Re: Findings of Fact, application of IDX Systems Corporation to
amend a previously approved plan for a 120,000 square foot
general office building. The amendment is to: 1) construct 120
lineal feet of sidewalk, and 2) install a cooling tower with
associated landscaping, 1400 Shelburne Road.
On the 16th day of December, 1997, the South Burlington Planning
Commission approved the request of IDX Systems Corporation for
site plan review under Section 26.10 of the South Burlington
Zoning Regulations based on the following findings:
1. This project consists of amending a plan previously approved
on 12/15/87, last revised on 5/27/97, for a 120,000 square foot
general office building. The amendment is to: 1) construct 120
lineal feet of sidewalk, and 2) install a cooling tower with
associated landscaping. The only issues affected by this
amendment are overall coverage and landscaping.
2. This property located at 1400 Shelburne Road lies within the
C2 District and the Bartlett Brook Watershed Protection Overlay
District. It is bounded on the south by an office building, on
the north by a shopping center and undeveloped property, on the
east by Green Mountain Drive, and on the west by Shelburne Road.
3. Coverage: Overall coverage is 50% (maximum allowed is 70%).
4. Landscaping: The proposed landscaping has an estimated
value of $22,920.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington
Planning Commission approves the site plan application of IDX
Systems Corporation to amend a previously approved plan for a
120,000 square foot general office building. The amendment is
to: 1) construct 120 lineal feet of sidewalk, and 2) install a
cooling tower with associated landscaping, 1400 Shelburne Road,
as depicted on a plan entitled "Proposed Planting Concepts at
Cooling Tower, "prepared by Keith Wagner, dated 11/l/97 with the
following stipulations:
1) All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.

2) Prior to issuance of a zoning permit, the applicant shall post
a $22,920 landscape bond. The bond shall remain in effect for
three (3) years to assure that the landscaping takes root and has
a good chance of surviving.
3) The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or
this approval is null and void.
4) The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to use
of the new sidewalk.
5) Any change to the site plan shall require approval by the
South Burlington Planning Commission.
