I could have applied for a one (1) year extension, but my engineer only applied for a six(6) month. Please consider granting me this extension. Thank you. Condition 13 of their decision requires that a zoning permit be obtained within 6 months of the approval, which is dated November 16, 2016. Therefore, a zoning permit must be obtained by May 15, 2017. Although the applicant plans to proceed with construction in the near future, it will not be possible to complete the various other prerequisites and obtain the zoning permit prior to May l5tn. We are requesting that the Development Review Board grant a 6 month extension for obtaining the zoning permit. We understand that you have received the final plans, mylar for recording, and Notice of Condition, satisfying the various other conditions of approval requiring the submittal of information prior to applying for the zoning permit. Belair, Administrative Officer SUBJECT: SD-16-30 1408 Hinesburg Road — Mary Jo Capotrio DATE: November 21, 2017 Development Review Board meeting Mary Jo Capotrio (applicant) is requesting a six (6) month extension to the requirement in her subdivision approval issued on 11/16/16 by which she must obtain a zoning permit to construct the approved two-family dwelling. On 4/18/17 the DRB approved a six (6) month extension, at the applicant's request, which extended the life of the project to 11/16/17. Prior to this expiration date, the applicant submitted a request for another six (6) month extension which would extend the approval to 5/16/18. The relevant provision is below. (a) The Development Review Board or Administrative Officer has approved a request for extension of the approval. The Board or Administrative Officer may approve one (1) extension to an applicant of an approval if reapplication takes place before the approval has expired and if the Board determines that conditions are essentially unchanged from the time of the original approval. In granting such an extension, the Board or Administrative Officer may specify a period of time of up to one (1) year for the extension. The issue with this request is that Section 17.04 (B) (c) of the LDRs limits the number of extensions which can be granted to only one (1) and this request would be the second request. Although this provision does allow for a one (1) year extension, the applicant had only requested a six (6) month extension when a one (1) year extension would have been allowed. Before submitting the final plans to Planning & Zoning, I wanted to confirm that we had addressed your comments on the plans (PDFs attached). The LOD have been pulled as close as possible toward the driveway and existing sewer service near the easterly driveway. As noted below, the location/need to connect to the existing sewer service is driving the extent of the disturbance on the east side of the driveway. We have added a note to sheets 2 & 3 requiring the westerly driveway to be used for construction access, since it is located further from the existing trees, and should require less pruning for construction vehicles. The trees will still need to be pruned for the westerly driveway, but to a lesser extent since no large construction vehicles will be using this drive. Timing of construction is still not certain. I think they will proceed as soon as they can obtain a zoning permit (which must be within 6 months). However, the State Wastewater and Potable Water Supply Permit still needs to be issued. The earliest that construction would start is the beginning of January. At least the westerly tree should be pruned for a vehicle height of 13.5 feet, since construction vehicles will be near this maximum allowable height. The easterly tree should be fine for 10 feet clearance (no construction vehicles). Please let me know if the attached plans are acceptable. We will then submit the final revised plans to Planning & Zoning. Hi Craig — Thanks for the quick turnaround on the review. The limits of disturbance next to the new driveway for the easternmost oak is related to the location of the existing sewer service to the single family home. We've located it horizontally, but don't have a depth on the existing sewer service as it approaches Dubois Drive. If possible, the tie-in between the relocated service and existing service can be moved south onto the lot and away from the oak tree. We won't know if this is possible until the existing sewer service is dug up and exposed in this area (at a location that is away from the tree). We will let you know as soon as the schedule is determined, for both pruning and whether work will be done on frozen ground. Either way, if the westerly driveway was used for construction traffic it would reduce the pruning clearance needed for the eastern drive, and limit compaction associated with construction traffic in that area. The eastern drive could be constructed last, just prior to occupancy of the home so that construction traffic is limited to the westerly driveway. I'd suggest moving the protective barrier for the easternmost oak as close to the proposed drive as possible to minimize soil compaction and root disturbance. If the work is done when the ground is frozen that would help. If the