Floral Diversity. The wetland at the western end of the drainage swale at this site is characterized by a vigorous stand of common reed (Phragmites australis), a Class B noxious weed under 6 V.S.A., Chapter 84. The wetland also supports gray dogwood (Corpus racemosa), a common species on old fields and damp meadows in the Champlain Valley. The main body of the wetland ca. 150 feet to the west is scrubby wetland typical of those along the railroad in this part of South Burlington. Data taken on the western side of this wetland on 5 June 2002 by our firm (for the VELCO Northwest Reliability Project) shows that part of the wetland is dominated by narrow -leaved cat -tail (Typha angustifolia) and purple loosestrife (Lythrum salicaria), another Class B noxious weed. In summary, this wetland rates poorly in natural native diversity, characterized as it is by species (reeds, cat -tails, loosestrife) that tend to form pure monotypic stands at the exclusion of other species. Wildlife Habitat. Wildlife expected in the wetland 150 feet or so from the encroachment would be typical of disturbed habitats and sites near human activity, limited to small mammals and birds such as red -winged blackbirds. The lack of open water and the proximity of the wetland to commercial and industrial uses, streets and the railroad limit its value for wildlife. Wildlife within the encroachment area would be minimal, if any. Fisheries Habitat. There is no open water or other habitat for fish in this wetland. Ray Belair 7 December 2010 Page 2 Flood/Stormwater Attenuation. The main part of this wetland is in a depression and therefore can store a limited amount of flood- or stormwater, subsequently releasing it into drainage channels that eventually discharge to Lake Champlain near the mouth of Bartlett Brook. Storage capacity is limited, and is restricted to parts of the wetland 150 feet or so from the encroachment, so it was not impacted. Water Quality Protection. The removal of material from the ditch along the south side of the parking lot at 2 Holmes Road prevented the material from washing into the wetland, as noted in previous correspondence (See letter from David Burke, 13 October 2010). Although not designed as a stormwater treatment facility, the ditch has functioned as one, and the removal of material could be regarded as maintenance. Shoreline Protection. There are no "shorelines" associated with this wetland. Groundwater. To my knowledge no groundwater resources were affected by the encroachment in the wetland buffer zone. Aesthetics/Recreation/Education. This wetland is not readily visible from any public vantage point except for the railroad, and because it supports populations of two noxious weed species, it has low aesthetic values. In any event, the encroachment took place outside the wetland and did not affect the its appearance. I visited the site on 22 October, delineating the edge of the wetland to the west and taking notes on vegetation, soils and hydrology. As noted in my letter 1 November, I believe removal of sediments from the ditch and the restoration of banks should be regarded as routine maintenance of an existing man-made structure, and that the action has prevented additional sediments from reaching the wetland west of the site. Under §12.02E, encroachment into the wetland buffer may be permitted if there are positive findings that the encroachment does not adversely affect the ability of the property to carry or store flood waters adequately and that impacts from the encroachment are minimized and/or offset by appropriate landscaping, stormwater treatment, stream buffering and/or other mitigation measures. Based on my analysis of the site, it is my professional opinion that both of these provisions are satisfied at 2 Holmes Road. There is no flood water storage on or near the site, and the removal of fill, rather than adversely affecting the wetland's values and functions, has improved conditions. For these reasons, I recommend after -the -fact approval of the fill removal by the Design Review Board Sincerely, f 3 Errol C. The property owner has been working towards cleaning out debris and sediment from a drainage ditch on the property. This ditch is located within the 50 foot buffer of a Class III wetland on the property and is therefore subject to review under Article 12, Surface Water Protection Standards, of the South Burlington Land Development Regulations. The applicant has submitted a statement from a wetlands expert which has delineated the wetland and wetland buffer, and which provides an assessment of any potential impact the grading and fill work could have on the wetland buffer (see attached memo dated November 1, 2010, from Gilman & Briggs Environmental). The letter correctly states that the DRB may permit encroachment provided that such encroachment: 1. does not adversely affect the ability of the property to carry or store flood waters adequately 