edgar Welch to amend a planned unit development on a 1.7 acre parcel
consisting of. 1) a 12,900 square foot building used for equipment rental use, 2) a 1,800 square foot
building used for retail use, and 3) 3,600 square foot accessory structure, 340 Dorset Street. The
amendment consists of: 1) converting the 12,900 square foot equipment rental building to retail use, 2)
reducing the size of the accessory building to 1800 square feet, and 3) adding one residential unit to the
second floor of the main building.
3) Final plat application of Pizzagalli Properties, LLC for reapproval of a two (2) lot subdivision on Joy
Drive originally approved on 10/9/79. The application involves subdivision of 4.04 acres of land into two
(2) lots 2.02 acres each. The applicant failed to get the original plat signed by the Planning Commission
within the required 90 day time limit.

— the City has not been properly interpreting Section 6.601 of the zoning regulations in regards
to the golf course project. Up until now, we have been treating this development as a PRD
consisting of 244 residential units and an 18 hole golf course. We have been including the
entire 405 acres in the calculations for allowable residential density. 450 acres yields a
maximum density of 540 units (450 acres x 1.2 units/acre), 244 units have been approved to
date. Based on the recent opinion from the City Attorney regarding interpretation of Section
6.601, we should separate out the land devoted to the golf course use and then multiply the
remaining acreage devoted to residential use by the maximum residential density. This
method yields a maximum allowable residential density of 198 units (165.2 acres x 1.2
units/acre). Again, we have approve 244 units. The Commission is considering a zoning
amendment to allow those nonresidential uses that are currently allowed in the SEQ zoning
district to be part of a PRD. This would allow the City to base the maximum density on the
entire golf course property. Until such time as this amendment is effective, the Commission
could not approve additional density proposed by this project.

#2 Business Park North Resubdivision
There are no substantive issues to be resolved, and no changes to the plan
since you last saw it.
t:5 Spafford Subdivision (now called "Brookwood")
The plan has been revised to satisfy the conditions of preliminary plat
approval, a draft of the convenants has been approved by Dick Spokes which
will preserve the important concept of building envelopes. I have a list of
minor modifications which pertain to the legal do cuments and can be in-
corporated into a motion of approval.
#4 Vermont Broadcasting Subdivision
All is O.K.
#5 Nowland Subdivision
I suggest the final plat carry the notation, "Reserved for Future City Street",
immediately south of lot #2, to make it perfectly clear to the lot buyer where
access to the balance of the land should be located, and where the potential east -west
street may go.
#6 1 lot subdivision at 162 East Terrace
The division of a 1 + acre lot, is proposed to create a.6 acre lot with an existing
dwelling on it, and a .4 acre lot (large enough for a duplex). All City services
are at the site. The existing dwelling should be plotted on the plan to insure that
the new dividing line does not create any non -conforming situations.
#7 Site Plan Review. Plvwood Ranch
The applicant has agreed to improve screening and revise landscaping. The re-
visions to the plan will be presented at the meeting.
#8 Site Plan Review for former Lake Champlain Motors building
The building's owners wish to obtain site plan approval for revisions to existing
access, parking, and circulation, to serve a future tenant who is as yet un-
determined. I assume this is'being done to improve the marketability' of the proposal.
Access is substantially improved, through the closing of two old curb cuts on Allen
Road, and the installation of a new one farther away from Shelburne Road. Parking is
being increased to a total of 42 spaces; circulation is sufficient, although I
question the :advisiibiifty of the dead end service road to the north of the building.
Also, the grading plan doesn't make it clear whether or not fill or surface water
will be diverted fiD the adjoining property to the north. In any event, there should
be a site plan review of this property when a particular client has been found.

felt that placement of the accesses to the lots would depend on what business
went on them. There is a hill and a curve in the road near these lots, and the
accesses should be placed where sight -distance is best; probably to the east of
the lots. The placement of the curb cut can be decided at site -plan review and
it was noted that the commission would probably look most favorably on access to
lot 3 at the crest of the hill, although that could change if conditions changed.

#2 Nowland Sketch Plan
A 2 lot minor subdivision is proposed to enable the owners to sell off
the existing farm house and barns, and what was formerly the hired hand's
residence, from the balance of the farm acreage on the east side of Spear
Street (see attached map).
Access for both lots is via a single curb cut. On site sewer and municipal
water are in place for both residences. Both lots meet the area and dimensional
requirements of the R-1 district; however, the farmhouse does not conform to the
75' front yard setback; the other house has a non -conforming side yard which can
be resolved by adding a slight jog to the intervening property line.
The Comprehensive Plan shows a proposed east -west street in the vicinity
of this proposal. It appears that this road could be routed close to the southern
boundary of lot #2, although this should be confirmed in the field.
,'#3 Vermont Broadcasting Treliminary Plat
All is in order.
#4 Sears Rent - A - Car
This proposal is to convert a former residence into an automobile rental
business. The total project cost is $2000, which is split between interior
renovations to the house and gravel for the parking area. This project re-
ceived conditional use approval from the City Council last July.
Access, off Hough Street, is good. Saving the existing trees and
shrubs will more than suffice for adequate landscaping. Circulation and parking
need improvement. Fencing or screening should be installed as a buffer for the
residence to the east.
#5 Schools - Draft Chapter Outline will be prepared in time for the meeting.