ground isn't frozen, spreading 6-8 inches of wood chips over geotextile fabric or laying down plywood or M inch hdpe mats(alturnamats) would help distribute weight and reduce compaction. Ideally construction activity would be no closer than 15 feet from the trunk of a tree this size, but I think you should be alright if you minimize the area impacted. If you notify me once the project is approved, I'll schedule pruning to raise the lower crown of the tree. Grantors retain the development rights for all of Grantors' retained lands depicted on the proposed above -referenced plans (other than the Sending Property), subject to such modifications that may occur under the Land Development Regulations. If, prior to the Sending Property being developed to the maximum density authorized by Grantors retained Development Rights, the City modifies its Regulations to reduce the development potential of the 5.72 acres for which Grantors retained Development Rights, then Grantors shall forfeit said Development Rights. Upon such forfeiture, Grantors shall have the right to develop the Sending Property to the extent authorized by the Regulations in effect. In addition to the retained Development Rights discussed above, Grantors retain the right to utilize any increase in the development potential of the remaining acres of the Sending Property attributable to changes in the Regulations that allow development to occur at a density greater than that available under the Regulations. The property interests being conveyed by this Density Reduction Easement consist solely of the transfer of Developments Rights from the Sending Property to the Receiving Property (defined below) and in all other respects, Grantors shall retain the fee title to the Sending Property, subject to the following covenants and restrictions which are imposed for the benefit of the public pursuant to 10 V.S.A. Chapter 155 and shall run with and bind the Sending Property in perpetuity: (a) There shall be no construction or placing of any buildings or structures of any kind, temporary or permanent on the Sending Property, except the Grantors, their heirs, successors and assigns, shall have the right, subject to approval under the Land Development Regulations, where applicable, to construct non-residential structures with related access drives and utilities on the Sending Property necessary for storage of equipment and materials used in connection with agricultural or forestry activities on the Sending Property or adjacent lands of the Grantors, their heirs, successors and assigns. (b) There shall be no filling, excavating, dredging, mining or drilling, removal of topsoil, sand, gravel, rock, minerals or other materials, nor any building of roads or change in the topography of the land in any manner. (c) Grantors, their heirs, successors and assigns, shall have the right to maintain the Sending Property in an orderly and presentable manner including the right to utilize the Sending Property for agricultural and forestry purposes, plant trees and shrubbery, to keep the fields mowed and to take any other normal action in maintaining the appearance of the open space. (d) There shall be no dumping of ashes, trash, garbage, or other unsightly or offensive material, and no changing of the topography through the placing of soil or other substance or materials such as landfill. (e) There shall be no operation of dune buggies, motorcycles, all -terrain vehicles or any other types of motorized vehicles on the Sending Property, except: (1) snowmobiles; and (2) motorized vehicles used for the maintenance of the Sending Property for the purposes described below or for forestry or agricultural purposes. Grantors, their heirs and assigns, shall have the right to clear, construct and maintain trails for non-commercial snowmobiling, walking, bicycling, horseback riding, skiing, and other non-commercial, recreational activities within and across the Sending Property, all in a manner consistent with these open space provisions. (f) There shall be no activities or uses on the Sending Property which shall be detrimental or could be detrimental to drainage, flood control, water conservation, fish and wildlife or habitat preservation. Grantors hereby grant solely and exclusively to the City of South Burlington (1) the right of official representatives of the City, in a reasonable manner and at reasonable times, to enter and inspect the property; and (2) the right to enforce, on behalf of the public, by injunction or proceedings at law or in equity, the above -stated covenants. Nothing stated herein shall be interpreted to grant the public any right of access to the Sending Property. All rights retained by the Grantors, as above -described, shall run with the title to the Sending Property and shall be transferred automatically to any successor fee owner of the Sending Property. If the Land Development Regulations are hereafter changed in a way that ascribes development potential to the Sending Property on any basis other than that described above, the City shall implement the terms of this easement by developing a method to equate the above -described development potential to the new development potential.
