FINAL PLAT APPLICATION #SD-08-37
FINDINGS OF FACT AND DECISION
East Mountain View, LLC, hereafter referred to as the applicant, is seeking final plat
approval to amend a previously approved plan for a 24, 400 sq. ft. 2 story medical office
building. The amendment consists of revising the location of a shared water line
easement, 1100 Hinesburg Rd.
The Development Review Board held a public hearing on Tuesday, August 19, 2008.
Abby Lisius represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking final plat approval to amend a previously approved plan
for a 24, 400 sq. ft. 2 story medical office building. The amendment consists of
revising the location of a shared water line easement, 1100 Hinesburg Rd.
2. The owner of record of the subject property is East Mountain View, LLC.
3. The subject property is located in the Industrial & Open Space (10) Zoning
District.
4. The plans submitted consist of a two (2) page set of plans, page one (1) entitled,
"Boundary Plat East Mountain View, LLC 1100 Hinesburg Road South
Burlington, VT, prepared by Trudell Consulting Engineers dated 8/26/06, last
revised on 7/7/08.
Zoning District & Dimensional Requirements:
There are no changes to the dimensional requirements as part of this application.
Water Line
The applicant is proposing to relocate the shared water line based on changes which
occurred during construction. The Superintendent of the South Burlington Water
Department has reviewed the plans and stated that he has no concerns about this
proposal and recommends approval.

Other
Upon review of this application, Staff visited the subject property and found several issues
of concern which the board will address as part of this application. The underground
parking was closed with a locked and keyed entrance. All parking which is counted towards
the minimum requirements shall be accessible to the general public when the business is
open.
During these site visits, staff also noticed that the paved drive to the front was blocked with
cones. This too shall be accessible during business hours.

approve Final P at Application D-08-37 of East Mountain View, LLC, subject to the
following conditions:
1. All previous approvals and stipulations shall remain in full effect except as
amended herein.
2. This project shall be completed as shown on the plat submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. All parking shall be accessible. The underground parking garage must remain open
and accessible to the general public during all hours in which the businesses in the
building are open.
4. All drives and lanes shall be accessible during all hours in which the businesses in
the building are open.
5. Any change to the final plat plan shall require approval of the South Burlington
Development Review Board.
6. The final plat plan (survey plat) shall be recorded in the land records within 180
days or this approval is null and void. The plan shall be signed by the Board Chair
or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall
submit a copy of the survey plat in digital format. The format of the digital
information shall require approval of the South Burlington GIS Coordinator.
