Mr. Farley seconded. Motion passed unanimously. 3. Miscellaneous Application #MS-10-01 of City of South Burlington for after -the - face approval to alter the existing grade for the construction of storm water improvements, 1175 Hinesburg Road: Mr. DiPietro said they received approval in April but didn't get a zoning permit within the allowable time. There are no changes to the plan. Ms. Quimby moved to approve Miscellaneous Application #MS-10-01 of City of South Burlington subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed 6-0. 4. Preliminary Plat Application #SD-10-02 of Bullrock Corporation to amend a previously approved planned unit development consisting of five multi -family dwellings for a total of 160 units and a 40-unit congregate housing facility. The amendment consists of constructing a 100-unit assisted living facility, 250 Quarry Hill Road: --- Mr. Roy indicated that they did float the balloons on the site for people to observe. He showed what the balloons indicated and which "balloon scenario" they are proposing. He testified that the peak of the roof will be 387 feet above sea level. Mr. Dinklage asked why a peaked roof instead of flat. Mr. Roy said it allows them to put all the mechanicals inside. It also matches the building across the street. February 2, 2010 The City of South Burlington is seeking miscellaneous after -the -fact approval for alteration of the existing grade for the construction of stormwater improvements, 1175 Hinesburg Road. The applicant received approval for the project on August 5, 2008 but did not get a zoning permit within the specified six months but constructed the improvements. This project is a re- application. There have been no changes to the proposed plans. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. 575 Dorset Street South Burlington, VT 05403 tel 802.846,4106 fax 802.846.4101 www,sburi.com Agenda # 3 The applicant submitted a plan, containing one (1) sheet showing the removal of the fill and subsequent re -grading on the subject property. This plan is sufficient to satisfy this requirement. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. Staff does not feel this requirement is applicable to the subject application as the retention pond is proposed to be permanent. (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing drainage, and other appropriate measures. The applicant is proposing to install a stormwater management pond. The South Burlington Stormwater Superintendent is overseeing the proposal and it shall be completed to his satisfaction. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the existing grade. After a cursory review of your plans, I had several concerns that I would like you to address. 1. The access road, to the swale behind #20 Oak Creek, goes directly over areas that have puddled after heavy rains since I moved to 18 Oak Creek Drive in 1992. That is the low point of the property, and rain water collects in that area. This year, the entire piece of land behind my property is a swamp. I do not want your road construction to increase the water table around my home. What measures will you take to prevent this? What type of materials will be brought in and added? What type of grade changes will be made? How will the construction affect the pooling of the water? Where will it now flow? Removing grass and plants affects water absorption. How will that be countered? I cannot afford to take on the water that is displaced by your construction project. 2. The following is hearsay, but the original owner of #20 Oak Creek once told me that he saw perimeter drainage pipes from the building of #16 Oak Creek laid across the rear lot to empty near the swale. If any such PVC pipes were dug up, would they be replaced, or be left to empty more water behind my property? 3. The fencing and berm were installed to offer a sound and privacy buffer from the Hinesburg Road traffic. I was not sure if you were planning to dig through the berm or to remove the fencing to put in the access road. Which were you removing, and how would you restore the sound and privacy protection that you removed? 4. The last question relates to esthetics. How would you keep the area from being an eyesore? What type of fencing material would you be using, and would there be landscaping? 5. When did you plan to begin the project, and how long did you expect the construction to last?
