FINAL PLAT APPLICATION #SD-08-06
FINDINGS OF FACT AND DECISION
CEA Properties, LLC, hereinafter referred to as the applicant, is seeking to amend a
previously approved planned unit development consisting of three (3) 7200 sq. ft.
general office buildings and a 1000 sq. ft. detached accessory structure. The
amendment consists of a waiver to increase the height of the detached accessory
structure by 1.2 feet for a total height of 16.2 feet, 10 Mansfield View Lane.
The Development Review Board held a public hearing on Tuesday, February 19, 2008.
David Marshall represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1) The applicant is seeking to amend a previously approved planned unit
development consisting of three (3) 7200 sq. ft. general office buildings and a
1000 sq. ft. detached accessory structure. The amendment consists of a waiver
to increase the height of the detached accessory structure by 1.2 feet for a total
height of 16.2 feet, 10 Mansfield View Lane.
2) The owner of record of the subject property is CEA Properties, LLC.
3) The subject property is located in the Industrial & Open Space (10) Zoning
District.
4) The plans submitted consist of a two (2) page set of plans, page one (1) entitled,
"CEA Office Planned Unit Development Lot 1A Meadowland Business Park
South Burlington Vermont Site Landscaping Plan", prepared by Civil Engineering
Associates, dated Feb., 2007.
5) The detached accessory structure has already been reviewed by the Board as an
element of the existing planned unit development. Section 3.10 of the South
Burlington Land Development Regulations states that accessory structures shall
not exceed fifteen feet in height. This application seeks to increase the height of
the accessory structure by 2.4 feet, or 1.2 additional feet to the mid point of the
eaves, for a total height of 16.2 feet.
6) The applicant has submitted a letter dated January 28, 2008 detailing their
reasons for this request, as well as an elevation of the structure.

7) The Board has no concerns regarding this request but will require that the
elevations be revised to show the total height of the structure, as well as to detail
the height of the structure from the pre -construction grade to the mid point of the
eaves.

approve Final Plat Application #SD-08-06 of CEA Properties, LLC, subject to the
following conditions:
All previous approvals and stipulations shall remain in full effect, except as
amended herein.
2. This project shall be completed as shown on the plat submitted by the applicant,
and on file in the South Burlington Department of Planning and Zoning.
3. The plans shall be revised to show the changes below and shall require approval
of the Administrative Officer. Three (3) copies of the approved revised plans
shall be submitted to the Administrative Officer prior to permit issuance.
a. The elevations depicting the accessory structure shall be revised to detail
the total height of the structure as well as the height of the structure from
the pre -construction grade to the mid -point of the eaves.
4. The Board approves a height waiver of 1.2 feet for the detached accessory
structure for a total height from pre -construction grade of 16.2 feet.
5. Any change to the final plat plan shall require approval of the South Burlington
Development Review Board.
