FINDINGS OF FACT, CONCLUSIONS & DECISION
IDX Systems Corporation, hereafter referred to as the applicant, is requesting revised
final plan approval for a Planned Unit Development (PUD) consisting of a 384,400 sq. ft.
general office building and a 679 space parking structure. The South Burlington
Development Review Board (DRB) held a public hearing on March 4, 2003. Peter
Smichenko, Timothy Duff and Miles Weston represented the applicant.
Based on testimony given at the above mentioned public hearing and on the plans and
supporting materials contained in the document file for this application, the DRB finds,
concludes and decides as follows:
FINDINGS OF FACT
The applicant is requesting revised final plan approval for a PUD consisting of a
384,400 sq. ft. general office building and a 679 space parking structure. The
amendment consists of substituting 75 redtwigged dogwoods for 28 transplanted
pines along the southern property line at 40 IDX Drive.
2. The project was originally approved as a three phased PUD by the South
Burlington Planning Commission on January 26, 1999, subject to 19 conditions.
The project consists of elimination of a 21,200 sq. ft. structure, construction of a
239,708 sq. ft. building addition, construction of a 679-space parking garage, and
lot consolidation. The proposed amendment involves only phase one
landscaping plans.
3. The applicant submitted two sheets of plans labeled LS.1 and LS.2 and dated
February 28, 2003, which detail the as -built landscape plantings associated with
phase one of the approved development.
CONCLUSIONS
The applicant has indicated that substitutions and revisions to the originally
approved phase one landscaping plans were made in response to site conditions
and plant availability. Thirteen more plants are proposed than the number
previously approved for phase one. In addition, slope factors were problematic and
existing power lines did not allow for the safe operation of a tree spade.
Consequently, the applicant substituted 75 dogwood shrubs for the previously
approved 28 transplanted pines along the southerly property line. Due to the
difficulties of the site conditions along the southerly property line described by the
applicant, the DRB concludes that the landscape substitutions are appropriate.
2. Phase one landscape planting costs totaled $235,889. Approved minimum
landscaping costs were to total $257,950 or more. Based on approved phase two

and three landscaping plans, it appears that the minimum landscaping cost
requirement will be met after the proposed substitution of dogwood shrubs for the
previously approved transplanted pines.
DECISION
MOTION by Gayle Quimby, seconded by Chuck Bolton, to approve revised final plan
#SD-03-07, subject to the following conditions:
All previous approvals for the subject property shall remain in effect except as
amended herein.
2. This project shall be completed as shown on plan sheets LS.1 and LS.2, dated
February 28, 2003, as amended by this decision and on file in the Department of
Planning and Zoning.
