HomeMy WebLinkAboutBATCH - Supplemental - 0040 IDX DriveProject Narrative On January 23, 1973, the South Burlington Planning Commission approved the subdivision of 18 commercial lots shown on a plan prepared for the National Life Insurance Company, a copy of which is attached hereto (the "National Life Plan"). The National Life Plan was not recorded within the 90 day period mandated by Vermont law and, therefore, the original approval lapsed. On April 14, 1998, the South Burlington Planning Commission reapproved the National Life Plan to address the delayed recording of the Plan. In the April 4, 1998 Findings of Fact, the Planning Commission note that: Some of the original lots have altered their boundaries since the 1973 plat. The City will be requesting that these property owners obtain the appropriate amendments from the Planning Commission. BDP Realty Associates ("BDP") submits this application to seek approval for modifications which have occurred on its property since the National Life Plan was approved in 1973. BDP currently owns the following parcels of land from the original plan of lots shown on the National Life Plan: 1. BDP acquired Lot No. 1, as shown on the National Life Plan, by Warranty Deed from Hatco Associates dated July 5, 1979 and recorded in Volume 141 at Page 233 of the City of South Burlington Land Records. The following modifications were made to Lot No. 1 after the above -referenced purchase: (a) BDP conveyed a parcel of land known as Holmes Road Extension to the City of South Burlington by Irrevocable Offer of Dedication dated April 26, 1988 and recorded in Volume 261 at Page 125 of the City of South Burlington Land Records. The conveyance of this roadway was mandated in condition No. 3 of BDP's December 15, 1987 Site Plan Approval. (b) BDP acquired a strip of land, approximately 40 feet in width, along Shelburne Road from the City of Burlington by Deed dated September 9, 1991 and recorded in Volume 317 at Page 210 of the City of South Burlington Land Records. 2. By Warranty Deed dated January 18, 1979 and recorded in Volume 146 at Page 459 of the City of South Burlington Land Records, National Life Insurance Company conveyed the following parcels to BDP: (a) Lot No. 2, as shown on the National Life Plan: (b) the pre-existing lot identified as "Fairview Motors," as shown on the National Life Plan; and (c) a portion of the 70 foot right of way adjacent to the Fairview Motors lot, as shown on the National Life Plan. The following modification was made to the above -property after the conveyance by National Life Insurance Company: (a) BDP acquired a strip of land, approximately 40 feet in width, along Shelburne Road from the City of Burlington by Deed dated September 9, 1991 and recorded in Volume 317 at Page 210 of the City of South Burlington Land Records. Attached is a Boundary Survey prepared by Krebs & Lansing Consulting Engineers, Inc dated July 30, 1998 (the "Boundary Survey"), which depicts the following lots of land: Lot A (containing 9.606 acres), which lot consists of Lot No. 1 on the National Life Plan, with the deletion of the lands conveyed to the City of South Burlington for Holmes Road Extension and the addition of the 40 foot strip along Shelburne Road that was conveyed from the City of South Burlington to BDP. Lot B (containing 4.837 acres), which lot consists of the original parcel conveyed by National Life Insurance Company to BDP by Warranty Deed dated January 18, 1979 and recorded in Volume 146 at Page 459 of the City of South Burlington Land Records, with the addition of the 40 foot strip along Shelburne Road that was conveyed from the City of South Burlington to BDP. Sheet C-101 includes the number of existing handicap parking spaces. Per the City's regulations, 17 handicap spaces are required for the existing 727 parking spaces. Mr. Belair said he is most concerned with the buildings that are closer to the property line. 18.1 ft. was the closest the Board had approved. Units 15 and 16 are built within 13 feet of the property line. Units 1 & 2 went from 15 ft. to 12 ft. from the property line. Unit #1 has an enclosed porch and the footprint of the building does not match what is on the plan. Building #17 has a deck that is not shown on the plans presented. Mr. Osgood said those 2 units were built by the owners, and he assumed they had permission to do that. Mr. Belair asked the Board if it would approve the as -built or ask the applicant to move the property line to maintain the setback. Mr. Bolton felt better documentation was needed. He also felt the lot lines should be moved to preserve the setbacks. Mr. Dinklage reminded the Board that their concern had been that residents of the units would treat the golf course as their backyards. Mr. Belair said this is what he saw happening. People have put flowerbeds, etc. on golf course property. Mr. Dinklage said he wanted the lot lines moved. Mr. Belair said measurements will be needed on units # 1 and 17. Mr. Osgood said it would be reasonable to maintain the 18.1 ft. setback as the closest, except unit #1 which would be 15 ft. Height of the landscape feature: The height of the sign as measured from finished grade is at its tallest point is 78 inches or 6.5 feet (maximum allowed is six (6) feet). The average height of the proposed landscape feature as measured from finished grade is 4.7 feet (see enclosed photos). The application was last reviewed by the DRB at their May 7, 2002 meeting (minutes enclosed). This property lies within the Residential 4 District. The property is bounded on the east by the Belter Farm, on the north and west by the Winooski River, and on the south by a residence and a commercial structure. The only issue affecting this application is coverage. Coverage: The applicant is proposing a front yard coverage along Lime Kiln Road at 12% (maximum allowed is 30%). Building coverage is 11.7% which remains unchanged from previous approval (maximum allowed is 20%). Overall coverage is 17.6% (maximum allowed is 40%). This is down from the previous approval on 5/7/02, which was 33.7%. This feature appears on the site plan, landscape plan and miscellaneous other plans collectively titled "Green Mountain Power Corporation, Corporate Headquarters Building, prepared by Sargent Webster Crenshaw & Folley (Stamped), dated March 22, 1983". In addition, this feature is also shown on IDX's Act 250 Permit Amendment, application #4C0094-2E, filed in 1999 to add new parking spaces to its 25 GMD location. I assume that both of these processes, especially the original landscape plan had some level of DRB approval. It would be unfortunate for IDX to have to wait until October to request a permit for adding letters to a landscape feature that was clearly part of GMP's approved plans over 20 years ago. Any assistance you can provide would be appreciated. Also, I have attached a powerpoint file showing how I arrived at the average height for the sign and have indicated where we have added fill. These numbers may be slightly different than those I provided yesterday, since I arrived at these numbers using two measurements on each elevation instead of one and I also rounded all numbers up to the nearest inch to insure that my measurements are conservative. We would be happy to provide any additional information or more professionally made graphics for the DRB to review if you think that it would be appropriate.