said they would like to see fewer cuts, and it was suggested that lot 3 have asses:
to Van Sicklen Road. Access via a road constructed on the east line of the 3
small lots to Van Sicklen was discussed and Mr. Woolery mentioned that when the
remaining 43 acres behind those three lots were developed, such a road on the
east line might be necesary anyway. Mr. Wick, a lawyer for Dr. French, said that
constructing such a road to Van Sicklen might be very hard because of the
topography of the land. He also said that putting such a right of way through
the 43 acres would divide the land and mentioned that some of the land was very Wei
Mr. Poger felt that if access to Van Sicklen were not possible, the best thin
would be one access to Route 116 for the three lots with a shared right of way.
Xr. Mona did not like to have any cuts on 116 but P's. Noolery felt 1 was better
than 3. Mr. Poger said the Planner and Commission could look at the site when
they came back for subdivision approval. He also mentioned that perhaps a
temporary access to 116 could be given and when the rest of the land was subdivides
access could be via Van Sicklen.

Nir. Alan Palmer said this was the last land on Joy Drive. It is 4.4 acres
and will be divided into 2 2.2 acre parcels. Access to both lots will be off
Joy Drive. Mr. Page said the drive curved at that point, so access should be
where sight distance is best. He noted that Joy Drive was not a through street
and carried very little traffic. The Commission briefly discussed possible
access locations.

The Commission noted that it had received memos from the City Engine er/Managez
and the Natural Resources Committee, both dated August 9, regarding this property
(see attached copies).
Mr. Gary Farrell said that they had received a variance from the Zoning
Board for the construction of the parking lot within the Interstate setback and
that site plan approval was necessary. He said the lot was 60' z 158'. They
will screen between the Interstate fence and the parking lot with trees, and
there will also be a burm between the present and proposed parking areas with
trees.
Mr. Farrell said that there was a required setback from the Interstate of
150' from the right of way, but that it is just a ramp which is near this lot.
They will be within 35' of the fence with this lot but they are probably 300' from
the main Interstate itself, he said, and about 85-90' from the ramp itself.
Mr. Page, who attended the Zoning Board hearing, said the Board felt the setback
from the ramp was like a setback from a major road. Kr. Mona said it was clear
to him that the Zoning Board had been in possession of all the facts when it made
its decision.
Mr. Woolery felt it was very important that the trees be evergreen, so they
would provide year-round screening and he suggested arborvitae.
Yrs. Bailey said she realized that it was after the fact, but she questioned
how many variances to the C:) district the city was going to give. N.r. roger replii
that the Zoning Board had already given the variance and he noted that it was an
administrative decision as to whether the CO zone refers to the main road or to
the ramps also.

#3 Continuation of Public Hearing on Twin Oaks Condominiums
This hearing should be tabled until August 28, because the
layout changes suggested by the Commission on this plan depend on
a variance being granted by the ZBA. This variance, as you may re-
call, is from the 150' C-0 District along the Interstate, where there
is an odd bulge in the right of way. I recommend the Commission
endorse this proposal before the Zoning Board.
#4 (Vermont Broadcasting: Sketch Plan for 2 lot subdivision
The division of a 4 acre parcel into 2 equal lots is proposed.
There is adequate frontage, and sewer, water, and storm drainage are
in place in Joy Drive. My only concern is that the access for the
westerly lot (#3) be located towards the proposed dividing line, where
sight distances are better.

Dr. French Subdivision
Hinesburg Road has a high volume of heavy truck traffic. It
has a posted speed limit of 55 M.P.H. Improvements to the road are
being made in the area of this proposed subdivision and another is
expected to commence very soon in the vicinity of the intersection
of Cheesefactory Road, these improvements will encourage high speed
travel in this vicinity. Road openings on to Hinesburg Road should
be discouraged. It would be my preference to see a road constructed
from Van Sicklen Road to serve this subdivision.

Kennedy_Lane_Apartments, _Kennedy Drive
1. Considerable fill will be required alongthe west side of
building #2. This filling will extend over the drainage way.
2. It appears a minor drainage way will be obstructed by
the north end of building #1.
3. The water main on Kennedy Drive must be extended along the
entire frontage of this development. Plans must also be reviewed
by City Water Department.
4. The angle of approach may make it difficult to maneuver
into the parking space adjacent to building #1, this should be
checked.

Dear Doug:
Your request to construct a passageway between two office
complexes located at 35-55 Joy Drive was discussed with the
City Attorney. My concern was whether the passageway was
classified as a structure and if so is the fact that both lots
are under one ownership relevant.
It is the opinion of the City Attorney that for Planning and
Zoning purposes the lots are merged as one. Therefore no
dimensional variance is necessary.
You may have a problem in the future should you decide to sell
off a building. At that time the passageway would have to be
removed, or you would then require a variance.
I understand that you have already received site plan approval
from the Planning Commission subject to approval by the zoning
Board of Adjustment. The appeal before. the Zoning Board is no
longer an issue. Upon compliance with the conditions set forth
by the Planning Commission, this office will issue a zonigg permit.
