CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of BDP Realty Associates to modify the configuration of two (2) parcels that were originally approved by the South Burlington Planning Commission on 1/23/73, 1400 and 1500 Shelburne Road. On the g" day of September, 1998, the South Burlington Planning Commission approved the request of BDP Realty Associates for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1) This project consists of modifying the configuration of two (2) parcels that were originally approved by the Planning Commission on 1/23/73. The boundary line adjustment involves moving the southerly boundary of lot A 70 feet to the south to include a 70 foot r.o.w. to the Horticultural Farm which was eliminated when Green Mountain Drive was constructed. 2) This property located at 1400 & 1500 Shelburne Road lies within the C2 District. It is bounded on the east by Green Mountain Drive, on the south by an auto dealership, on the west by Shelburne Road, and on the north by a retail/office building and undeveloped land. 3) Lot size/frontage: The expanded lot meets lot size and frontage requirements. 4) Coverage/setbacks: Coverage and setback requirements are met. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of BDP Realty Associates to modify the configuration of two (2) parcels that were originally approved by the South Burlington Planning Commission on 1/23/75, 1400 and 1500 Shelburne Road, as depicted on a plat entitled, "Boundary Survey BDP Realty Associates Shelburne Road South Burlington, Vermont," prepared by Trudell Consulting Engineers, Inc., dated July 30, 1998, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Any change to the final plat shall require approval by the South Burlington Planning Commission. 3) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
