Consent Agenda: Application #MS-02-07 of Kenneth Horsemen seeking approval for Section 26.05, Conditional Uses, and Section 25.118, Exceptions to Yard Setback and Lot Coverage Requirements, of the South Burlington Zoning Regulations. Request is for permission to allow a roof over existing steps and entry to encroach into the required front yard setback by four feet, 8 Jonathan Avenue: No issues were raised. Mr. Cameron moved to approve the consent agenda subject to the stipulations in the Director=s memorandum. Mr. Farley seconded. Motion passed unanimously. 3.Public Hearing: Appeal #AO-02-03 of Tim McLaughlin & Terry Wixson appealing the decision of the Administrative Officer that a tattoo and body -piercing parlor is a personal service as the term is defined in the South Burlington Zoning Regulations: Mr. Belair said after consulting with the City Attorney, he determined that a tattoo parlor was a Apersonal service@ as defined in the Zoning Regulations. Neighbors of the proposed location have appealed this. Mr. Belair then read the Apersonal service@ definition from the regulations. It includes uses such as barber shops, beauty parlors, shoe repair, etc. Mr. McLaughlin said his home borders on the proposed business. He cited later, longer hours of the business and felt it was not appropriate for the neighborhood. AND MISCELLANEOUS USE, 8 JONATHAN AVENUE This project consists of allowing a roof over existing steps and entry to encroach into the required front yard setback by four (4) feet, 8 Jonathan Avenue. This project was last reviewed on August 7, 2001 (minutes enclosed). The approval lapsed. This property is located in the Residential Four District. The property is bounded on the west by Jonathan Avenue, on the south by a residence, on the east by a residence, and on the north by a residence. Criteria of Section 25.118 (c): This section provides for encroachment of a structure to within five feet from the front property line provided the encroachment will not have an undue adverse effect on: (i) views of adjoining and/or nearby properties (ii) access to sunlight of adjoining and/or nearby properties (iii) adequate on -site parking; and (iv) safety of adjoining and/or nearby properties There are currently front steps protruding from the front fagade of the property four (4) feet into the front yard setback. The applicant has proposed erecting a gabled roof over these stairs that will not increase the overall degree of encroachment. The majority of the structures along Jonathan Avenue have the same front yard setback as the Horseman house or less. It is staffs opinion that no adverse effect will result from the proposed roof. Mr. Belair noted this is an existing apartment that was approved as a variance with the stipulation that when the property sold the apartment had to go away. The only way to do this is to have it be an accessory unit, but the unit is more than 30% of the square footage of the house (if the garage is not included in the calculation.) Mr. Baily said the apartment is 40 sq. ft. over what is allowed. They will be subtracting some of that for an access. Members said the applicants should work this out with staff. Mr. Belair noted this will have to happen within 6 months. Mr. Farley moved the Board approve application #CU-01-28 of Keith Bailey and Tatum Brackett subject to the stipulations in the draft motion of 7 August 2001. Mr. Cameron seconded. Motion passed unanimously. 8. Public Hearing: Final Plat Application #SD-01-39 of Gardner & Son Development Corp. to amend a previously approved 11 unit planned residential development. The amendment consists of revising the landscaping plan, East Birch Lane: Ms. Gardner said some plants were hard to get and they were able to save some spruce and cedars. The major change is that the plan called for a dumpster in front of unit 91. They have changed to private pickup so there will be no dumpster. They also did some landscaping around some units. It was noted that the city arborist suggested moving the lilacs and spirea back from the sidewalk. Mr. Cameron moved that the Board approve Final Plat Application #SD-01-39 of Gardner & Son Development Corp. subject to the stipulations in the draft motion dated 7 August 2001. Ms. Quimby seconded.
