HomeMy WebLinkAboutSP-93-0000 - Decision - 1150 1170 Hinesburg RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN J CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Doug Griswold/S.T.Griswold to operate a quarry for removal of 2.5 million cubic yards of crushed stone. On the 8th of June, 1993, the South Burlington Planning Commission approved the request of Doug Griswold/S.T. Griswold for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the expansion of the Green Acres quarry to a maximum of 23.07 acres and the removal of 2.5 million cubic yards of crushed stone. The Planning Commission on 2/24/87 approved an expansion to this quarry and the construction of an access road. 2. The Zoning Board of Adjustment has held one hearing and will be holding another hearing on 6/14/93 on the applicant's request for a resource extraction operation. This approval should be conditioned on the Zoning Board's approval. 3. This property is located in the Industrial & Open Space District. It is bounded on the north by I-89, on the west by Lane Press and the Green Acres industrial subdivision and on the south and east by Muddy Brook. 4. Access/circulation: Access will be via an existing road through the Town of Williston. No access will be available through South Burlington. Circulation is acceptable. 5. Coverage/setbacks: Due to the nature of this operation, these items are not applicable. 6. Parking: There are no minimum parking requirements for this type use. Three (3) parking spaces will be provided for the two (2) employees who will be on the site. 7. Landscaping: There is no minimum landscaping requirement for this project and no landscaping is being proposed. The reclamation plan calls for seeding the fringe of the quarry area but no new plantings are proposed. The quarry area will be screened from the south and southeast by existing trees. 8. Traffic: There will be no additional traffic generated in South Burlington from this project. 1 9. Sewer: No sewer allocation needed. The applicant will provide the employees with a port-o-let. 10. Lighting: There will be no exterior lighting. 11. Wetland: The quarry is classified as a class II wetland by the State and is therefore regulated. The applicant has contacted the State and is requesting that they make a determination that it does not fit the definition of a wetland and is therefore not regulated. If they are unable to convince the State that it should not be regulated, they will need a State permit before it can be drained. 12. Performance Standards: This project's conformance with the Performance Standards contained in Table II of the zoning regulations relating to fire and explosion hazards, vibration, noise, dust, etc. will be evaluated by the Zoning Board of Adjustment as part of the conditional use review. 13. Other: --- sheet SP4 must be revised to reflect the revised sheet SP2. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Doug Griswold/S.T. Griswold to operate a quarry for a removal of 2.5 million cubic yards of crushed stone as depicted on a seven (7) page set of plans, page one entitled "Griswold Quarry, South Brownell Road", prepared by Trudell Consulting Engineers, Inc. and dated 3/30/93, with the following stipulations: 1. This site plan approval shall not be construed as a conditional use approval for a resource extraction operation. The decision of whether or not to grant a conditional use approval shall be made by the Zoning Board of Adjustment. 2. Plan sheet SP4 shall be revised prior to issuance of a zoning/building permit to be consistent with plan sheet SP2. Three (3) copies of the revised plan shall be submitted to the City Planner prior to permit issuance. 3. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 4. Any changes to the site plan shall require approval by the South Burlington Planning Commission. 2 5.
