MINOR LOT LINE ADJUSTMENT APPLICATION #AD-18-03
FINDINGS OF FACT AND DECISION
Ernest N. Auclair Family Trust, hereinafter referred to as the applicant, is seeking
approval to remove a recently approved water line easement running between lots
#2 & #3, 1731 Hinesburg Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the follow:
FINDINGS OF FACT
1. The applicant is seeking approval to remove a recently approved water line
easement running between lots #2 & #3, 1731 Hinesburg Road.
2. The owner of record of the subject property is Ernest N. Auclair Family Trust.
3. The subject property is located in the Southeast Quadrant Neighborhood Residential
District.
4. The application was received on June 28, 2018.
5. The subject properties consist of two (2) lots of approximately 15 acres (Lot#3), and
approximately 117 acres (Lot #2).
6. The plan set submitted consists of two (2) pages, page one (1) is entitled,
"Subdivision Plat for Ernest N. Auclair Family Trust Parcel ID# 0860-01751 Vermont
Route 116, Hinesburg Road South Burlington, Vermont", prepared by Trudell Consulting
Engineers, dated 3/20/18, and last revised on 06/20/18.
DIMENSIONAL REQUIREMENTS
7. All area and dimensional requirements will continue to be met for both lots.
PURSUANT TO SECTION Z5.Z9(B) OF THE LAND DEVELOPMENT
REGULATIONS;
NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT.
8. The removal of the water line easement between the lots involved will not result in
the creation of any new lots.
THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT
PROPERTY OWNERS.

9. The water line easement removal will be between the same property owners.
THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION OF
A NON -CONFORMING LOT, STRUCTURE OR USE.
10. No lot lines will be relocated.
THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED
FROM PRIOR MUNICIPAL APPROVAL.
11. This water line easement removal does not violate any conditions of any prior
approvals.

12. The plat should be revised to: 1) include the signature of the land surveyor, and 2)
replace "Development Review Board" and "Chairman or Clerk" with "Administrative
Officer" in the resolution statement.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Minor
Lot Line Adjustment Application #AD-18-03 of Ernest N. Auclair Family Trust, for
removal of a recently approved water line easement running between lots #2 & #3,
1731 Hinesburg Road, subject to the following conditions:
1. All previous municipal approvals and stipulations which are not superseded by this
approval will remain in effect.
2. This project must be completed as shown on the plat and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plat must be revised to show the changes below and will require approval of the
Administrative Officer. Three (3) hard copies of the approved revised plat must be
submitted to the Administrative Officer prior to recording the final plat plan.
a. The plat must be revised to: 1) include the signature of the land surveyor,
and 2) replace "Development Review Board" & "Chairman or Clerk" with
"Administrative Officer" in the resolution statement.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The final plat plan shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Administrative Officer prior
to recording. Prior to recording the final plat plan, the applicant shall submit a copy

of the survey plat in digital format. The format of the digital information shall require
approval of the South Burlington GIS Coordinator.
6. Any change to the plat plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
