#2 Castlerock Condominiums - a suggested motion of approval has
been prepared, for circulation at the meeting.
#3 Trono Construction Final Plat - with the exception of some
minor engineering details and finallized legal documents, all is
in order on this application.
#4 DesLauriers Final Plat - The Commission's requests, to plot
the centerline of the brook on this lot, plus show a schematic
layout for the "backland", have been complied with.
#5 Hickok & Boardman / Flanders Lumber Final Plat- this proposal,
as you may recall, is for 150 two bedroom condominiums to be
built in 4 phases on the so called Brand Farm, directly west of
Twin Oaks Tennis Center. The first two phases have received final
approval and now that there is adequate sewage capacity, the final
two phases are being submitted for approval. As a result of Act
250, measures for minimizing erosion have been substantially ex-
panded. In addition, the overall landscaping plan is being presented.
There have been some rearrangements of parking and building locations.
No substantive issues have arisen, although the revised plan is being
reviewed by the Tree Committee and the Fire Chief. Approval for
Phase I has expired, but should be renewed , as the developer's
timetable was retarded by an unexpectedly long A250 review process.
#6 Nadeau Final Plat all is in order.
#7 Day Care Center Site Plan - this proposal received conditional
use approval from the City Council, under the interim zoning reg-
ulations, on 8/21/78. The day care center is accompanied on this
site by a wholesale music store and 2 apartments. In approving this
plan, the Council stipulated that screening be erected and that the
approval will last 1 year (another review will be necessary if this
use is to continue). Since no construction is involved and there are
some outstanding large trees on site, no landscaping is necessary.
With regard to access, I feel that there are no practical alter-
natives to the present scheme that would be a net improvement. As
far as parking and circulation are concerned a modest widening of
the turnaround would be helpful - otherwise, I see no practical
alternatives.

Mr. Goddette said that with each piece of equipment came several
volunteers in cars that they needed to park.
Air. Peter Collins, who represented the developers, read the April, 1977
letter from the Chief to the then Chairman of the Commission,Bill Wessel,
which stated that if certain measures were taken, and they have been, the
project could be adequately protected.
The Commission wrestled further with this issue. Mir. Goddette felt
that there was a serious problem with the development which would not allow
the fire department to give it good protection. It was suggested that the
Chief and the developer meet and come back in two weeks with an agreement
between them or an agreement to disagree and a written statement by both
of their positions and what each of them wanted to see. Mr. Woolery
did not like that idea because he felt the Chief would never get the optimum
situation, bc u,re this project was not totally unsafe, and because this project
had been around so long and delayed so much. He felt the project had already
been reviewed and rereviewed.
IAr. Collins felt it was a mistake to reopen a settled thing.
Yr. Poger said that it should be reopened if it was important enough or
if it were going to create a situation which could lead to a catastrophe.
He noted that the Council had also requested that the Commission listen to
the paid staff in the city.
Yr. Curtis said that they had received a storm water discharge permit
from the District Environmental Commission based on the amount of blacktop
there would be and that if they added blacktop by connecting parking lots,
they might have to get another one, which would take at least 90 days and
would seriously affect the project. They are trying to build a project with
a low final price and it is hard to keep their expenses down under normal
conditions.
Mr. Woolery objected to holding the developers up any more and said it
was not fair to change things in the middle of the game.
Mr. Jacob arrived at this time.
Mr. Ewing moved to continue the public hearing until 2 weeks from
tonight, September 26, 1978, at City Hall, at 7:30 pm. The motion was
seconded by Mr. Jacob and passed with only Mr. Woolery voting no.
Public hearing on final plat application of Leo Nadeau for a 1 lot subdivision,
south and west of 1549 Hinesburg Road
Mr. Page showed the Commission where the lot was. He said that the
State Highway Department approved the application to enter the state highway (Hite ss$jrg
as long as the brush which restricts sight distance at this point is cleared
loa
by the applicant and remains cleared. He said that a plan to straighten
the road along this section of road had been temporarily shelved by the
Highway Department but would be done some day. This would improve the
sight distance.
Mr. Woolery moved that the South Burlington Planning Commission approve
the final plat a -lication of Leo and Joan Nadeau as depicted on the plan
of record, drawn by John Marsh, dated 8 22 78, subject to the following
stipulations:
1. The final plat shall be recorded within 90 days.
2. The recreation fee is waived.

Intersection shall be performed prior to occupancy, to the satisfaction of
the City Engineer.
The motion was seconded by Mr. Levesque and passed unanimously. Mr. Levesque
said that he did not like creating 10 acre lots. Mr. Poger agreed and said
that the Commission should look into the zoning of the Southeast Quadrant.
Mr. Erring did not like 10 acre lots at the ends of private roads either.
Site Plan Review, proposed day care center, 950 Shelburne Road
Ronald Schmucker represented the applicants, and said that they had
received approval from the City Council under Interim Zoning to start a
day care center. Ms. Woodward felt that the problem with this plan was the
traffic situation. She planned to encourage car pooling and in addition
planned to deliver one half of the children herself. She will start the
center with 20-25 children and take on more in January or February. Children
will be delivered no later than 7:30 and picked up no earlier than 5:20-5:30.
Ms. Woodward did some traffic studies on day care centers in the area and
found that these hours would be before and after the worst times of the day
for traffic on the roads.
The children will be in the center for a full day so there will be no
in and out traffic at all times of the day. Mr. Schmucker said that they
would like to hire someone to do a study of the internal traffic flow after
the center has been in operation for some time. The students currently
living in apartments in one of the buildings will leave so that there will
be less traffic during the day than there is now.
In short, due to carpooling and Ms. Woodward's bussing, they feel that
they will have little impact on the traffic situation and they also think
that a lot of the people dropping children off there will be on the road
anyway. Mason's Pianos and Organs no longer does any teaching, he is mainly
in the business of service and repair, so there are few cars coming there.
When all the renovations are done, there will be Mason, the d 4 care center,
and a few apartments on the lot.
Nis. Woodward said that the students would be leaving gradually and
would not be there through the winter and she has made sure the children
will not be in the parking areas.
Kr. Woolery said that access from Brewer Parkway would be something
to think about doing in the future.
Mr. Woolery moved that the South Burlington Planning Commission approve
the site plan application of ALrthur Mason and Sharon Woodward, to operate
p day care center at 938-950 Shelburne Road, as depicted on the plan of
record, subject to the following stipulations:
1. The radius of the turnaround shall be expanded to facilitate
circulation, as approved by the City Engineer.
2. The delivery and pick up of children shall be restricted to hours
which do not coincide with the peak roadway hours of Shelburne Road, i.e.,
7:30-8:30 am, 11 am - 1 pm, and 4-5:15 pm.
3.This plan shall be reviewed 4 months from this date by the City Planner
to evaluate the adequacy of access, circulation, and parking. Based on
this evaluation, the Commission shall be free to terminate, extend, or allow
expansion of this use. Further evaluation as directed by the Citv Counci]
will occur one year from this date.
