Re: Findings of Fact, application #M5-02-07 of Jacqueline Marceau to build within the
restricted area defined in the Southeast Quadrant Map under 5ection 6.501 (h) of the
5outh Burlington Zoning Regulations. The applicant proposes constructing a single-
family residence entirely within the restricted area, 1485 Hinesburg Road.
On the 17' day of December 2002, the South Burlington Development Review Board
approved the request of Jacqueline Marceau for approval under 5ection 6.501 (h) of the
South Burlington Zoning Regulations based on the following findings:
1. This project consists of a request of a request to construct a single-family
residence within the restricted area, 1485 Hinesburg Road.
2. The owner of record of this particular property is Michael Marceau and Mary
Lavigne.
3. This property located at 1485 Hinesburg Road is within the Southeast Quadrant
Zoning District on an undeveloped parcel partially in the restricted area. The
parcel is bounded by single-family dwellings on the north, east and south, and by
undeveloped land on the west.
4. Criteria of 5ection 6.501 (h)
The applicant submitted a letter dated December 16, 2002 from Alan Elwood,
the applicant's engineer, indicating that the septic system must be located in
the developable area and the house located in the restricted area.
5. Access/Circulation: Access is provided via a single 20 foot wide curb cut on
Dorset 5treet. Circulation is not an issue.
6. 5etbacks: The building envelope meets all setback requirements.
PEC15ION & CONDITIONS
Based on the above Findings of Fact, the 5outh Burlington Development Review
Board approves application #M5-02-07 of Jacqueline Marceau to build within the
restricted area defined in the Southeast Quadrant Map under 5ection 6.501 (h) of
the 5outh Burlington Zoning Regulations. The applicant proposes constructing a
single-family residence entirely within the restricted area, 1485 5helburne Road, as
depicted on a two (2) page set of plans with a stamped received date of December 11,
2002, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval
Shall remain in effect.
2. Iursuant to 5ection 6.606 of the zoning regulations, the Board finds that the
proposed development activity complies with the criteria under 5ection 6.606
(a) — (d) of the zoning regulations.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to
5ection 27.302 of the zoning regulations or this approval is null and void.
4. Any change to the site plan shall require approval by the South Burlington
Development Review board.
5. Access to this lot shall be changed to through the Marceau Meadows
develo merit when it is constructed.

this decision is issued. The fee is $150.00. If you fail to appeal this decision, your
right to challenge this decision at some future time may be lost because you waited
too long. You will be bound by the decision, pursuant to 24 V5A 4472 (a) (exclusivity
of remedy; finality).
