SITE PLAN APPLICATION #SP-16-68
FINDINGS OF FACT AND DECISION
Wright & Morrissey, Inc., hereinafter referred to as the applicant, is seeking after -the -
fact approval to amend a previously approved plan for a 23,400 sq. ft. general office
building. The amendment consists of: 1) adding a 30 yard dumpster, and 2) adding two
(2) outside storage areas, 43 Comcast Way.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan
for a 23,400 sq. ft. general office building. The amendment consists of: 1) adding a 30
yard dumpster, and 2) adding two (2) outside storage areas, 43 Comcast Way.
2. The owner of record of the subject property is Cable Holdco Exchange III, LLC.
3. The subject property is located in the I-C Zoning District and is 287,496 square feet in
size.
4. The application was received on October 3, 2016.
5. The plan submitted is entitled, 'Comcast Communications 43 Comcast Way, South
Burlington, VT," prepared by Trudell Consulting Engineers, Inc., dated 09/12/96, and
last revised on 09/07/15.
DIMENSIONAL REQUIREMENTS
6. Building coverage is 8.3 % (maximum allowed is 40%). Overall coverage is 25.7%
(maximum allowed is 70%). Front yard coverage along Kimball Avenue is 4.5% and
along Comcast Way is 13.8% (maximum allowed is 30%).
7. Setbacks requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below will are affected by this application. All other standards will
continue to be met.
(c) All dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible,

secure, and properly screened with opaque fencing to ensure that trash and
debris do not escape the enclosure(s),
8. The new dumpster is not screened. The plan will have to be revised to show the new
dumpster fully enclosed on all sides.
OUTSIDE STORAGE
9. The site plan shows two (2) new outside storage areas, one for cable recycling bins
and another for pallet storage. These areas are not readily visible from Kimball Avenue
so no additional screening will be required.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-16-68 of Wright & Morrissey, Inc., subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The site plan must be revised to show the changes below and will require approval
of the Administrative Officer. Three (3) copies of the approved revised plan must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to show the new 30 yard dumpster fully enclosed
on all sides.
4. All exterior lighting shall be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
5. Prior to issuance of a zoning permit, the applicant must submit to the Administrative
Officer a final set of project plans as approved in digital (PDF) format.
6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.0.4 of the Land Development Regulations or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to use or occupancy of the outside storage areas and the new dumpster.
8. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
