HomeMy WebLinkAboutSD-06-70 - Decision - 0095 0099 Holmes Road#S D-06-70 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JANE BOISVERT - BOUNDARY LINE ADJUSTMENT 95 & 99 HOLMES ROAD FINAL PLAT APPLICATION #SD-06-70 FINDINGS OF FACT AND DECISION Jane Boisvert, hereinafter referred to as the applicant, is seeking final plat approval for a boundary line adjustment between 95 and 99 Holmes Road. The Development Review Board held a public hearing on August 15, 2006. The applicant was present at the meeting. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval for a boundary line adjustment between 95 and 99 Holmes Road. 2. The Development Review Board reviewed the sketch plan for this project on July 18, 2006. 3. The owner of record of the subject property is the Estate of Maurice Boisvert. 4. The subject property is located in the Lakeshore Neighborhood Zoning District. 5. The plan submitted is entitled, "Boundary Line Adjustment for Estate of Maurice Boisvert, 99 Holmes Road South Burlington, Vermont", prepared by Tyler Hart. The applicant is proposing to adjust the boundary between the two properties by 15 feet in order to allow a greater distance from the house to the side setback for the property at 95 Holmes Road. This is a minor property line adjustment and results in no substantial change to setbacks, coverages, lot sizes, or other dimensional requirements that would create non-compliance as regulated in the South Burlington Land Development Regulations. Both properties are still in full compliance with the Land Development Regulations. The total acreage conveyed between the properties is .057 acres, increasing the lot size at 95 Holmes Road and decreasing the lot size at 99 Holmes Road. - 1 - #SD-06-70 /� DECISION n �/ Motion by G � L� � 4 _ seconded by M A� 11�C $�O—'to approve Final P Ft Application #SD-06-70 of Jane Boisvert, subject to the following conditions: 1. All approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 4. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the Director of Planning and Zoning.
