WITNESSETH- WHEREAS, Developer has received site plan approval from the MUNICIPALITY'S Development Review Board for the development of property located at 1 1 7 Holmes Road , as depicted on a site plan entitled" Misc Application MS- 07-1 0 ", dated 09/1 8/2007 and prepared by Civil Engineering Associates Inc WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the capacity of escrow agent. NOW THEREFORE, the parties hereby covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following construction as depicted and in accordance with the specifications set forth in said site plan and related documents: $5,000 hold in escrow to guarantee the removal of camp at 117 Holmes Rd South Burlington VT within 2 years after completion of new dwelling 2. The Developer shall complete the improvements set forth in Paragraph one no later than 0 3/ 1 8/ 2 01 0 3. DEVELOPER shall replace or repair any defective or improper work or materials which may be recognized within three (3) years after completion of the improvements set forth in Paragraph one. For the purpose of this Agreement "completion"- shall be deemed to have occurred when the MUNICIPALITY has inspected and approved the construction of all the improvements required by this Agreement and issued written notice to the DEVELOPER that the construction is complete. 4. For the guaranty of Developer's performance of all requirements herinabove set forth, and prior to the issuance of any zoning permit for Terrence K Ryan , Developer and Bank agree that the sum of $5, 000.00 shall be set aside and held in escrow by the Bank and shall be available for payment to the Municipality in accordance with the terms herein set forth. 5. If the Municipality shall file with the Bank a statement that the Developer is in the judgement of Municipality in default under the terms of this Agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality, in amounts not to exceed a total enabling the Municipality to complete improvements and requirements set forth in this Agreement. 6. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality , nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such a manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this agreement. 11.This agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3). 12. The sum of �vo�. shall be maintained in escrow until certification to the Bank by the Municipality of the completion of the warranty period set forth in paragraph three (3). 13.This agreement shall not only be binding upon the parties hereto, but also their respective heirs, executers, administrators, successors, and assigns. Rear Setback 30 ft. 74 ft. zoning compliance CONDITIONAL USE CRITERIA Pursuant to Section 12.01(D) of the South Burlington Land Development Regulations the proposed structure shall be reviewed as a conditional use and shall meet the following standards: The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. Staff feels that the proposed project is consistent with the planned character of the area, as defined by the Comprehensive Plan. The proposed use shall conform to the stated purpose of the district in which the proposed use is located. Staff feels that the proposed project is consistent with the stated purpose of the Lakeshore Neighborhood District, which is "to encourage residential use at densities and setbacks that are compatible with the existing character of the lake shore neighborhoods located in the vicinity of Bartlett Bay Road and Homes Road. " The Development Review Board must find that the proposed uses will not adversely affect the following: 2 (a) The capacity of existing or planned municipal or educational facilities. The proposed project will not adversely affect municipal services, nor will it have an impact on educational facilities. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. The proposed project will not have an adverse affect on the character of the neighborhood or zoning district that this property falls within. (c) Traffic on roads and highways in the vicinity. It is extremely unlikely that this proposed single family home will generate any additional traffic. Any traffic that is generated by this home will be negligible in its effect on the neighborhood and will hardly be more than is present today from the existing camp. (d) Bylaws in effect. The proposed project meets all of the dimensional standards of the zoning district. (e) Utilization of renewable energy resources. The proposed project will not likely affect renewable energy resources. (0 General public health and welfare. The proposed project will not likely have an adverse affect on general public welfare. SITE PLAN REVIEW STANDARDS Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations the Proposed conditional use shall meet the following standards: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The proposed project has been planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. 