HomeMy WebLinkAboutSD-96-0000 - Decision - 1545 Hinesburg RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Jacqueline Marceau to subdivide a 45 acre parcel into two (2) parcels of 10.8 acres and 34.2 acres, 1545 Hinesburg Road. On the 7th of May, 1996, the South Burlington Planning Commission approved the request of Jacqueline Marceau for preliminary plat and final plat approvals under Sections 203 and 204 of the South Burlington Subdivision Regulations respectively based on the following findings: 1. This project consists of the subdivision of a 45 acre parcel into two (2) lots of 10.8 acres (lot #2) and 34.2 acres (lot #1). The 10.8 acre parcel is developed with a single family dwelling. The sketch plan was reviewed at the April 9, 1996 meeting. 2. This property located at 1545 Hinesburg Road lies within the SEQ District and the Dorset Park South View Protection Zone. It is bounded on the north by a single family residence and undeveloped land owned by the applicant, on the east by Hinesburg Road, on the south by a single family residence and undeveloped land, and on the west by undeveloped land. 3. Access: Access to the 10.8 acre parcel is via a driveway to the house and barn. Access to the remaining 35 acre parcel, which will not have frontage on a public street, will be via a 60 foot r.o.w. from Hinesburg Road. 4. Lot size/frontage: The minimum frontage requirement of 100 feet will be met by the 10.8 acre parcel. The remaining 35.2 acre parcel will not have any frontage. 5. Development/restricted areas: A portion of the 10.8 acre parcel lies within a designated restricted area. Section 6.502 of the zoning regulations allows the creation of this lot since no new lots are being created for residential development in the restricted area. 6. Scenic View Protection: This property is located in the Dorset Park View Protection Zone. Nothing is being proposed which would violate height requirements. 1 DECISION & CONDITONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the preliminary and final plat applications of Jacqueline Marceau to subdivide a 45 acre parcel into two (2) parcels of 10.8 acres and 34.2 aces, 1545 Hinesburg Road, as depicted on a two (2) page set of plans, page one (1) entitled "Property Plan, Edward & Jacqueline Marceau, 1545 Hinesburg Road, South Burlington, Vermont," prepared by William A. Robenstein, dated 4/19/96, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat shall be revised to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plat shall be submitted to the City Planner prior to recording. a) The plat shall be revised to include the stamp and signature of the land surveyor. 3. Any change to the plat shall require approval by the South Burlington Planning Commission. 4. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void.
