Re: Findings of Fact, application of Mountain Cable Company d/b/a
Adelphia Communications Corporation for: 1) the temporary
placement of a 12'x 60' office trailer with an enclosed link to the
main office building, and 2) the construction of a 5,200 square
foot addition to an existing 5,000 square foot office building, 106
Kimball Avenue.
On the llth day of July, 1995, the South Burlington Planning
Commission approved the request of Mountain Cable Company. d/b/a
Adelphia Communications Corporation for site plan review under
Section 26.10 of the South Burlington Zoning regulations based on
the following findings:
1 This project consists of: 1) the temporary placement of a 12'x
60' office trailer with an enclosed link to the main office
building, and 2) constructing a 5,200 square foot addition to an
existing 5000 square foot office building. The temporary office
and enclosed link will be removed upon completion of the office
addition. The Planning Commission on 1/14/92 approved a two (2)
phase project, of which only phase 1 was constructed.
2. This property located at 106 Kimball Avenue lies within the IC
District. It is bounded on the west by Potash Brook and the
Woodlands commercial/industrial complex, on the east and north by
undeveloped property and on the south by Kimball Avenue.
3. Access/circulation: Access is provided by a 27 foot curb cut
on a proposed public street known as Adelphia Drive. No change
proposed.
Circulation is adequate.
4. Coverage/setbacks: Building coverage is 3.5% (maximum allowed
is 30%). Total lot coverage is 10.3% (maximum allowed is 70%).
Front yard coverage along Kimball Avenue is 1% and along Adelphia
Drive is 17% (maximum allowed is 30%).
Setback requirements will be met.
5. Parking: A total of 41 parking spaces are required and 47
spaces including four (4) handicapped spaces will be provided. A
bike rack is being provided as required under Section 26.253(b) of
the zoning regulations.
6. Landscaping: The minimum landscaping requirement, based on
building costs, is $10,500 which is being met. Plantings will
include Sugar Maple, Crabapple, Rhododendron and Juniper.
7. Traffic: ITE estimates that the existing use generates 20.4
vte's and 'the proposed addition an additional 21.0 vte's for a
total of 41.4 vte's. The applicant was made aware that the road
impact fee will be approximately $3900.
8. Sewer: Additional sewer allocation needed is 370 gpd. The
applicant will be required to pay the per gallon fee prior to
permit.
9. Sidewalk: The applicant has contributed to the sidewalk fund
for construction of a sidewalk along the property's frontage along
Kimball Avenue.
10. Lighting: Existing and proposed exterior lighting consists of
the following:
--- six (6) 250 watt metal halide lamps with downcasting and
shielded fixtures on 16 foot poles.
--- one (1) 100 watt metal halide building mounted lamp with a
downcasting and shielded fixture.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Mountain Cable
Company d/b/a Adelphia Communications Corporation for: 1) the
temporary placement of a 12'x 60' office trailer with an enclosed
link to the main office building, and 2) the construction of a
5,200 square foot addition to an existing 5,000 square foot office
building, 106 Kimball Ave., as depicted on a plan entitled
"Adelphia Cable Communication, Kimball Ave., So. Burlington, VT",
prepared by Trudell Consulting Engineers, dated 11/27/91, stamped
received June 20, 1995, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. For the purpose of calculating required road impact fees under
the South Burlington Impact Fee Ordinance, the Planning Commission
estimates that the office addition will generate 21.0 additional
vehicle trip ends during the P.M. peak hour.
3. An additional sewer allocation of 370 gpd is approved. The
applicant shall pay the per gallon fee prior to issuance of a
zoning permit.
4. The applicant shall post a $10,500 landscape bond prior to
issuance of a zoning permit. The bond shall remain in effect for
three (3) years to assure that the landscaping takes root and has
a good chance of surviving.

5. Any new exterior lighting shall consist of downcasting shielded
fixtures so as not to cast light beyond the property line. Any
change in existing or proposed lighting shall be approved by the
City Planner prior to installation.
6. Based on the expressed representation of the applicant, the
temporary office trailer and enclosed link shall be removed upon
occupancy of the addition or by November 1, 1996, whichever first
occurs.
7. The applicant shall obtain separate zoning permits for (1) the
addition, (2) the temporary office trailer and enclosed link,
within one year or this approval is null and void.
8. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to use
of the addition.
9. Any change to the site plan shall require approval by the South
Burlington Planning Commission.
10. Based on the expressed representation of the applicant, the
applicant shall implement certain improvements which help make the
temporary trailer and link blend aesthetically with the existing
building.
