Re: Findings of Fact, application of Nile & Julie Duppstadt and John & Deborah Allen to
terminate protective covenants for a seven (7) lot subdivision approved on 1/15/80 and 8/9/83
known as the Paul K. French, M.D. subdivision located at 1550 Hinesburg Road.
On the 171h day of August, 1999, the South Burlington Development Review Board approved the
termination of the protective covenants for a seven (7) lot subdivision approved on 1/15/80 and
8/9/83 known as the Paul K. French, M.D. subdivision located at 1550 Hinesburg Road under
Section 204 of the South Burlington Subdivision Regulations based on the following findings:
1. This project consists of the termination of protective covenants for a seven (7) lot subdivision
approved by the Planning Commission on 1/15/80. These seven (7) lots were subdivided by the
CnmmjSSlnn nn 7/15/Q7 into 52 lots and resubdivirded into 55 hots on 4/28/98. Sinre the 55 lot
subdivision supersedes the seven (7) lot subdivision, these covenants are no longer necessary.
The Chairman of the Development Review Board will be required to sign a legal document
approved by the City Attorney which terminates the covenants.
2. The owners of record of this property are Nile & Julie Duppstadt and John & Deborah Alden.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approved
the termination of the protective covenants for a seven (7) lot subdivision approved on 1/15/80
and 8/9/83 known as the Paul K. French, M.D. Subdivision located at 1550 Hinesburg Road.
These covenants are recorded in Volume 157, pages 502-505 of the land records.
The Development Review Board authorizes the Chair to sign the legal document approved by
the City Attorney to terminate the covenants.