3 Parking is to the front of the building. However, given that the nature of the project as a single-family residential use, staff finds this layout acceptable and in harmony with the rest of the neighborhood. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The applicant has stated that the proposed structure will be approximately 24.5 feet in height, which is in compliance with Section 4.07(E) and 4.08(F) of the Land Development Regulations. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. The applicant has submitted architectural renderings of the proposed home. Staff feels that this requirement is being met. (t) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The applicant has submitted architectural renderings of the proposed home. Staff feels that this requirement is being met. (g) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to require any additional access easements as part of the proposed project. (h) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. 0 Staff has already stated that any new utility lines, services, and service modifications shall be underground. (i) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). As this is a single-family residential lot, it is unlikely that this criterion would apply. Q) Landscaping and Screening Requirements The proposed project does not require additional landscaping or screening under the SBLDR. Furthermore, no trees or shrubs are proposed to be removed in order to accommodate the addition and so none are required to be replaced. Pre -Existing Structures along Lake Champlain and within Queen City Park This proposed expansion shall be reviewed under Section 12.01(D) of the SBLDR which includes all lands within one hundred fifty feet horizontal distance of the high water elevation of Lake Champlain. The expansion and reconstruction of pre-existing structures on these lands may be approved by the DRB as a conditional use provided the requirements of the underlying zoning district and the following standards are met: a) The structure to be expanded or reconstructed was originally constructed on or before April 24, 200. The existing structure meets this criterion. b) The expanded or reconstructed structure does not extend any closer, measured in terms of horizontal distance, to the applicable high water elevation or stream centerline than the closest point of the existing structure. The proposed expansion is no closer to the lake than the existing structure. c) The total building footprint area of the expanded or reconstructed structure shall not be more than fifty percent larger than the footprint of the structure lawfully existing on April 24, 2000. The proposed expansion meets this criterion: the new home is 43.3% larger than the existing structure. d) An erosion control plan for construction is submitted by a licensed engineer detailing controls that will be put in place during construction or expansion to protect the associated surface water. The applicant has submitted an erosion control plan which is acceptable. 6-1 e) A landscaping plan showing plans to preserve maintain and supplement existing trees and ground cover vegetation is submitted and the DRB finds that the overall plan will provide a visual and vegetative buffer for the lake and/or stream. The plan indicates that most trees will remain or be relocated. However, one exiting pine along the northern property line is proposed to be removed. Staff recommends that this be replaced elsewhere on the site with trees of similar value, as approved by the City Arborist. 2. The applicant shall propose additional trees on the property which meet a similar value to the pine which is proposed to be removed. This shall be done in consultation with the City Arborist. The plans shall be revised accordingly. OTHER The plans include a note to convert the existing chimney to a fire pit. Open burning is not permitted within the City of South Burlington. Staff advises that the applicant discuss the proposed fire pit with the Fire Department. Although this is not under the control of the South Burlington Land Development Regulations, staff recommends that it be on the record that they are not endorsing anything which may conflict with any City ordinance. RECOMMENDATION Staff recommends that the Development Review Board approve Miscellaneous Application #MS-07-10, subject to the applicant addressing the numbered items in the comments section of this report. The discharge of sediment laden water from the project site Is prohibited. All discharged water from dewatering operations 'hall discharge Into a temporary sedimentation basin. B. Contractor shall Install all erosion control measures as depicted on plane and details or as recommended by the Vermont Agency of Natural Resources, or Soil Conservation Service, prior to any construction. Contractor shall also be responsible for Inspecting and maintaining all erosion control measures until project Is completed. C. If aoil disturbance will be required later than October 15th or earlier than April 15. the contractor shall be responsible for maintaining compliance with the winter stabilization