FINDINGS OF FACT AND DECISION
The applicant, Jim Gaboriault, is seeking to amend a previously approved plan for a 233,133 sq.
ft. general office building. The amendment consists of installing an emergency generator
resulting in the elimination of three (3) parking spaces, 40 IDX Drive.
The Development Review Board held a public hearing on August 7, 2012. The applicant was
represented by Debra Bell.
Based on the plans and materials contained in the document file for this application, the
Development Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, Jim Gaboriault, is seeking to amend a previously approved plan for a 233,133
sq. ft. general office building. The amendment consists of installing an emergency generator
resulting in the elimination of three (3) parking spaces, 40 IDX Drive.
2. The owner of record of the subject property is IDX Systems Corporation.
3. The subject property is located in the Commercial 2 Zoning District.
4. The application was received on June 25, 2012.
5. The plans submitted consist of two (2) page set plans, page one (1) is entitled, "GE
Healthcare 40 IDX Drive South Burlington, VT" prepared by Trudell Consulting Engineers, dated
4/20/12.

Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations, the
following review standards shall apply to site plan applications:
(a) The relationship of the proposed development to goals and objectives set forth in the
City of South Burlington Comprehensive Plan.
6. This criterion will continue to be met.
(b) The site shall be planned to accomplish a desirable transition from structure to site,
from structure to structure, and to provide for adequate planting, safe pedestrian
movement, and adequate parking areas.
The base required number of parking spaces on the lot is 744. The existing number of spaces is
732, previously approved by the City. The proposed project will locate the generator pad on an
area currently used for three parking spaces. This will result in a new proposed parking total of
729 spaces for a 15 space shortfall which represents a 2% waiver.
The applicant is requesting a 2 percent off-street parking waiver (15 spaces) as permitted under
Section 13.01 N. (2) of the LDRs which states that "(w)here the Development Review Board
determines that a proposed land use or structure is adequately served by existing or proposed
parking facilities, the Development Review Board may waive the off-street parking space
requirements stipulated in Tables 13-1 through 13-6, by no more than twenty-five percent
(25%). "
The Board finds that the elimination of these three parking spaces will not have a
material affect on the availability of parking for the facility and hereby grants a 2% waiver
of the base requirement of 744 spaces.
Section 13.01 of the Land Development Regulations requires that bicycle parking or
storage facilities be provided for employees, residents, and visitors to the site. A bike
rack is shown on the plans.
(c) Parking shall be located to the rear or sides of buildings.
9. No changes are proposed to the general layout of the parking lot.
(d) Without restricting the permissible limits of the applicable zoning district, the height
and scale of each building shall be compatible with its site and existing or adjoining
buildings.
10. No changes are proposed. This criterion will continue to be met.
(e) Newly installed utility service modifications necessitated by exterior alterations or
building expansions shall, to the extent feasible, be underground.
11. No changes are proposed. This criterion will continue to be met.
(0 The combination of common materials and architectural characteristics, landscaping,
buffers, screens, and visual interruptions to create attractive transitions between
buildings or different architectural styles shall be encouraged.
12. No changes are proposed. This criterion will continue to be met.

(g) Proposed structures shall be related harmoniously to themselves, the terrain and to
existing buildings and roads in the vicinity that have a visual relationship to the
proposed structures.
13. The proposed generator will be screened from public roads by current buildings, sloping
topography and roadside vegetation. This criterion will continue to be met.
In addition to the above general review standards, site plan applications shall meet the following
specific standards set forth in Section 14.07 of the Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access to abutting
properties whenever such access is deemed necessary to reduce curb cuts onto an
arterial or collector street, to provide additional access for emergency or other
purposes, or to improve general access and circulation in the area.
14. The reservation of land is not necessary. This criterion will continue to be met.
(b) Electric, telephone, and other wire -served utility lines and service connections shall
be underground. Any utility installations remaining above ground shall be located so as
to have a harmonious relation to neighboring properties and to the site.
15. The conduit from the generator to the building will be buried. This criterion will continue
to be met.
(c) All dumpsters and other facilities to handle solid waste, including compliance with
any recycling or other requirements, shall be accessible, secure, and properly screened
with opaque fencing to ensure that trash and debris do not escape the enclosure(s).
16. This criterion will be met.
(d) Landscaping and screening requirements

OTHER STANDARDS:
Section 13.06((B) Snow Storage. Pursuant to Section 13.06(B), snow storage areas must be
specified and located in an area that will minimize the potential for run-off.
18. The plans depict adequate snow storage areas.
Section 13.07(A) Lighting. Pursuant to Section 13.07(A), all exterior lighting shall be shielded
and downcasting to prevent light from spilling onto adjacent properties and rights -of -way.
19. No changes to lighting are proposed. This criterion will be met.
Section 13.18(B) Specific Standards for Utility Cabinets and Similar Structures. Section
13.18(B)(4) states that "There shall be sufficient landscaping with evergreens of sufficient height
and density to screen effectively the facility from surrounding property."
20. The proposed generator, located away from property lines, is not proposed to be
screened with evergreens. The Board finds this acceptable given that the generator will
be screened from public roads by current buildings, sloping topography and roadside
vegetation. However, the fence height shall not exceed eight (8) feet in height and
proposed jersey barriers shall be replaced by concrete -filled steel posts.

DECISION
Motion by Roger Farley, seconded by Bill Stuono, to approve Site Plan Application #SP-12-36
of Jim Gaboriault, to amend a previously approved plan for a 233,133 sq. ft. general
office building. The amendment consists of installing an emergency generator resulting
in the elimination of three (3) parking spaces, 40 IDX Drive.
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the South
Burlington Department of Planning and Zoning.
3. The Board hereby grants a 2% parking waiver of the base requirement of 744 spaces for
an approved total parking area of 729 spaces.
4. The Board finds that screening for the generator is not required as the generator will be
screened from public roads by current buildings, sloping topography and roadside
vegetation.
5. The plans shall be revised to show the changes below and shall require approval of the
Administrative Officer. Three paper (3) copies and one (1) digital copy of the approved
revised plans shall be submitted to the Administrative Officer prior to permit issuance.
a. Plans shall be revised to show a fence height not to exceed eight (8) feet.
b. Plans shall be revised to replace proposed jersey barriers with concrete -filled
steel posts.
6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to use of the generator.
8. Any change to the site plan shall require approval by the South Burlington Development
Review Board or the Administrative Officer.
