Re: Findings of Fact, application of Mt. Mansfield Television, Inc. to amend a
previously approved site plan for a 13,090 square foot general office (television
studio) . The amendment consists of: 1) erecting a 100 foot high tapered steel
monopole to support antennas with a total height of 110 feet, and 2) construct a 200
square foot equipment building, 30 Joy Drive.
On the 12th day of August, 1997, the South Burlington Planning Commission
approved the request of Mt. Mansfield Television, Inc. for site plan review under
Section 26.10 of the South Burlington Zoning Regulations based on the following
findings:
1. This project consists of amending a previously approved site plan for a 13,090
square foot general office (television studio). The amendment consists of: 1)
erecting a 100 foot high tapered steel monopole to support antennas with a total
height of 110 feet, and 2) construct a 200 square foot equipment building. A
conditional use permit was obtained from the ZBA on 7/28/97 for the monopole. The
last review of this property by the Planning Commission was on 11 / 12 / 96 .
2. This property at 30 Joy Drive is located in the C2 and C.O. Districts. It is
bounded on the north by Joy Drive, the west by a health club and office building,
on the east by an office building, and on the south by I-189.
3. Access/circulation: Access is provided by a 24 foot curb cut and a 15 foot curb
cut, both on Joy Drive. No changes proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 9.8% (maximum allowed is 30 0) .
Overall coverage is 34.8% (maximum allowed is 70%) . Front yard coverage is 10. 9 0
(maximum allowed is 30%) .
5. Setback requirements are met for the proposed monopole and equipment building.
The existing office building and garage are noncomplying structures subject to the
limitations of Section 26.002 of the zoning regulations because both buildings are
partially located in the CO District.
6. Parking: A total of 53 parking spaces are required and 88 spaces including four
(4) handicapped spaces are provided.
7. Landscaping: The minimum landscaping requirement, based on building costs,
is $1950 which is being met. Proposed plantings include White Pine trees which will
be planted in the C . O. District along the interstate and west of the newly expanded
parking area.
8. Lighting: Proposed new exterior lighting will consist of one (1) 70 watt high
pressure sodium light with a downcasting shielded fixture.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the site plan application of Mt. Mansfield Television, Inc. to amend a
previously approved site plan for a 13,090 square foot general office (television
studio) . The amendment consists of: 1) erecting a 100 foot high tapered steel
monopole to support antennas with a total height of 110 feet, and 2) construct a 200
square foot equipment building, 30 Joy Drive, as depicted on a three (3) page set
of plans, page one (1) entitled, "WCAX Parking Lot Expansion Joy Drive South
Burlington, VT," prepared by Freeman French Freeman, Architects, last revised
8 / 7 / 97 , with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. For the purpose of calculating road impact fees under the South Burlington
Impact Fee Ordinance, the Planning Commission estimates that the monopole and
equipment building will generate zero (0) additional vehicle trip ends during the
P.M. peak hour.
3. Any new exterior lighting or changes to existing exterior lighting shall consist
of downcasting shielded fixtures. Any change to existing lights shall require
approval of the City Planner prior to installation.
4. Prior to issuance of a zoning permit, the applicant shall post a $1950 landscape
bond. The bond shall remain in effect for three (3) years to assure that the
landscaping takes root and has a good chance of surviving.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the monopole and equipment building.
7. Any changes to the site plan shall require approval by the South Burlington
Planning Commission.