practices and requirements far winter construction found in the 'Low Risk Site Handbook for Erosion Prevention and Sediment Control'. An overage application of one pound of calcium chloride par square yard of exposed area should be coneldered for each treatment. The exact number of applicatlone and amount of dust controller shall be based upon field and weather conditions. It shall be spread in such monner and by such devices that uniform distribution Is attained over the entire area on which It Is ordered placed. PART 2 - PRODUCTS 2.01 EROSION CONTROL NETTING A. Jute netting shall consist of undyed and unbleached yam woven Into a uniform open plain wsaw mesh. 2.02 EROSION CONTROL MATTING A. Where required on the plans or where directed by the Engineer, erosion control blankets (matting) shall be North American Green C125 for swpes, and SC150 for dope stabilization, or approved equal. 2.03 FILTER FABRIC A. When filter fabric Is required, It shall conform to the requirements of Mirafl 14ONS or approved equivalent. 2.04 CALCIUM CHLORIDE A Calcium chloride shall conform to the requirements of AASHTO M 144. Either regular flake calcium chloride, Type 1 or concentrated flake, pellet or other granular calcium chloride. Type 2, may be used. 2.05 WATER A. All water used shall be clean and free of harmful amounts of oil, wit, acids, alkalles, sugar, organic matter and other substances Injurious to the finished product, plant life or the establishment of vegetation. PART 3 - EXECUTION &01 STONE CHECK DAM INSTALLATION A. Stone check dame to be constructed and Installed as outlined in the Low -Risk Handbook or as Instructed by the Engineer. Once vegetation Is established and the check dame are no longer needed far eroelon control, they shall be removed. A02 SILT FENCES A. The silt fences shall be constructed In accordance with the onatructlon detail. The fence shall generally be placed 10 feet from the toe of the dope or as shown on the plane. The ends of the fence shall be placed uphill to form a horseshoe shape to trap all runoff. B. The silt fences shall be Inspected periodically far damage or build-up of sediments. All damaged fences shall be repaired or replaced. Sediment deposits shall be removed from the fence as they build up and be placed In an area where there Is no danger of further erosion. 3.03 EROSION MATTING A. Erosion matting shall be placed on all grove -lined ditches with profile grades exceeding 5.0% and shall be placed and maintained in accordance with the Vermont Agency of Transportation Standard Specifications Sectlons 654 and 755.07. 3.04 RESTORATION A. As soon as construction is completed Ir an area, It .hall be topeoiled, seeded, fertilized and mulched. 3.05 GRASS -LIMED DITCHES A. All ditches that ore not stone -lined shall be topsoled, seeded, fertilized end mulched. Any area which shows signs of erosion shall be reseeded Immediately and maintained until permanent vegetation ie established. 3.08 TEMPORARY DIVERSION DITCH A. Stabilize any diversion berms or flow channels with with mad and straw mulch or erosion control matting Immediately after Installation. Channels with slopes greater than 5% shall be lined with 4 Inch stone. The diversion berm shall remain in place until disturbed areas are completely stabilized. 3.D7 MAINTENANCE A. All erosion control measures shall be Inspected weekly and repaired and/or replaced as needed. B. All erosion control measures shall be Inspected after periods of heavy rain. C. The stabilized road entrance shall be top dressed with additional stone should the existing stone become clogged with sediment. D. Hay or straw mulch IS subject to wind action. Mulch may require anchoring as the weather conditions warrant. 3.08 WINTER CONSTRUCTION A. If, due to the project schedule, construction during the winter months 1. necessary. the Contractor shall follow the winter construction procedures outlined in the 'Low Risk Site Handbook for Soil Erosion and Sediment Control as well as the following procedures: 1. Minimize disturbance between October and May. 2. All erosion control measures shall be In place prior to the ground freezing. 3. For areas to be stabilized by vegetation, seeding shall be completed no later than september 15 to ensure adequate growth and cover. 3. All non -vegetative stabilization must be completed by October 15. 4. Where mulch Is specified, apply roughly 3 Inches with an 811-905 cover. Mulch should be tracked in or stabilized with netting In open areas vulnerable to wind. TEMPORARY SEEDING PART 1 - GENERAL 1.01 SUMMARY A. Section Includes: 1. Furnishing ell labor, materials and equipment to complete all seeding required to provide temporary protection against wind or water erosion. 1.02 GENERAL NOTES A. Adequate aced bed preparation, use of quality seed, and timely planting are required to achieve a good stand of vegetation to control erosion. Within 48 hours of final grading, the exposed Boll must be seeded and mulched or covered with erosion control matting. PART 2 - PRODUCTS 2.01 GENERAL A.