2. will not adversely affect the ability of the Stormwater treatment system to reduce sedimentation 3. minimizes impact to the specific wetland functions and values identified in the field report The applicant's wetland expert further testifies that the work in the Class III buffer meets criteria 1 & 2 above. It seems logical that the work in the ditch will aid in some of the function of the wetlands, especially the transport of flood waters and other storm waters. However, the expert should testify that there is no adverse impact to the other function and values of the wetlands. That the wetland is class III and not a state jurisdictional Class II has no impact on this application as the City of South Burlington regulates both classes. Wetland conditions at the site are as follows: The main wetland at issue is a narrow marsh between the site and the railroad. A lobe of this wetland extends toward the site, fed by flow from the ditch which has deposited sediments in a delta -like deposit. Flows tend to flow around the deposit, and there are two principal channels on the north and south sides of the wetland lobe and a less -defined channel down the center. A stand of common reed (Phragmites australis) has become established on this deposit, and because this species spreads via vigorous underground shoots, it has invaded adjacent upland as well. Terraces to the north and south of the lobe, actually topographically lower, are upland. I marked the edge of jurisdictional wetland with eight sequentially numbered flags beginning on the northerly side, The delineation was done in accordance with the 1987 Corps of Engineers Wetland Delineation Manual and the 2009 Interim Supplement. This methodology requires the presence of three criteria for an area to be defined as wetland: hydric soils, wetland hydrology and a predominance of wetland vegetation. I enclose copies of the Corps of Engineers Dataforms documenting my delineation. Encroachment is permitted by the DRB when such encroachment (a) will not adversely affect the ability of the property to carry or store flood waters adequately, (b) will not adversely affect the "ability of the proposed stormwater treatment system to reduce sedimentation according to state standards", or (c) the impact of the encroachment(s) on the specific wetland functions and values identified in field delineation and wetland report is minimized or offset by appropriate landscaping, stormwater treatment, stream buffering , and/or other mitigation measures. An analysis of these provisions at the site shows that the following: Under (a), above, there is no flood water storage capacity at or near the site, so this provision does not apply. (b) does not apply because no stormwater treatment system is proposed; As noted on Page 1, the stand of common reed has become established on a "delta -like deposit" formed from sedimentation discharged from the ditch. The action at issue was removal of sediments that had built up in the ditch, thereby reducing eventual transport into the wetland. Mr. Belair said staff has no problem with this. He also noted it is unusual to have this much excess. Belai , ministrative Officer Re: September 21, 1999 agenda items Date: September 17, 1999 1) OTHER BUSINESS John and Marlene Stephens are requesting a six (6) month extension (see enclosed) to the variance granted them by the Zoning Board of Adjustment on 4/12/99 (effective 4/26/99). The variance granted was to demolish an existing residential dwelling and detached garage, and replace with a 35' x 48' two story dwelling unit located within nineteen (19) feet of elevation 102.5 feet of Lake Champlain and a detached 24' x 30' two story garage with guest quarters (living room, bedroom and bath) to within four (4) feet of the front yard and one (1) foot of the northerly side yard, located at 5 Austin Road (see enclosed decision). This variance was needed because the property is located within the C.O. District along the lake. 2) CONSENT AGENDA a) OVERNITE TRANSPORTATION COMPANY - FUEL TANK - SITE _PLAN This project consists of the installation of a 3,000 gallon above ground diesel tank and pump on a property developed with an 8400 square foot truck terminal. This property located at 2 Holmes Road lies within the C2 District. It is bounded on the north by Holmes Road, on the east by commercial buildings, on the south by an auto dealership, and on the west by the railroad r.o.w. Access/circulation: Access is provided by a 44 foot curb cut on Holmes Road. This property also has a r.o.w. which connects the dealership property to the south with Holmes Road. No changes proposed. Circulation on the site is adequate. Memorandum September 21, September 17, Development Review 1999 agenda items 1999 Coverage/setbacks: Coverage will not change as a result of this application. Setback requirements are met. Parking: No additional parking spaces required. Existing parking is adequate.
