JUNE 6, 2000 MEETING
6) DAPICE — CONDITIONAL USE APPLICATION - REAR DECK
REPLACEMENT —119 HOLMES ROAD
The applicant is seeking conditional use approval under Section 3.506 and Section 26.05 of
the South Burlington Zoning Regulations to replace a rear deck in the Lakeshore
Neighborhood District. The alteration consists of replacing a 30-foot by 12-foot deck with a
28 foot by 12-foot deck, 119 Holmes Road. The applicants were previously given a
variance by the Zoning Board of Adjustment on June 10, 1985 to construct a single family
dwelling within 35 feet of the high water mark and with a 10-foot side yard setback -
This property is located in the Lakeshore Neighborhood and Conservation Open Space
Districts. It is bounded on the east by Holmes Road, on the north by a single-family
residence, on the west by Lake Champlain, and on the south by a single-family residence.
Criteria of 3.506 (for water oriented structures)
d) The proposed steps and walkway leading down to the lake will:
1) to the greatest extent possible use natural materials such as wood. The applicant has
indicated that the new structure would remain a natural wood color and not be
painted.
2) not increase the potential for erosion.
3) not have an undue adverse impact on the aesthetic integrity of the lakeshore.
4) result in minimal removal of trees, shrubs, and ground cover
e) Existing trees and ground cover shall be preserved and maintained to enhance the
aesthetic integrity of the lake shore, provide a visual buffer from the lake and an
absorption area for erosion prevention.
Conditional Use Criteria:
The proposed use complies with the stated purpose of the Lakeshore Neighborhood District
to "encourage residential use at densities and setbacks that are compatible with the existing
character of the lake shore neighborhoods located in the vicinity of Bartlett Bay Road and
Holmes Road."
The proposed use will not adversely affect:
a) the capacity of existing or planned community facilities. No affect expected.
b) the character of the area affected. No adverse affect is expected.
c) traffic on roads or highways in the vicinity. The proposed use is not expected to impact
traffic.
d) bylaws in effect. The proposal is in conformance with the zoning regulations.
e) utilization of renewable energy resources. There is no utilization of renewable energy
resources to be affected.
f) general public health and welfare. No adverse affect expected.

3. Consent Agenda:
a. Design Review application #DR-00-08 — Dorset Square Associates —
Fletcher Allen Replay sign, 150 Dorset Street. This project consists of
replacing an existing internally lit wall sign that utilizes a white
background and dark lettering with an internally lit wall sign that
utilizes a dark background with white lettering.
Mr. Dinklage asked if anyone on the Board or in the audience wanted a full hearing on
this item. No such requests were made.
Mr. Farley moved to approve the Consent Agenda subject to the conditions in the staff
memo of 1 June 2000. Mr. Roth seconded. Motion passed unanimously.
4. Continued Public Rearing: Preliminary plat application #SD-00-25 of Jeffrey
and Elizabeth Goldberg to subdivide a 12.92 acre parcel into 5 lots of 2.34
acres (lot #1), 2.34 acres (lot #2), 1.73 acres (lot #3), 1.92 acres (lot #4) and
4.55 acres (lot #5), 1760 Dorset Street:
Mr. Belair advised that the applicant has requested a continuation until 11 July.
Ms. Quimby moved to continue the application until I I July 2000. Mr. Roth seconded.
Motion passed unanimously.
5. Sketch Plan application #SD-00-24 of Michael & Melissa Lojek to subdivide
a 2.4 acre lot into: 1) a 1.6 acre lot hereafter referred to as Lot #a and 2) a 0.8
acre lot hereafter referred to as Lot #2,1397 Spear Street:
Mr. Belair advised that the applicant has requested a continuation until 11 July.
Mr. Roth moved to continue the Sketch Plan until I 1 July. Mr. Farley seconded. Motion
passed unanimously.
6. PUBLIC HEARING: Application #CU-00-12 of Douglas & Lynn Dapice
seeking conditional use approval from Section 26.05, Conditional Uses and
general approval under Section 3.506, Nonconforming Uses and Activities of
the South Burlington Zoning Regulations. Request is for permission to
reconstruct a 12' x 28' deck and stairs located in the Conservation & Open
Space District at 119 Holmes Road:
Mr. Dapice said the deck is more than 30 years old and is falling apart. He is concerned
with the safety of his grandchildren.

The new deck will be made of cedar and will be 28 ft. long, within the footprint.
Mr. Belair said staff visited the site and has no concerns.
Ms. Quimby moved the Development Review Board approve conditional use

3. The applicant shall obtain a zoning permit within six months pursuant to
Section 27.302 of the Zoning Regulations or this approval is null and void.
4. Any change to the site plan or appearance of the deck shall require approval
by the South Burlington Development Review Board.
Mr. Farley seconded. Motion passed unanimously.
7. Appeal #AO-00-03 of Ralph and Cheryl C. Guillette appealing the decision of
the Administrative Officer that the appellant's single family dwelling at 314
Fatchen Road is in violation of the zoning regulations due to it projecting
1514" into the 50 foot front yard setback requirement:
Mr. Belair gave members material just submitted by appellant's counsel, Paul Morwood.
Mr. Dinklage said the first issue is whether the house violates the zoning regulations.
Mr. Morwood said their appeal is not whether the house is 15'4" further into the setback
but with the remedy which they feel is excessive ($100/day). In addition, moving the
house would bankrupt the Guillettes and isn't a practical decision. Mr. Morwood said
that under the statutes, the Board does not need to do either as the mistake was made by
the builder, not the Guillettes. Mr. Morwood also noted that other houses on the street
are further into the setback than the Guillettes.

Overview:
The applicant is seeking conditional use approval under Section 26.05 of the South Burlington Zoning
Regulations to replace a rear deck in the Lakeshore Neighborhood District. The alteration consists of replacing
a 3 0-foot by 12-foot deck with a 28 foot by 12 foot deck, 119 Holmes Road.
Issues:
The, applicant should submit a brief report addressing the criteria of'Section 26.05 and the criteria of
Section 3,506 of the Zoning Regulations.
