Re: Findings of Fact, application of Bernard and Nancy Barone, and Gail Wyand and
Mary Grunvald for a boundary line adjustment involving 3,730 square feet of land
resulting in two (2) reconfigured lots of 0.73 acres and 2.02 acres, 25 Imperial Drive
and 1330 Shelburne Road.
On the 13th day of February, 1996, the South Burlington Planning Commission
approved the request of Bernard and Nancy Barone, and Gail Wyand and Mary
Grunvald for final plat approval under Section 202 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project consists of a boundary line adjustment between two (2) adjoining
properties of 28,010 square feet and 91,860 square feet resulting in two (2)
reconfigured parcels of 31,740 square feet and 88,130 square feet. Subdivision
approval is necessary for this boundary line adjustment because adding land to the
smaller lot will make it capable of subdivision into more lots than before the
adjustment. The sketch plan was reviewed on January 9, 1996.
2. These properties located at 1330 Shelburne Road and 25 Imperial Drive lie within
the C1 and R4 Districts. They are bounded on the east by a single family residence,
on the north by Imperial Drive, on the south by a commercial building and
undeveloped land, and on the west by Shelburne Road.
3. Access: Access to the residence at 25 Imperial Drive is currently across the
northeasterly portion of the property at 1330 Shelburne Road. This adjustment is
to convey 3730 square feet from the 1330 Shelburne Road property to the 25 Imperial
Drive property. This will result in the access to 25 Imperial Drive being on its own
property. No access changes proposed.
4. Lot size/frontage: The minimum lot size requirements of 9500 square feet in the
R4 District and 40,000 square feet in the Cl District will be met. The parcel at 25
Imperial Drive will increase in size from 28,010 square feet to 31,740 square feet.
The parcel at 1330 Shelburne Road will decrease in size from 91,860 square feet to
88,130 square feet.
5. The minimum frontage requirement of 80 feet will be met in the R4 District and the
minimum frontage requirement of 120 feet will be met in the C1 District. The
frontage for 25 Imperial Drive will increase from 100 feet to 150 feet. The frontage
for 1330 Shelburne Road along Imperial Drive will decrease from 500.85 feet to 450.85
feet.
6. Setbacks: Setback requirements will be met.
7. Other:
--- lot 8#A has been merged with lot #8, therefore the property line separating
them should be removed.
--- the property line which is to be dissolved should be labeled as such on the
plat.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the final plat application of Bernard and Nancy Barone, and Gail Wyand
and Mary Grunvald for a boundary line adjustment involving 3,730 square feet of
land resulting in two (2) reconfigured lots of 0.73 acres and 2.02 acres, 25 Imperial
Drive and 1330 Shelburne Road, as depicted on a subdivision plat entitled "Proposed
Conveyance Wyand & Grunvald to Barone, Imperial Drive, South Burlington,
Vermont", prepared by Pinkham Engineering Associates, Inc., dated 1/10/96, with
the following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. The plat shall be revised to show the changes listed below and shall require
approval of the City Planner. Three (3) copies of the approved revised plat shall
be submitted to the City Planner prior to recording.
a) The plat shall be revised to remove the property line separating lot #8 and
lot #8a.
b) The plat shall be revised to label the property line which is to be dissolved
as such on the plat.
3. Any change to the plat shall require approval by the South Burlington Planning
Commission.
4. The final plat plan shall be recorded in the land records within 90 days or this
approval is null and void. The plan shall be signed by the Planing Commission Chair
or Clerk prior to recording.
