HomeMy WebLinkAboutCU-83-0000 - Decision - 2000 Hinesburg Road (2)ZONING BOARD OF ADJUSTMENT JANUARY 24, 1983 The South Burlington 'Zoning Board of Adjustment held a regular meeting on Monday, January 24, 1983 at 5:00 pm in the Conference Room, City Hall, 575 Dorset St. Members Present Everett steed, Chairman; Alex Guyette, Fred Blais, James Thibault Members Absent Norman Campbell, James McClary, John Dinklage Others Present Richard Ward, Zoning Administrator; Ernest & Mildred Auclair No. 1 Appeal of Ernest Auclair Appeal of Ernest Auclair seeking approval from Section 6.30, Conditional uses and Section 18.113 Dwelling standards of the South Burlington Regulations. Request is for permission to convert the basement of an existing building into two apartments containing approximately 600 sq. ft. and maintain existing tack shop on other two levels, at 2000 Hinesburg Road. Mr. Ward said the area was zoned AgR-Rural and that additional dwellings for farm employees were conditional uses. Section 18.113 of the ordinance sets forth a minimum size of 850 sq. ft. per dwelling unit and 600 sq. ft. is proposed here. The basement area would be converted into two apartments - existing in the basement is a kitchen and bathroom. The first and second floors of the building will continue to be used as a tack shop and dance apparel shop. The building is 36' x 44', three stories tall, and has a 10' x 18' entrance. Usable area in the basement is 31' x 39'. Mr. Ward noted that the ordinance required Planning Commission input on this type of use, and on January 4, the Commission reviewed and approved this plan. The Auclairs told the Board that one side of the basement would be used to house farm help, and the other side would be used as an area to babysit children of tack shop employees. The apartments are not large enough to house more than just a couple. The Auclairs had no problem with a stipulation that the apartments be just for farm help, as long as the tack shop was considered part of the overall farm operation, as the Board felt it was. Mr. Thibault moved that approval be with the stipulation that the apartment be used for farm employees only. Mr. Guyette seconded the motion and all voted for it. The appeal was granted unanimously, as per stipulation. Minutes of December 27, 1983 The December 27, 1983 minutes were approved on a motion by Mr. B1ais, a second by Mr. Guyette and a unanimous vote. The meeting was adjourned at 5:10 pm. On or about December 20, 1982 we noticed construction at the tack shop, this is in direct violation of the City's zoning. We must inform you that continuation of the remodeling will result in the City's having to take legal action. Because the area does not permit multi -family you would be required to obtain a variance. I suggest that you contact this office to discuss this matter. PLANNING COMMISSION Other business JANUARY 4. 1983 Mr. Spitz introduced Mr. Barry Carris, the city's new representative to the Regional Planning Commission. Mr. Poger encouraged him to let the Commission know what was happening in the regional commission, not only after it happened, but before, by letting the Commission know what was on the agenda. It was noted that if Mr. Carrie desired to do so, he could be put first on the agenda, so he would not have to sit through an entire Commission meeting. Mr. Mona felt Mr. Carris should receive this Commission's minutes. Mr. Spitz noted that in the new zoning ordinance there was a section in the AgR district which allowed additional dwellings for farm employees as conditional uses with Commission input. He noted that on the Auclair farm there was a tack shop and the basement is going to be converted into 2 600 sq. f t. apartments for farm employees. The Commission felt that would be all right, but a stipulation that the apartments be only for farm employees was mentioned. Mr. Spitz said he was thinking about having two separate funds of sewer capacity as part of the sewer policy. He noted that residential requires a lot more capacity than industrial or commercial. Mr. Poger felt he should bring in a proposal for a separate fund. The meeting was adjourned at 9:30 pm. Clerk
